About this file
This document is a Limited Sources Justification (LSJ) for a Firm Fixed Price Task Order under the GSA Multiple Award Schedule contract 47QSWA18D008D to provide information technology custom computer programming services in support of the U.S. Environmental Protection Agency (EPA) Office of the Chief Financial Officer (OCFO), Office of Budget (OB). The proposed Task Order, with a total estimated value of $747,000.00, will be awarded to the incumbent contractor KeyLogic Systems LLC to provide project management, operations and maintenance, cloud hosting, and intermittent IT support services for the EPA's Budget Formulation System (BFS) for a 6-month period (3-month base and three 1-month options). This sole source award is necessary to avoid a lapse in critical budget services due to a recent protest filed against the competitive award of a follow-on task order. The justification cites an urgent and compelling need, potential cost savings of $915,120 compared to onboarding a new vendor, and KeyLogic's incumbent experience supporting the BFS since 2000 as the rationale for the limited sources approach.

The General Services Administration (GSA) Assisted Acquisition Services (AAS) makes this Limited Sources Justification (LSJ) for orders pursuant to Federal Acquisition Regulation (FAR) 8.405-6.
i.) Identification of Agency and Contracting Activity:
Agency:
GSA AAS Civilian Business Unit, Sector 5 acting in support of the United States Environmental Protection Agency (EPA), Office of the Chief Financial Officer (OCFO), Office of Budget (OB)
Contracting Activity:
GSA AAS Civilian Business Unit, Sector 5 1800 F Street, NW Washington, D.C. 20405 ii.) Nature and/or Description of Action Being Approved:
The GSA AAS Civilian Business Unit proposes to award a Firm Fixed Price (FFP) Task Order (TO) on a sole source basis to KeyLogic Systems LLC (KeyLogic) under GSA Multiple Award Schedule Number
Formulation System (BFS).
The TO period of performance will be for six months from the date of award (three month base period and three, one-month options). The total estimated dollar value of the TO at award is $747,000.00 including options.
iii.)
Value of $747,000.00):
EPA requires the contractor to support the operation, maintenance, and modification of the agency's BFS and its related interfaces and dashboards. The objectives of the requirement are to improve the management and access of EPA's records and data that are used in the agency's budget planning, formulation, and execution processes; to comply with the Government Performance and Results Act (GPRA); and to meet EPA's budget reporting requirements to the Office of Management and Budget (OMB) and Congress.
The contractor will provide services in the following task areas:
Task 1 - Project Management Support. The contractor will provide project management and oversight of all activities performed by contractor personnel, including subcontractors. Project management tasks include the management, oversight, functional, and technical support of all activities performed by contractor personnel, including subcontractors, associated with the operation and maintenance of the BFS and its related interfaces and dashboards.
Task 2 Custom Computer Programming Services. The Contractor must operate and maintain the existing BFS, all related modules/applications, dashboards, disaster recovery environments, and perform daily health checks, submit incident reports to EPA, and maintain a log of all incidents in accordance with EPA standards. The Contractor must inform the Government as soon as possible on critical issues needing immediate attention. Application/dashboard maintenance includes correcting deficiencies identified during testing and system use, upgrading system software as necessary, and optimizing system performance as operational factors fluctuate. This includes cloud environment configuration, maintenance, monitoring cloud and system performance during peak budget workload hours, and support to respond to urgent/emergency budget directives from OMB, Congress, and/or EPA Executives.
Value of $747,000.00)
$747,000.00 including
Task 3 - Intermittent IT Support. The Contractor must support EPA, OCFO, and OB, when workload amounts and priorities fluctuate as it relates to operation and maintenance of BFS, and Qlik dashboards for organizations within the Agency. Historically, workload demands can range from 20% to 40% from one month to the next. The priorities may require one dedicated resource to support this effort during the OMB budget submissions and Congressional Justification, when Congress passes an annual budget, and when budget drills are required from Congress or EPA Senior Management.
Task 4 - Cloud Hosting. The Contractor must provide monthly cloud hosting services, metrics to include the number of users, number of applications supported, and recommendations for
Requirements monthly.
iv.) The Authority and Supporting Rationale:
The acquisition will be conducted under the authority of the Multiple Award Schedule (MAS) Program.
Consideration of MAS contractors will be restricted in accordance with:
a. FAR 8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays.
The proposed TO will be awarded to KeyLogic because it was the incumbent contractor on the previous TO and can most efficiently and effectively satisfy the urgent and compelling need for these services. Procuring this requirement on the multiple awards schedule as a sole source award is the only way for EPA to prevent a prolonged lapse in service.
Background
The EPA BFS is a Platform as a Service solution hosted in the Microsoft (MS) for Government Azure cloud environment. KeyLogic holds the Azure tenant subscription with MS that hosts the BFS. The BFS application is utilized throughout the budget formulation and execution cycles to perform mission critical multiple modules and dashboards that link budget and performance data in support of EPA's efforts to comply with the requirements of the GPRA. EPA's budget personnel also use the data to generate EPA's budget submission to the Office of Management and Budget (OMB) and Congress.
