1.0 Introduction

1.1 Purpose

The General Services Administration (GSA), Public Buildings Service (PBS), Office of Portfolio

Management and Customer Engagement (PT), Real Property Valuation Division (PTA), 1800 F Street, NW, Washington, DC is pursuing a new national Blanket Purchase Agreement (BPA) contract with an established Real Property Informational Services company.

1.2 Objective

This contract will provide valuable commercial real estate data and information resources to enable individual and portfolio-wide management and evaluation of GSA’s owned and leased properties by the various PBS divisions and regions listed below:

Office of Portfolio Management and Customer Engagement: The market data, leasing data and comparable sale data (hereafter referred to as market data) allows PBS to better determine the appropriate strategy for an asset based on its competitive position in the market. The Real

Property Valuation Division uses the information to cross-check appraisals to confirm the subject/comparable property/buildings and that projected rental rates and/or sales prices are comparable to recent market transactions. It will also aid in monitoring how well PBS is operating its owned buildings.

Office of Property Disposal: The market data helps PBS validate independent appraiser valuations to ensure that GSA receives a fair price for properties that are selected for disposal.

Capital Investment Division: Provides knowledge of the local real estate markets to aid in ensuring that any new construction, major R&A or modernization projects will be cost effective.

Leasing and Analysis Divisions: Provides information on the rents and expenses in comparable buildings in local markets to ensure that the rents GSA charges to customer agencies, whether in leased or owned buildings, are consistent with the market.

1.3 Background

The U.S. General Services Administration (GSA), Public Building Services (PBS) requires a nationwide contract to provide national, regional, and local real estate market and property information, which provides both macro and micro market data down to the local comparable level to properly evaluate property specific investment options for owned and leased buildings, property acquisitions and disposals nationwide and to include U.S. Territories.

This acquisition is managed by the Office of Portfolio Management and Customer Engagement

(PT), Real Property Valuation Division (PTA), but is funded by each user’s organization, division, or region.

Work will be primarily performed in the Washington, D.C. Metro area, and in GSA Regional

Offices:

Region 1 = Boston; Region 2 = New York; Region 3 = Philadelphia; Region 4 = Atlanta;

Region 5 = Chicago; Region 6 = Kansas City; Region 7 = Fort Worth; Region 8 = Denver;

Region 9 = San Francisco; Region 10= Auburn, WA; Region 11 & Central Office =

Washington, DC.

Additionally, this includes any field office for these Regional Offices. PBS (Portfolio and

Leasing Divisions and the Regional Leasing, Portfolio, Appraisal and Disposal Divisions) require local comparable real estate market information to validate lease rates, appraisal information and valuations obtained from private sector appraisers, and to evaluate FAR appraisals and set the Fair Annual Rents for its owned inventory, annually. In addition, the

Real Property Valuation Division continually performs a myriad of consultations for various projects that require such market data and forecasts.

The current Blanket Purchase Agreement (BPA) contract number: 47PA0118A0008, which was executed on September 28, 2018, and expires on December 31, 2023. Numerous delivery orders (BPA Calls) under this contract (base and all options) were executed with a current total of approximately 141 nation-wide GSA users. This current BPA contract was intended to procure National, Regional, or Local coverage, but procures only one type of license for nation-wide coverage. This solicitation seeks pricing only for national coverage.

2.0 Scope of Work

GSA-PBS's Office of Portfolio Management and Customer Engagement and National Office of

Leasing along with their regional counterparts need an internet-based computer accessible real property informational database and analysis service. GSA requires national comparable real estate market and property information to research markets and submarkets, and to validate appraisal information obtained from private sector appraisers. Market specific data must include inventories, space availability, new construction inventory, changing trends in vacancy rates, and absorption and growth rates. Building specific information to be provided includes detailed physical building/property characteristics, financial data, operating costs and maintenance history, leasing history, including specific lease transactions and asking rentals. The database must also provide confirmed sale transactions, including sale prices, gross and net rentable square feet, financing data, cap rates, and buyer and seller contact information. Said sales must be tracked and continually updated. Graphic products provided should consist of high-resolution digital images, including maps, floor plans, 360-degree visuals, interior and exterior photographs, and aerial photographs. The Contractor shall provide a continuously updated data base of real estate market data and transactional information to include:

• comprehensive market/submarket/building inventories, trends, and analytics, market and building size, and a variety of other data fields.

