The building, constructed in 1969, currently lacks a fire sprinkler system and requires a retrofit installation meeting North Carolina Code S-1 for non-separated mixed-use occupancy. Sealed bids are due by 2:00 PM on July 14, 2026, at the Lee County Finance Office, 115 Chatham Street, Suite 301, Sanford, North Carolina 27330. A pre-bid meeting is scheduled for July 7, 2026, at 10:00 AM at the project site. Bids must be submitted in two complete packages with all required documentation or face rejection. The contract is awarded on a lump sum basis to the lowest responsible and responsive bidder. The contract time for substantial completion is 60 calendar days from the Notice to Proceed, with liquidated damages of $500 per calendar day for delays beyond the completion date.
Bidders must include a certified check or bid bond equal to 5 percent of the aggregate base bid amount as bid security. All bids must acknowledge receipt of all addenda and include proof of a valid North Carolina General Contractor's License meeting project requirements. Contractors must provide three references from similar projects completed within the past five years and demonstrate adequate staffing, equipment, and resources. All employees and subcontractor employees must undergo national background checks at the contractor's expense, with documentation provided to the county prior to site access. Lee County requires a 10 percent minority business enterprise (MBE) participation goal and bidders must submit either Affidavit A (good faith efforts), Affidavit B (self-performance), or Affidavit C (minimum MBE participation achieved). Performance and payment bonds equal to 100 percent of the contract price are required upon award. Contractor insurance requirements include workers' compensation, commercial general liability ($2,000,000 aggregate), commercial automobile liability ($1,000,000 combined single limit), professional liability ($1,000,000 claims made), pollution liability ($1,000,000 claims made), cyber liability ($1,000,000 claims made), and abuse and molestation insurance ($300,000 per claim). The county maintains sales tax exemption on materials becoming permanent parts of construction and requires contractor-submitted certified sales tax statements for each invoice. Contract payment is net 30 days from invoice receipt, and the contractor must comply with E-Verify requirements, Iran Divestment Act certification, and Israel Boycott List certification.

To substantiate a refund claim for sales or use taxes paid on purchases of building materials, supplies, fixtures, and equipment by a contractor, County must secure from a contractor certified statements setting forth the specific required information. A “certified statement” is a statement signed by a contractor’s County, a corporate officer of a contractor, or an employee of a contractor who is authorized to provide information set forth in the statement. Such statement must also include the cost of any tangible personal property withdrawn from Contractor’s warehouse stock and the amount of State and local sales or use tax paid thereon by Contractor. Any local sales or use taxes included in Contractor’s statements must be shown separately from the State sales or use taxes. Contractor’s statements must not contain sales or use taxes paid on purchases of tangible personal property purchased by Contractor for use in performing the Contract which does not annex to, affix to or in some manner become a part of the building or structure that is owned or leased by a governmental agency and is being erected, altered or repaired for use by a governmental entity as defined by N.C.G.S. § 105-164.14(c). BUILDING CONSTRUCTION OR REPAIR CONTRACTS
N.C.G.S. 143-128.2 requires that a local government unit or other public or private entity that receives State appropriations for a building project or other State grant funds for a building project, including a building project done by a private entity on a facility to be leased or purchased by the local government unit, where the project cost is one hundred thousand dollars ($100,000) or more, shall have a verifiable ten percent (10%) goal for participation by minority businesses in the total value of the work. A verifiable goal is also required for building projects costing three hundred thousand dollars ($300,000) or more when no state funds are involved. The outreach plan shall also be applicable to the selection process of architectural, engineering, and Construction

Nothing in these guidelines shall be construed to require contractors or awarding authorities to award contracts or subcontracts to or to make purchases of materials or equipment from minority-business contractors or minority-business subcontractors who do not submit the lowest responsible, responsive bid or bids.
