About this file
This document is an Addendum (#2) to a Request for Proposals (RFP #6000002329) issued by the Port Authority of New York and New Jersey for Expert Professional Aeronautical Technical Services and Safety Management Systems (SMS) Consulting Services. The solicitation is for call-in services during the period of 2025 through 2029, with consultants expected to provide technical expertise on an as-needed basis. The addendum addresses four specific questions from potential bidders regarding proposal requirements, including clarifications on Minority and Women-owned Business Enterprise (MWBE) participation goals, staff qualifications, and insurance provisions.
The document emphasizes key procurement details, particularly around MWBE participation. A self-performing MWBE prime can satisfy both the 20% Minority Business Enterprise (MBE) and 10% Women-owned Business Enterprise (WBE) goals, though prime contractors must demonstrate good faith efforts to identify separate MBE and WBE subcontractors. Regarding proposal submissions, consultants are permitted to include ongoing projects when demonstrating staff qualifications. The Port Authority maintains a firm stance on insurance requirements, indicating that individual insurance levels will be addressed at the task order level and that no waivers will be automatically granted for insurance limits. Potential bidders with questions are directed to contact Mr. Chase Palmer via email.

SUBJECT: REQUEST FOR PROPOSALS FOR PERFORMANCE OF EXPERT
PROFESSIONAL AERONAUTICAL TECHNICAL SERVICES AND
SAFETY MANAGEMENT SYSTEMS (SMS) CONSULTING SERVICES AS
REQUESTED ON A “CALL-IN” BASIS DURING 2025 THROUGH 2029
(RFP# 6000002329) – ADDENDUM #2
Dear Sir or Madam:
The following are questions from Request for Proposals (RFP) recipients. The questions and the corresponding Port Authority of New York and New Jersey (the Authority) answers are provided for your information and use, as appropriate.
Question #1: Can one subconsultant firm that is MBE and WBE certified count towards both the 20% MBE and 10% WBE percent participation goal requirements?
Answer #1: A self-performing MWBE prime will satisfy both the 20% MBE and 10% WBE goals. For MWBE subcontractors, the prime will need to demonstrate good faith efforts to identify both MBE and WBE subcontractors first, and not use one firm to meet both goals.
Question #2: In Attachment D Staff Qualifications and Experience, the Relevant Projects section requires “a minimum of two and no more than five completed projects comparable to the services contemplated under this solicitation". Please clarify if consultants are able to include ongoing projects as relevant projects for proposed staff.
Answer #2: Yes, you may include ongoing projects.
Question #3: Under Article 24 of the Authority’s standard agreement, can you please confirm and update the provision that the “each occurrence” limits set forth for professional liability and general liability insurance apply to annual aggregate limits consistent with industry-standard coverage?
Answer #3: This can be addressed during the task order level when you are submitting. Each occurrence and aggregate limits are different parameters but in some cases they will be the same. The Port Authority is under no obligation to provide waivers for insurance limits.
Question #4: To proactively and successfully support the Authority’s MBE/WBE/SDVOBs Participation Plan and given the mandatory flow down of the insurance provisions provided under Article 24 of the Authority’s standard agreement, will the Authority provide waivers for subconsultant(s), especially for MBE/WBE/SDVOBs firms, that may not be able to procure outlined limits?
Answer #4: Individual insurance levels will be addressed on a task order level. The Port Authority is under no obligation to provide waivers for insurance limits.