• mapping and aerial photographs of buildings and comparable data.

• building specific data including floor plate information, building photographs, and tenant floor-by-floor information.

• Historic trend analytics including rent, vacancy, and absorption. GSA-PBS requires a broad geographic and demographic informational base.

• submarket statistics and boundary maps; a variety of interactive custom and demographic reports as well as quarterly major market overview reports of building vacancy and absorption by market and submarket; confirmed comparable sales transaction, comparable rental rates and lease expirations sort able by property type, property class, geographic location, dates of sale.

• on-site system training available during normal business hours, telephone, and computer-based technical support with 24 hour 7 days a week access.

• the ability for the Contractor to provide research on specific real property to include current and historical building specific rent rates, vacancy, and major improvements.

• the information should aggregate to the national level for the national offices and regionally/market specific for the GSA-PBS regions.

• all information must be directly accessible by GSA-PBS's employee or its Contractors.

• Raw data files that can be provided on a recurring (at least quarterly) basis at the sub-market level for office or industrial space with all rental, tenant improvement, and market concessions information.

• Geographical “shape files” for mapping the individual office submarkets that are covered.

All GSA-PBS users currently have National Coverage – most GSA Central Office and Regional users will require access to the information described above for geographic markets available covering the

United States and its territories.

3.0 Specific Requirements or Tasks

3.1 Specific Requirement or Task 1

The Contractor shall provide a license (or another means of access) and website access to each

GSA user for its exclusive products and individual property data in the contracted metropolitan markets and submarkets in the entire United States of America (USA), provide market and sub-market reports, comparable sales, lease offerings and transactions, and the ability to perform ad-hoc research on individual properties, sub-markets, markets, regions and nationally (ad-hoc research may require an additional fee).

Licenses: The individual licenses (or other means of access to the contractor’s website) for the

Authorized Users may be transferred to other designated employees or Contractors of GSA during the contract term, as needed.

Condition: Contractor shall provide extensive training in the use of its service at no additional expense to GSA (including on/off-site trainings/workshops) to both Central Office and

Regional office staff for the life of the contract.

3.2 Specific Requirement or Task 2

The contractor shall provide Custom Quarterly Reports outlining specific concession and submarket fundamentals, to be made available only within the GSA intranet for GSA personnel.

3.3 Specific Requirement or Task 3

The contractor shall provide Submarket Mapping “Shape” Files quarterly.

5.0 Deliverables

The Contractor shall provide continuously updated commercial property information (e.g., rental rates, sales data, transactional data, property location, operating expenses, rent projections, vacancy rates, etc.) for major markets and submarkets across the USA (and its territories). The information will be provided via the internet to designated GSA employees who obtain access to the database/service through this contract. The service hours of the contractor’s website shall be a minimum of 6:00 am to

11:00 pm EST/EDT, Monday through Friday and 7:00 am to 5:00 pm Saturday. Delivery will be tracked on an ongoing basis by the COR using his/her own access, as well as soliciting selected users in each region to verify the website is active and functioning correctly.

All deliverables under this contract become Government property and are able to be publicly released under the Freedom of Information Act (FOIA), unless the Contractor marks them proprietary, and the

Government concurs.

6.0 Place and Period of Performance

Work shall be primarily performed in the Washington, D.C. Metro area, and in GSA Regional Offices.

Additionally, this includes any field offices for these Regional Offices, as well as remotely for teleworking employees.

