Written Submitted Question Summary
Last Updated 6/05/2024.
All Question Responses are highlighted in Green.
1. What type of licensing is required?
Offerors will be required to provide proof of licensing in the state of which the proposal is being submitted for as part of their proposal submission.
Alabama Contractor License Rule on Government Projects: Work undertaken by representatives of the US government, State of Alabama, or local governments, supervised by licensed architects or engineers, is exempt.
We routinely work federal projects in Alabama and the requirement is to show I have an AE firm on retainer to review plans and specs.
Tennessee Federal Projects - A state license is not required for 100% federal projects (all federally funded and on federal land), unless required by the federal government awarding authority. See AG opinion 92-39 .
See: Leslie Miller, Inc. v. Arkansas, 352 U.S. 187 (1956) This basically says SAM.GOV is the benchmark for qualifying a contractor.
I would ask GSA to amend the requirement to read:
Offerors will be required to provide proof of licensing if required by the state of which the proposal is being submitted for as part of their proposal submission.
Summary: If the SB is not required by the state to have the license it’s an undue burden on Small Businesses to require one. The final point, the state level license offers no guarantee or qualification not already provided by the Federal Government Contractor Registration Process. (SAM.GOV)
Hard requirement should be: Current SAM registered, bonded Small Business
You must be licensed in the state that you are bidding on.
Offerors must submit a current copy of their General Contractor License for the state in which the proposal is being submitted.
