About this file
This document is a Justification and Approval for Other Than Full and Open Competition for Brand Name procurement issued by the U.S. General Services Administration (GSA), Office of Centralized Acquisition Services (OCAS), on behalf of the GSA Office of Chief Information Officer. The procurement seeks HVAC hardware support services for the Regional Infrastructure Center (RIC) located at the GSA Region 8 Regional Office Building in Denver, Colorado. The requirement covers a base period of 12 months plus two 12-month option periods, with an estimated total contract value that is redacted in the document. The contract type is Firm Fixed Price (FFP), with a period of performance from September 29, 2026 through September 28, 2029.
The procurement is justified under RFO Subpart 6.103-1 (Only One Responsible Source) because GSA's existing HVAC equipment is exclusively manufactured by Liebert (part of Vertiv), which requires certified technicians trained specifically to repair Liebert equipment and respond to service calls within 24 hours. The specific Liebert equipment models requiring support are identified by model and serial numbers. Market research conducted via GSA e-Buy and SAM.gov from September 4-10, 2026 identified two potential vendors; however, only one (Professionals HIR LLC, the incumbent) was found capable of supporting Liebert equipment, while the second vendor indicated it does not support the Liebert brand. Despite the brand-name justification, GSA will issue the solicitation as a 100% Small Business Set-Aside on a competitive basis via SAM.gov to allow all qualified, authorized resellers of Liebert products and services an opportunity to compete. Price reasonableness will be validated through comparison against an independent government cost estimate (IGCE) and competitive quotes from authorized resellers.

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for Other Than Full And Open Competition For Brand Name Justification.”
This requirement is in support of OCIO - Office of Chief Information Officer (I), 1800 F Street, NW Washington, D.C. 20405. The contracting activity is the Office of Centralized Acquisition Services (OCAS) Office of Internal Acquisition Service Center, 1800 F Street NW, Washington, DC 20405.
2. Nature and/or description of the item/service being procured and anticipated cost.
This acquisition is conducted under the statutory authority of the Revolutionary Federal Acquisition Regulation Overhaul (RFO) Subpart 12.201-1 Simplified Procedures authorized by 41 U.S.C. 1901.
This part provides policies and procedures to streamline the acquisition of commercial products, including commercially available off-the-shelf (COTS) items (a subset of commercial products), and commercial services in accordance with 41 U.S.C. 1906, 1907, and 3307 and 10 U.S.C. 3451-3453.
(a) Brief Description:
GSA FAS OCAS intends to provide brand name support for hardware manufactured by Liebert Co. on behalf of GSA IT.
GSA IT has a requirement to establish a Service Agreement to support the Regional Infrastructure Center (RIC) at the GSA Region 8 Regional Office Building, in Denver, CO. A Request for Proposal (RFP) will be issued as 100% Small Business Set Aside on a competitive basis via SAM.gov. As determined through market research, there is only one vendor that can provide support service to Liebert manufactured hardware; however, GSA will issue a competitive RFP to provide authorized resellers of Liebert products and services an opportunity to compete for this procurement.

4. An identification of the statutory authority permitting other than full and open competition.
This Justification and approval is issued in accordance with the Revolutionary Federal Acquisition Regulation Overhaul (RFO) Subpart 6.103 Other than full and open competition which states that (a) agencies may contract without providing for full and open competition under authorities specified in this section and RFO Subpart 6.103(d) Justification.
Pursuant to the authority in RFO Subpart 6.103-1 Only one responsible source and no other supplies or services will satisfy agency requirements (a) Authority in 10 U.S.C. 3204(a)(1) or 41 U.S.C. 3304(a)(1).
(d) Application for brand-name descriptions. Use of brand-name descriptions, or specification of attributes peculiar to one manufacturer, prevents full and open competition and should only be used when justified and approved according to 6.104. This does not apply to “brand name or equal” descriptions as they provide for full and open competition.
GSA has determined that the procurement requires a limited source to satisfy the Agency’s needs.
Specifically, the basis for use of other than full and open competition is that GSA hardware to be supported is manufactured by Liebert co. (part of Vertiv), whose maintenance must be provided by certified technicians trained to specifically repair Liebert equipment. The requirement is for a contractor who must be able to respond to service calls as per the specifications of the listed equipment model numbers within 24 hours.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
The current vendor is an authorized reseller/service provider of hardware and capable of providing support for the below listed Liebert manufactured equipment. The vendor has been the service provider and has knowledge of the specific equipment listed below. With proven experience and the current familiarity of the technicians with the locations of the equipment, the Government will be able to continue the current maintenance schedule needed to keep the equipment functioning properly.