The BPA will be established for a maximum duration of five (5) years. The anticipated base period of performance shall be February 1, 2024, to January 31, 2025.

Base Year:

The base year is for a period of 12 months from date of award.

February 01, 2024 – January 31, 2025

Option Year I:

Option Year I, if exercised by the Government, is for a period of 12 months from the end of the Base

Year.

February 01, 2025 – January 31, 2026

Option Year II:

Option Year II, if exercised by the Government, is for a period of 12 months from the end of Option

Year I.

February 01, 2026 – January 31, 2027

Option Year III:

Option Year III, if exercised by the Government, is for a period of 12 months from the end of the

Option Year II.

February 01, 2027 – January 31, 2027

Option Year IV:

Option Year IV, if exercised by the Government, is for a period of 12 months from the end of the

Travel is not required for this contract.

There is no GFE and GFI required for this contract.

9.0 Terms and Conditions

Any standard Terms and Conditions must be reviewed and approved by GSA’s Legal Division prior to executing the contract.

10.0 Security

This contract does not require the contractor to have physical access to Federally controlled workspace or information systems.

10.2 Privacy Act

10.3 Protection of Information

The Contractor shall be responsible for properly protecting all information used, gathered, or developed as a result of work under the contract. In addition, the Contractor shall protect all government data, equipment, or information by treating the material as sensitive. Controlled Unclassified Information (CUI) information, data, and/or equipment shall only be disclosed to authorize personnel. The Contractor shall ensure that appropriate administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, and/or equipment is properly protected. When no longer required, this information, data, and/or equipment shall be returned to Government control, destroyed, or held until otherwise directed. Items returned to the Government will be hand carried or mailed to the COR using certified mail. The Contractor shall destroy unneeded items by burning, shredding, or any other method that precludes the reconstruction of the material.

11.1 GSA Electronic Invoicing

All invoicing shall be done electronically. Password and electronic invoice access shall be obtained through GSA web site at https://finance.ocfo.gsa.gov/. Invoices shall be itemized as per the specific line items utilized during that billing period.

Billing and payment shall be accomplished in accordance with this clause. The Contractor shall have the invoice certified by the client representative. The Contractor’s invoice shall be for no less than one month. The Contractor shall invoice only for the hours, travel, and/or unique services ordered by GSA and actually used in direct support of the client representative’s project. A copy of the Government’s document (receiving report) accepting the covered services shall accompany invoices submitted for payment. A copy of the invoice shall be submitted via email to the Government PM, along with the monthly status reports, at the same time that it is submitted for payment. Failure to comply with the procedures outlined above shall result in your payment being delayed.

The Contractor shall submit with a GSA Form 1142- Release of Claims with submission of the final invoice at the end of the period of performance. A copy of the form should be sent via email to the

Contracting Officer identified in Block 26A of the award document (GSA Form 300) and to the

Contract Specialist and COR identified as the Government POCs in this SOW.

Invoices shall identify the period of service provided and/or deliverables and their associated costs in dollars.

11.3 Inspection and Acceptance

The Government will have fifteen (15) business days to complete the review of each deliverable and accept or reject the deliverable by giving written notice. When the Government fails to complete the review within the review period, the deliverable shall become acceptable, unless an extension of the review period is requested and mutually agreed upon. In the event of rejection of any deliverable, the Contractor shall be so notified in writing by the Government

PM or CO, giving the specific reason(s) for the rejection. The Contractor shall have five (5) business days to correct the rejected deliverable and return it to the Government PM. The

Contractor shall be allowed one (1) resubmission of deliverables.

11.4 Cancellation of Orders

The Government has the right to cancel BPA Calls if the requirement is eliminated, changed, or no longer needed. The Government will notify the BPA Holder, in writing thirty (30) calendar days prior to the stop work date.

11.5 Unauthorized Commitment

The Government PM or any other client representative is not authorized to change any of the terms and conditions of the resultant BPA Calls. Changes, if any, shall be made by the CO only.

