ANNUAL ASBESTOS SURVEILLANCE REPORT

COMPLETED FOR THE

GENERAL SERVICES ADMINISTRATION – SAFETY AND

ENVIRONMENTAL MANAGEMENT BRANCH

A Federal Occupational Health (FOH) Contractor Representative performed a limited walk-through Annual Asbestos Visual Surveillance Check as required by the General Services Administration (GSA) for their owned facilities. No bulk or air samples were collected. Operations and Maintenance (O&M) and Custodial contractors were checked for compliance with GSA contract safety and health requirements listed on the attached checklist. In accordance with GSA instructions only spaces listed on Table A were to be visually checked. During the surveillance check, observations of any potential damage to the asbestos-containing materials (ACM) were noted and recorded. If any imminently dangerous situations been discovered, they would have been immediately reported by the FOH Representative to GSA Customer Service Center (CSC) Manager and GSA Safety and Environmental Management Branch Representative in accordance with GSA established procedure. The GSA Form 3614, GSA Notice of Unsafe/Unhealthful Workplace Conditions, was to be completed on-site for any potential safety and health violations. One GSA Form 3614 may list multiple violations. An opportunity to correct violations, if any, would be given to the GSA employee or representative during the surveillance. Those violations corrected are noted in the text of the report.

The FOH Contractor Representative used the GSA ACM Checklist FY 2016, which was approved by GSA for consistency purposes and to ensure the required information was obtained at this facility. The checklist and 3614 forms, if any, are attached to this report as back-up information.

This report was based on personal observations during the surveillance check and from conversations with on-site personnel. Not all possible hazards and conditions may have been listed during this brief inspection because equipment, regulations, operations and personnel changes may not be evident.

The report contained the following GSA required sections: Building Descriptions, General Findings, Comments and Concerns, Action Items, 3614s, Corrected Items and Other.

Note: The FOH Contractor Representative designated in this project is an employee of CIH Services, Inc. which has performed the services indicated in this report. Nothing in this report is intended nor should be interpreted as establishing any form of employment or contractor relationship between the FOH Contractor Representative and General Services Administration, Federal Occupational Health, U. S. Public Health Service, or any division, agency, or contractor thereof.

Reports and other publications issued by the Environmental Health Services program of the Federal Occupational Health (FOH) were prepared under procedures established by FOH, which were designed to assure the technical competency of the persons or organizations under contract to FOH. In addition, reports and other publications were reviewed internally by one or more FOH technical staff, and all comments were addressed to the satisfaction of the issuing office, prior to dissemination.

U. S. COURT OF APPEALS

GSA BUILDING NUMBER GA0008ZZ

ATLANTA, GEORGIA 30303

I. BUILDING DESCRIPTION

The United States Court of Appeals building is located at 56 Forsyth Street in Atlanta, Georgia, GSA Building No. GA0008ZZ. The building consists of six (6) stories and a basement. The roof structure is copper and slate. The total gross square footage is approximately 189,350 square feet. The general construction of the building is brick and stone exterior with interior concrete and terrazzo floor finishes in the lobbies and hallways. The walls and ceilings are a combination of concrete and plaster in the older areas of the building with sheet rock finishes in the newer areas. Exposed ceiling tiles are predominate; however the original plaster is exposed in the entry lobby and some hallways.

The facility is heated and air conditioned utilizing the following mechanical systems. The conditioned air is supplied by air handler units (AHUs) B-1, B-2 and B-4 located in the northwest corner of the basement. These serve the GSA office and the library. All AHUs were replaced in 2016. AHUs 1-1 and 1-2 are located above the first floor and supply the first floor and mezzanine. AHUs 2-1 and 2-2 located on the second floor serve the second floor. AHUs 5-1 and 5-2 located on the fifth supply air to the courtrooms on the third floor. AHUs 6-1 and 6-2 are located on the sixth floor north and supply air to the third, fourth and fifth floors. AHUs 6-3 and 6-4 located on the sixth floor south distribute air to the sixth floor and the two fifth floor courtrooms.

A boiler supplies heating water to the AHUs. Chillers supply cooling water to the AHUs. The cooling tower and chillers were installed around 1985. The building systems included chill water supply and return piping, heating water supply and return piping, domestic hot and cold water supply and returns and condenser supply and return lines.

According to the O&M and the GSA Building Manager (BM), all plaster materials in the 3rd floor renovation of the 10 NW offices and hallway were removed in 2016. This area was gutted. In 2014/2015, 4 NE offices on the outer wall were gutted. No letters stating "Asbestos Free, no asbestos put back during renovation" have been located for any of these renovations.

ATLANTA, GEORGIA 30303

II. GENERAL FINDINGS

An Annual Asbestos-Containing Material (ACM) Visual Surveillance Check of the U. S. Court of Appeals building was conducted by Federal Occupational Health (FOH) Contractor Representative, Arthur Tippit, CIH, on November 16, 2016.

