Justification for Other Than Full and Open Competition

This document is a Sole Source Justification (SSJ) for a contract modification with Midwest Landscaping Inc. (UEI: L6F1NMBYQ5M8) under General Services Administration (GSA) Public Buildings Service authority. The modification extends contract number 47PF0021D0007 for a two-month period from October 1, 2026, through November 30, 2026, to provide landscaping and related services at three federal facilities in Ohio: Anthony J. Celebrezze Federal Building in Cleveland, Carl B. Stokes US Courthouse in Cleveland, and Donald J. Pease Federal Building in Medina. The estimated contract value is $11,300.00 on a firm-fixed-price basis.

The services required encompass fall and winter season landscape maintenance including lawn mowing, leaf removal, soil aeration, perennial cutbacks, and preparation of planting beds for dormancy. The justification for sole source procurement under 41 U.S.C. 3304(a)(2) (Unusual and Compelling Urgency) cites the contractor's satisfactory ongoing performance, specialized facility knowledge, and possession of required GSA ENT user credentials and security clearances that would not be available to alternative sources within the accelerated timeline. The competitive procurement for the follow-on contract is underway with an expected award date of February 1, 2027, and new services are scheduled to commence April 1, 2027, aligned with the standard landscaping season. The contracting officer, Natasha Cunningham, signed and certified this justification on August 6, 2026, and the document will be publicly posted within 30 days for a minimum 30-day availability period in compliance with regulatory requirements.

☐ Brand Name Justification ☒ Sole Source Justification (SSJ)

If SSJ, Annotate the following: Vendor Name: Midwest Landscaping Inc. UEI: L6F1NMBYQ5M8

2. Nature and/or description of the action being approved

This activity proposes a two-month extension to the period of performance for contract number 47PF0021D0007 on the basis of other than full and open competition. This firm-fixed-price extension for landscaping and related services will run from October 1, 2026, to November 30, 2026. To prevent any lapse in landscaping services at GSA facilities while the follow-on contract is finalized. The competitive procurement process for the replacement contract is currently underway, with an expected award start date of April 1, 2027, to align with the standard April-to-November landscaping season.

3. A description of the supplies or services required to meet the agency's needs (including the estimated value)

To prepare the grounds for the winter season, landscaping clean-up services will be carried out from October through November.

These required services encompass, but are not limited to: lawn mowing, leaf removal, soil aeration, perennial cutbacks, and preparing planting beds for dormancy.

The estimated value is $11,300.00.

4. An identification of the statutory authority permitting other than full and open competition

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(2) as implemented by RFO 6.103-2, Unusual and compelling urgency.

5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires using the authority cited

Midwest Landscaping Inc. qualifies to deliver these services to GSA PBS due to their satisfactory ongoing performance and specialized knowledge of the facilities and required tasks. Furthermore, the contractor personnel possess GSA ENT user credential and a favorably adjudicated security clearance, granting them complete access to the system and facility. This justification to restrict competition is essential to safeguard the Government against a service lapse during the follow-on contract procurement while the follow-on procurement is being finalized, previously delayed by a scope-related solicitation cancellation.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as possible, including whether a notice was or will be publicized as required by part 5 and, if not, which exception under part 5 applies.

To maximize competition, the follow-on requirement will be solicited from as many potential sources as possible. In compliance with RFO 6.301, this justification will be officially posted within 30 days following the execution of the modification and will remain available for a minimum of 30 days.

7. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable

To establish that the cost of this acquisition to the Government is fair and reasonable, a comprehensive price analysis will be performed and documented prior to the modification award. The Contracting Officer will make this determination based on an evaluation of the price information obtained from the contractor in comparison to the current contract pricing.

8. Market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted

Initial market research supported the selection of the current contractor. Because of the accelerated timeline for execution, no other firms possess the required security credentials or specific facility knowledge necessary to assume responsibility before the active performance period expires. The Government has concluded that no alternative source is available to begin operations immediately. Meanwhile, market research is actively progressing to support the upcoming follow-on contract acquisition.

9. Any other facts supporting the use of other than full and open competition

There are no additional facts to be reported.

10. A listing of any sources that expressed a written interest in the acquisition

Given the abbreviated duration of this performance period, no alternative sources were solicited.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required

To guarantee the uninterrupted continuation of fall clean-up services, this period of performance has been extended.

Concurrently, the procurement process for the subsequent follow-on contract is progressing, with an estimated award date targeted for on or around February 1, 2027.

12. CERTIFICATION