The hardware to be supported are Liebert manufactured models as follows:
Unit Model Number Unit Serial Number
○ VNSA16-ICOM C11G860440
○ DCSL60K-A 1129C36499
○ DCSL60K-A 1129C36525
○ DCSL60K-A 1130C36568
○ DCSL60K-A 1130C36583
○ CR020RA1A7X150 N11FBM0063
○ CR020RA1A7X150 N11FBM0064
○ CR020RA1A7X150 N11FBM0065
○ CR020RA1A7X150 N11FBM0066
Currently the Vendor’s technicians can be dispatched to the specified site and are qualified to work on the hardware as specified by this agreement. The existing HVAC units in the Region 8 Regional Infrastructure Center (RIC) provide vital cooling services to keep the room temperature in a range required for the stable function of the GSA IT hardware. These HVAC units need hardware support services required as the performance of regular manufacturer recommended preventive maintenance to ensure continuous operation. This hardware also needs to provide for response for critical outages and repair services for unexpected critical hardware events that need an immediate response to mitigate or correct potential interruptions in temperature control for the space.
The Regional Infrastructure Center (RIC) at the Region 8 Regional Office Building houses critical GSA IT infrastructure hardware for the region's IT services. Managing the environmental conditions, including temperature control, of the RIC’s physical space is a critical aspect for maintaining the stable function of the IT hardware in that space. GSA owned Liebert HVAC equipment is controlled by a control unit connecting multiple cooling units equipped with Liebert unit control, allowing them to communicate and function as a team, and supports lead/lag operation of the environment where the Regional Infrastructure Center HVACs are located.
The provider must be an authorized service technician, who has experience with the current installations, history of the maintenance at this facility, has certification of maintenance personnel which forms the basis of the support needed for Liebert equipment support. The current environment continues to need support which lapsed in July 2026 and maintenance support is urgently needed as of July 31, 2026 and the current provider is verified as certified to perform necessary maintenance. The vendor is also the only known service provider of Liebert equipment at the Regional Infrastructure Center (RIC) R8 location.
The vendor is currently uniquely positioned to continue providing these services on an uninterrupted basis and to allow for maintenance on the current HVAC installations to be properly maintained as the equipment approaches end of life. As such, it is in the best interest of the Government to continue receiving maintenance services from an authorized contractor by awarding the renewal of maintenance services contract to the Vendor.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is possible, including whether a notice was or will be publicized as required by Subpart
5.2 and, if not, which exception under 5 and if not, which exception under part 5 applies.
RFO Subpart 5101(b)(1)(i) Pre-solicitation - The contracting officer is not required to post a pre-solicitation notice to the GPE when the value is at or below the simplified acquisition threshold (SAT) and the solicitation will be posted to the GPE in accordance with 5.201; and permit the public to respond to the solicitation electronically.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Price validation will be achieved through comparison of the IGCE and adequate price competition from authorized resellers. The IGCE developed for planning was based on market research from historical data and was benchmarked against the agency's independent government cost estimate (IGCE).
The Contracting Officer will assess all quotes received in response to the solicitation to determine the quotes received represent a fair and reasonable price consistent with historical pricing data. Based on the above assessment, there is an anticipation that the cost to the Government will be fair and reasonable.
8. The market research conducted (see part 10) and the results or a statement of the reason market research was not conducted.
Market research was conducted using GSA Advantage, GSA e-Library, and the System for Award Management (SAM) from September 4, 2026 through September 10, 2026 and using procurement history in establishing the capable source of providing HVAC maintenance services to Region 8 Facilities Infrastructure Management Branch (IXBM).
Request for Information (RFI) RFI no. 090426, was issued via GSA e-Buy and SAM.gov. GSA received a total of two (2) responses to the RFI; however, one (1) of two (2) was found responsive (Professionals
HIR LLC, incumbent). The capable vendor, Professionals HIR LLC, does not have NAICS CODE 238220 on its GSA FSS schedule. The remaining vendor expressed its interest in the Region 8 ROB RIC HVAC Support acquisition, however, the vendor also informed GSA that it doesn’t support the brand Liebert, and they will be responding to the request for proposal.
This acquisition will be issued as 100% Small Business set-aside via sam.gov to all qualified vendors authorized to provide support hardware manufactured by Liebert.
The following sources were identified during the market research:
● - Capable
● – Not Capable
9. Any other facts supporting using other than full and open competition.
None.
10. A listing of the sources, if any, that expressed an interest in the acquisition in writing.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The program office shall review this requirement on an annual basis and conduct additional market research to ensure that in instances where brand name requirements are not necessary to meet the Government’s needs, similar requirements will be completed on the basis of full and open competition to the maximum extent practicable (without limiting competition to those that carry a specific brand name.