Mr. Dale Pelchat, J's Services, O&M mechanic accompanied the inspector during this survey. This is a Contractor-operated facility.

Physical damage was observed to suspect plaster walls and ceilings on all five floors. Damaged areas range in size to < 3 square feet/linear feet to 15 square feet. Plaster debris was observed on top of a ceiling tile in the 4th floor hallway.

Also holes in sheetrock at PACM joint compound were observed on various floors above the drop ceiling. Asbestos containing floor tile in the 4th floor restroom was dull and scuffed. The remainder of the ACM observed during the course of this building re-surveillance was in good condition and did not exhibit any noticeable damage. Each area of damaged ceiling and wall plaster should be sampled and analyzed immediately to determine ACM content.

Previous sample results are inconclusive.

The overall building Risk Assessment Code (RAC) is 3. No significant adverse findings (RAC 1 or 2) were identified during this surveillance. Three (3) citations were issued during this visual surveillance of which three (3) were repeat citations.

Two (2) corrective actions were taken during this surveillance.

Inaccessible spaces – The following spaces were not accessible during the visual surveillance: All Courtrooms, Judges’ Offices and Suites, and robing areas. Courts were being held on the 3rd floor and no entry to this floor was permitted.

No new suspect ACM was identified during this surveillance check.

No additional asbestos sampling and analytical reports were available since the previous asbestos Annual Visual Surveillance Report.

This Annual Visual ACM Surveillance Check was performed using the most recent FOH Annual Visual ACM Surveillance Check Report and Spreadsheet.

Any additional information obtained by the FOH Contractor Representative during this surveillance check was added to the table. The FOH Contractor Representative did not conduct any asbestos sampling or measure ACM quantities other than noting if ACM were removed since the last surveillance.

The FOH Contractor Representative may note suspect materials that were not previously identified or tested and list them in the spreadsheet (Table A) as suspect and recommend for testing.

Findings are located in the attached table.

Any future changes to the quantity and condition of ACM in the facility should be incorporated into GSA’s Operations and Maintenance (O&M) Plan.

Photographs were taken of deficiencies where possible and are included in the body of the report, underneath the appropriate citation, and in Table A.

OSHA/GSA deficiencies (Form 3614) issued during this survey are attached at the back of this report along with Form 3559.

Attachments located at the back of this report include: 1) An Annual ACM Visual Surveillance Table A, 2) Survey Notes, 3) Form(s) 3614 and 3559.

III. COMMENTS

The following is a list of comments and several concerns noted during this re-surveillance check:

· Physical damage was observed to ceiling and wall plaster on all floors above the drop ceilings. Areas range from less than 3 square feet to 15 square feet.

Debris was observed on top of the ceiling tile in the corner intersection of the hallway where new cameras had been installed on the 4th floor (Forsyth and Walton corner). Examples are below:

· Dull scuffed VAT was observed in the 4th floor women's restroom.

ATLANTA, GEORGIA 30303

· The remainder of the ACM viewed during this surveillance was in good condition.

· The Building Manager (BM) for GSA, Richard Pace, maintained the building records.

· The GSA BM had current asbestos training.

· GSA had distributed the annual asbestos letter to the tenants, O&M and custodians noting the current status, condition and location of ACM within the building.

· GSA maintained copies of previous asbestos inspections and surveillance checks at this facility.

The following asbestos survey reports must be maintained on-site:

• Asbestos Survey Report dated October 31, 2007 by FOH

• January 15, 1991 Initial Asbestos Survey Report by Cavin Analytical

• December 19, 1995 Asbestos Survey Report by Diversified Environmental

Management, Inc.

• December 20, 2002 Pre-Renovation (partial) Report by unknown author

• January 15, 2003 6-Month Periodic Surveillance Check by FOH with sampling data

• February 27, 2003 Asbestos Survey Report by Environomics, Inc.

• Asbestos Survey Report by Durbin and Associates for the 2nd and 5th floors, circa July 2005

· GSA’s contract has the following nine asbestos O&M requirements: 1) at least one O&M asbestos trained worker/O&M person on-site; 2) annual fit tests; 3) annual medical exams; 4) the EPA “Green Book” on-site; 5) the NIBS O&M book (either available onsite or access to); 6) Asbestos repair equipment onsite; 7) written respirator program; 8) written medical surveillance plan; and

9) written protective equipment plan. The O&M contractor had an agreement with Penta Engineering, an asbestos contractor to conduct all asbestos related O&M work.

· The Custodial contractor had all the required training and written documentation. A slow speed buffer was on-site.

· A contractor notification and sign-in sheet regarding the presence of ACM within the building was present and implemented by the O&M contractor.

IV. ACTION ITEMS

· Sample each area of damaged plaster to determine ACM content.

