About this file

This document is a Brand Name Justification and Approval (J&A) memorandum from the General Services Administration (GSA) to support the acquisition of MasterCam software licenses for the Navy Command stationed at Keyport, WA.

The memorandum outlines the need for the MasterCam software, including part numbers for Mill 3D, Lathe Full, Multi-Axis, and associated maintenance licenses. The justification cites that the MasterCam software is customized for the Navy's industrial equipment and has been used for over 10 years, and changing the software would significantly increase costs. The contracting activity, GSA, is restricting consideration to only MasterCam as the manufacturer that can meet the Navy's requirements. Market research was conducted, and no other qualified sources were found. This one-time procurement is being conducted under FAR 13.501 for brand name items.

General Services Administration

Memorandum to Federal Acquisition Service (FAS)

Supply Chain Management Contracting Division

Brand Name Justification and Approval (J&A)

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY

The requiring agency is the Navy Command stationed at Keyport, WA, for MasterCam.

The contracting activity is the General Services Administration.

2. NATURE OR DESCRIPTION OF THE ACTION BEING APPROVED

This Brand Name Justification serves to support the acquisition for MasterCam 3D Dynamic Motion Technology (See part numbers requested below). This acquisition is being procured via Sam.gov to ensure the Government is receiving the most competitive price and will limit sources to only manufacturer: MasterCAM.

3. DESCRIPTION OF THE AGENCY’S NEEDS

The following list details the complete requirement:

Line 1: PN Mill 3d Mastercam: for multi-surface machining 3-axis - Quantity: 1 Line 2: PN Mastercam Lathe Full: 2-axis turning with support - Quantity: 1 Line 3: PN Mastercam multi-axis: Add support for 4 and 5 axis motion - Quantity: 1 Line 4: PN MasterCam Maint- Mill 3D: Support Mill-3d - Quantity: 1 Line 5: PN Mastercam Maint- Lathe: Support Lathe - Quantity: 1 Line 6: PN Mastercam Maint- Multiaxis: Support Multiaxis - Quantity: 1

4. IDENTIFICATION OF JUSTIFICATION RATIONALE

The circumstances and rationale for limiting consideration to select schedule contractors for award follows:

This acquisition is conducted under the authority of Federal Acquisition Regulation (FAR) 13.501. In accordance with FAR 13.501(a), an ordering activity must justify its action when restricting consideration to a single source, including brand name justifications. Additionally, this limited source justification will document that this requirement is essential to the Government’s requirements and the market research which indicates that no other brand is qualified to meet Navy’s requirements.

5. DEMONSTRATION OF THE UNIQUE NATURE OF THE REQUIRED

SUPPLY

On October 22, 2024, the required agency submitted a Brand Name Justification Memorandum, to limit sources for the purchase of the above referenced MasterCam Part numbers.

Docusign Envelope ID: AB3AE043-B766-46D2-B176-BFC7B1DB9AC4

The basis for limiting the source for this acquisition is that the above software license is in support of MasterCam and is required for this purchase. The current software, licenses and configurations from MasterCam are customized specifically for their industrial machines being utilized in their industrial complex. This established software and licenses have been in use for over 10 years and to change now would greatly increase the price to utilize their industrial equipment

Therefore, for this acquisition, the contracting activity is restricting the consideration of NAICS Code 511210 to include MasterCam as the only manufacturer that can provide the required phones.

6. DETERMINATION THAT THE ORDER REPRESENTS THE BEST VALUE

The order will be competitive among vendors on SAM.gov as a brand name requirement to ensure the government is receiving the most competitive price. A best value determination will be documented at time of award.

7. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED

In accordance with FAR 13.501, the customer has provided detailed market research that has been conducted to justify this RFQ as Brand Name only. Market research was conducted in October 2024 and documented in Tab 3 of the contract file. This research consisted of reviews of similar previous procurements and a market survey through search engines of open market contractors and Federal Supply Schedule contractors.

Search engines utilized include Google and GSA Advantage catalog referencing the part numbers listed above. A review of GSA Advantage revealed the products are not available via multiple MAS schedules.

8. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION

Prior to any subsequent procurement the market will be reviewed to assess whether any other qualified sources are available and are able to meet the Government’s requirements.

9. CONTRACTING OFFICER CERTIFICATION AND APPROVAL

I certify that the justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge and belief. Based on the above, I hereby determine that it is in the best interest of the Government and most appropriate for this acquisition to be Brand Name.