11.6 Personal Services

The Government has determined that in order to satisfy the requirements in this SOW the use of a PBS BPA is in the best interest of the Government, economic and other factors considered, and this BPA is not being used to procure personal services prohibited by the Federal

Acquisition Regulation (FAR) Part 37.104 titled "Personal Services Contract."

(a) Definitions. As used in this clause - “Covered telecommunications equipment or services”, “Critical technology”, and “Substantial or essential component” have the meanings provided in FAR 52.204-25, Prohibition on Contracting for Certain Telecommunications and

Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense

Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing-

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Representation. [Contractor to complete and submit to the Contracting Officer] The

Offeror or Contractor represents that it [ ] will or [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract, order, or other contractual instrument resulting from this contract. (3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

FAR 52.216-1 - TYPE OF CONTRACT (APR 1984)

The contract will be a Blanket Purchase Agreement (BPA) which firm fixed price BPA Calls will be issued. The contract will consist of a base year, extending one full year (365 calendar days, 366 calendar days if a leap year occurs) from the date of contract award (As an example, if contract award occurred on

February 1, 2024, the base year is effective through January 31, 2024), and four (4) additional one full year options, to be exercised at the discretion of the Contracting Officer, for a potential total contract duration of five (5) full years from the contract award date.

MAXIMUM ORDER LIMITATION

Maximum Total Contract. The base year and each of the four potential option years will each have a

Maximum Order Limit (MOL) for a total potential aggregate contract total of $7,435,200.00.

MINIMUM ORDER LIMITATION

Guaranteed Minimum. There is no guaranteed minimum for this contract.

Required Post-award Orientation Conference After contract award, and before any work starts, the Contractor may be required to attend an orientation conference conducted by the Contracting Officer. The purpose will be to introduce the Government contract administration team, review their roles and responsibilities, address general paperwork requirements, and cover contractual issues on inspection, acceptance, payments, changes, and disputes.

14.0 Proposal Preparation and Offeror Submissions

The Offeror is advised that all submissions and related materials become the property of the

Government and will not be returned.

INSTRUCTIONS

General:

(1) The Offeror is advised that its technical and price proposals, if accepted by the Government, will form binding parts of the contract that results from this solicitation. Therefore, care must be taken to properly address the requirements set forth in the RFP.

(2) These instructions set forth requirements for preparation and submission of business proposals, and to establish format and specific content of each offer. This is to assure completeness and suitableness for both evaluation purposes and the cohesiveness of the resulting contract. Be sure that the proposal explains how your firm will fully satisfy all of the performance requirements of the intended contract.

(3) To aid in evaluation of proposals, each proposal shall be clearly and concisely presented in writing

(telephonic and telegraphic offers will not be accepted). Include all information required by this solicitation, with pages numbered and logically assembled. Each proposal shall identify the name of the Firm, date of submission, solicitation number, and other details required by the provision at FAR

52.215-1 of this RFP.

(4) A determination of responsibility may require on-site reviews of Firm’s facilities by the

Government. The Firm will be notified in advance if such visits will be conducted.

(5) Failure to comply with these prerequisites will result in a determination by the CO that the Offeror is non-responsible, or if applicable, a referral may be made to the U.S. Small Business Administration for a “Certificate of Competency”.

(b) Proposal Format and Content:

(1) Proprietary Data: Each and every page of both the technical/management and price proposals must be reviewed for and marked as to proprietary data content, by the Offeror, in strict compliance with

FAR Provision 52.215-1. Also see FAR 3.104-4. A single blanket statement at the front of the proposal is not adequate. Failure to mark every page will subject your technical proposal to public release through Freedom of Information Act requests.