Repair/seal/HEPA vacuum ceiling tiles, clean up damaged areas of plaster and debris in accordance with federal, state, local and GSA regulations. Treat as ACM until sampled and analyzed.

· Maintain wax coating on exposed VAT. Seal damaged areas of suspect joint compound.

· Maintain ACM and suspect ACM in good condition.

· Distribute the annual asbestos notification letter to tenants and O&M/Custodial contractors regarding status, condition, presence and location of ACM in the building.

· Ensure GSA Building Mangers were provided with appropriate and timely asbestos training.

· Continue to label all accessible ACM material.

· Maintain copies of inspection and surveillance reports and current status of ACM at this facility, as well as bulk sampling data on site. Maintain current records on site for all removal, O&M repairs or periodic surveillance activities involving ACM. Maintain building records in one master file.

· Require O&M contractor to continue to meet the asbestos requirements of the O&M contract.

· Asbestos Free stickers should be placed on all reinsulated items that once housed asbestos in order to visually show that ACM is no longer present.

· In the future, GSA should require in all renovation/demolition projects that “no asbestos products be installed” and that the architect or designer sign off to that affect. The signed document should be made a permanent attachment to the file. GSA should test any suspect new materials such as sheetrock mud, mastics, floor tile during the renovation/demolition project to ensure they are asbestos free.

· Require Custodial contractor to continue meeting the asbestos requirements of the Custodial contract.

· Require contractors to sign and date a form, usually found in the O&M plan, regarding notification of the presence of ACM before allowing any contractor to commence work within the building. This document demonstrates communication between the contractor and GSA regarding ACM and procedures for working around ACM.

· Obtain a letter from the architect stating that no asbestos containing products were used during future renovation/demolition of this building. Otherwise conduct an asbestos bulk survey of all new suspect building materials.

· Sample and analyze suspect ACM before performing any renovation or demolition. Maintain these analytical records in the asbestos file to be used for future inspection and surveillances.

· A certified, asbestos trained, 16-hour O&M person must perform all minor repairs or resealing. The changes to the quantity and condition of ACM in the facility should be incorporated into GSA’s Operations and Maintenance (O&M) Plan.

· Review this Annual ACM Surveillance Table A and make any necessary additions or subtractions. Bring to the inspector’s attention these changes during the next surveillance.

V. 3614s

· REPEAT - Physical damage was observed to ceiling and wall plaster on all floors. Areas range from less than 3 square feet to 15 square feet. Debris was observed on top of the ceiling tiles in the corner intersection of the hallway where new cameras had been installed on the 4th floor (Forsyth and Walton corner) and on most floors.

· REPEAT - Dull scuffed VAT was observed in the 4th floor women's restroom and drywall where PACM joint compound would have been present was damaged on the 4th floor at the restroom entrance.

· REPEAT - ACM records were not maintained in the building or updated as required by law. (Specific to 2012 1st floor renovation and the 3rd floor renovations.) Maintain bulk sampling data, what ACM was removed and where and the letter stating no ACM was reinstalled in build back.

ATLANTA, GEORGIA 30303

VI. CORRECTED DEFICIENCIES

The following items were corrected during the day of the surveillance check or shortly thereafter and confirmed by the GSA Building Manager (BM): None.

· The GSA BM had documentation of Asbestos Awareness Training.

· Tenants, O&M and Custodial contractors were notified annually of presence, location and condition of asbestos within their building.

VII. OTHER

When the facility receives this updated ACM Surveillance Table, they and the GSA BM should review it for accuracy and use it to record all changes in ACM amount, location, condition, etc. This table will be requested during all future inspections and surveillance checks and will be audited.

When conducting the next Annual ACM Visual Surveillance, please give the GSA inspector a copy of this report and have them verify all locations. Request that the GSA inspector note any additional suspect ACM. When using the previous Contractor Inspector, request them to use this report and to verify discrepancies between the reports. Require the previous contractor to modify their surveillance report to include the attached spreadsheet. All changes to condition, location, etc. should be made on this standardized report.

The Surveillance Table is to be updated continuously. The table contains three color-highlighted areas that indicate changes in the amount, location or condition of ACM. Red indicates changes in the amount or condition of ACM. Blue denotes “suspect asbestos,” that should be sampled and analyzed before any renovation or demolition occurs. Green indicates that suspect asbestos was determined not to be ACM or that ACM was removed. In the “Condition” column, good implies no or very minor damage (i.e., less than 1 percent), fair implies between 1 and 10 percent overall damage and poor means damage greater than 10 percent overall or 25 percent localized.

TABLE A - ANNUAL ACM VISUAL SURVEILLANCE TABLE

Note: This table is in color. Information will be lost if reproduced in black and white!

This table is for O&M purposes only.

A pre-renovation requires additional evaluation and sampling.