KeyLogic was the incumbent on the previousTO contract performing the same services. The previous
Region 9), who contracted for this service via TO 47QFPA19F0013 off of the Multiple Award Schedule contract 47QSWA18D008D. The previous TO was awarded on March 14, 2019, and expired on September 14, 2024. In September 2024, GSA awarded TO #47QFDA24F0031 and on September 23, 2024, cFocus Software Incorporated filed a GAO protest triggering the Competition in Contracting Act's provide project management, operations and maintenance, cloud hosting, and intermittent IT services in support of the BFS until the protest is resolved.
The EPA has an urgent need to access the environment in which the BFS is hosted for the system to be operational for Agency budget use as well as other budget related systems supporting payroll and financial data. The EPA OCFO OBO is currently in the middl algorithms, quality assurance inspection of outputs, and loading the funding data into the budget system.
This process relies exclusively on BFS to perform these activities within the allotted time frame to ensure stay of performance, which resulted in a lapse in service.
It is not uncommon for minor modifications to the complex algorithms as a result of the quality assurance inspections and must be completed prior to the loading of the funding data. These changes must be executed and tested in an extremely short time fram budget/funding process is necessary to ensure these algorithmic changes are made within the required timeframe. In addition, contractor support is needed to load the various budgets, manage spending within Congressional limits, and to enter payroll data.
The work to be performed requires a thorough understanding and experience with EPA budget and financial systems and the technical ability to support the EPA OCFO OB, the EPA Office of Planning and Performance (OPP), and other agencies in the continued operations, maintenance and modification of the BFS, and the budget and financial dashboards. KeyLogic has supported the development, operations and maintenance of all EPA OB budget formulation and execution systems for every budget cycle since 2000 which makes them uniquely qualified to provide the services under the proposed TO without further harm to daily operations.
The period of performance and the scope of the services for the proposed order are limited to the urgent services needed to immediately sustain successful budget/funding operations pending the resolution of the development, operations and maintenance of all EPA OB budget formulation and execution systems. Based on the urgent and compelling needs of continued services for EPA, awarding this TO to KeyLogic will be the most optimal solution until a determination of the protest is made; while avoiding additional unacceptable delays. Further, based on analysis of historical data awarding the TO to KeyLogic will result in cost savings of approximately $915,120.00 compared to on-boarding a new vendor:
allocating Government personnel to train the new contractor staff is approximately (6-9 months for 7 staff).
-in time and costs of $400,000.00: Transition-in cost is not required, resulting in an estimated savings of $400,000.00. This is based on prices paid by the Government or transition services under contracts/task orders for the same or similar services.
staff will need PIV cards in order to commence work. The effective date will need to be delayed 45 days to ling process, which will result in unsupported time for the
BFS. Savings in unsupported time average 2-month delay for at least all staff members based on previous experience of onboarding contractors.
makes them the only capable source of providing the services in the required timeframe under the circumstances, prior to awaiting the results of the protest. An award to KeyLogic under the authority of
FAR 8.405-
technical risk, start up time, and further impact to daily operations.
Period of Performance three one-month options). The basis for the period of performance is to provide time for resolution of the protest and any corrective action, if required. The period of performance and the scope of the services are limited to the urgent services needed to immediately sustain successful budget/funding operations.
v.) Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with FAR 8.404(d):
The proposed TO will be issued to KeyLogic against the existing GSA MAS contract 47QSWA18D008D.
GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at in time and costs of $400,000.00: Transition estimated savings of $400,000.00. This is based on prices paid by the Government or transition services savings of approximately $915,120.00 compared to on discounts'' will be requested in accordance with FAR 8.405-4. The level of effort and the mix of labor quoted to perform the services being ordered will be considered in determining price reasonableness.
vi.) Description of the Market Research Conducted Among Schedule Holders and the Results of the Research:
No additional market research was performed. Under the original order, market research was performed in May 2023 for the competitive procurement that is currently under protest. The market research consisted of scope compatibility reviews of existing GSA contract vehicles and a Request for Information (RFI) using the GSA Market Research as a Service tool. The RFI was issued to all vendors under North American Industrial Classification System (NAICS) code 541511 - Custom Computer Programming Services/ Special Item Number (SIN) 54151S - Information Technology Professional Services. The results of the market research indicated the services are commercially available through the GSA Multiple Award Schedule that was used as a basis to develop the acquisition strategy for the procurement under protest.
vii.) Any Other Facts Supporting the Justification:
There are no other known facts.
viii.) Statement of the Actions, if Any, the Agency May Take to Remove or Overcome any Barriers that Led to the Restricted Consideration Before Any Subsequent Acquisition for the Supplies or Services is Made:
stay of performance which was triggered by a protest filed with GAO of the award of for the continuation of services that are currently suspended under TO #47QFDA24F0031. The award of TO #47QFDA24F0031 was the result of full and open competition.