(2) Proposal Arrangement: Each proposal shall consist of Two physically separate volumes individually titled and numbered on the exterior of the top covers as stated below. The required number of each proposal volume is also shown:

15.0 EVALUATION FACTORS FOR AWARD

GENERAL

The best value tradeoff process in FAR 15.101-1 will be used in this procurement for the evaluation of offers and the selection of successful offerors. The award may be made on the basis of initial proposals without conducting discussions. Therefore, Offerors are requested to initially submit proposals to the

Government on the most favorable terms from a technical and price standpoint. The one (1) single award Blanket Purchase Agreement, firm-fixed price contract that will result from this solicitation.

EVALUATION PROCESS

A Source Selection Evaluation Board (SSEB) consisting of GSA professional personnel will be convened to review and evaluate all proposals. These evaluations will be based on the responses to both the technical evaluation factors and pricing requirements stated in this RFP.

The evaluation will be conducted using the evaluation criteria as set forth in this Section. The offer should contain the offeror’s best terms from a technical and price standpoint. Proposal clarification/revision requests may be issued which encompass any and all written documentation submitted in response to the RFP as may be deemed necessary by the Contracting Officer to fully explore and evaluate the merits of the proposal submitted.

The proposal shall be evaluated to determine whether the proposed approach meets the requirements established in Section C of the solicitation. GSA, PBS reserves the right to seek clarifications or deficiency corrections prior to determining the proposal technically unacceptable. Any proposal that fails to satisfy the requirements of the solicitation shall be ineligible for award.

The Government intends to evaluate proposals and make award without discussions.

TECHNICAL EVALUATION

Evaluation Criteria

Evaluation will be made on three criteria -- Technical Capability and Understanding of the

Requirements; Past Performance; and Price.

Best value evaluation is, in and of itself, a subjective assessment by the Government of the proposed solution that provides the optimal results to the Government, price and other factors considered.

Subjectivity is inherent in the process and is the cornerstone of the source selection decision. In an effort to provide insight to the offerors as to the decision-making process of the Government, the following information is provided:

In the evaluation, the technical factors are significantly more important than price. While price is not as important as the technical factors, it does have significance to the Government.

The proposals will be rated using the following evaluation criteria

Factor 1 – Technical Capability and Understanding the Requirements

In this evaluation, technical is significantly more important than price;

• Adequacy of current and historical real estate data;

• Adequacy of current and historical market and sub-market analysis and/or reports;

• Technical approach for obtaining and validating data

• Ease of use of the website and search capabilities

Offerors must provide information on (2) recent projects of similar scope to this solicitation, including contact information for the ordering entity for each project. Past Experience minimum of 5 years.

Technical and past performance is significantly more important than price. The Government will perform a technical/price trade off analysis in accordance with the above methodology to determine which proposal provides the best overall value to the Government.

PRICE EVALUATION

The Offeror’s proposed pricing will be evaluated for fair and reasonableness. The proposal may be rejected if it is materially unbalanced. If the offer is unrealistically high or low in price it will be considered indicative of a lack of understanding of the complexity and risk associated with work performed under the resulting contract. If the offer contains an unrealistic price it will not be considered for award.

Price evaluation will be accomplished by adding the evaluated prices (unit price/rate multiplied by estimated hours) for each labor category listed in the schedule in Section B.1 for the

Base Year and each Option Year. The sum of the total evaluated prices for the Base Year and all of the

Option Years will be the Total Evaluated Price for purposes of evaluation.

Price proposals will be evaluated against other proposals submitted, in-house estimates and the current market prices during evaluations. The contractor is also advised that, although price does not bear a numerical rating, it shall be evaluated as stated in FAR Part 15.304

FAR 52.217-5 Evaluation of Options (Jul 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total evaluated price for each of the four option years to the total evaluated price for the base year. Evaluation of the option year prices will not obligate the Government to exercise the option years.

CONTRACT AWARD

The contract will be awarded after the Contracting Officer executes the "Solicitation, Offer and

Award," Standard Form 1449, incorporating proposal attachments/documents including the technical and the price proposal. This RFP does not commit the Government to award a contract.
