Tips for Using the Sourcing Tool
1. Vendors should review available training and confirm that they are able to access the Sourcing Event, enter responses, and upload files well in advance of the date and time response are due to allow sufficient time to seek assistance from the North Carolina eProcurement Help Desk.
2. Vendors may submit their responses early to make sure there are no issues, and then submit a revised response any time prior to the response due date and time. The State will only review the most recent response.
3. Vendors should respond to all relevant sections of the Sourcing Event. Certain questions or items are required in order to submit a response and are denoted with an asterisk. The Sourcing Tool will not allow a response to be submitted unless all required items are completed. The Sourcing Tool will provide error messages to help identify any required information that is missing when response is submitted.
4. Simply saving your response in the Sourcing Tool is not the same as submitting your response to the State. Vendors should make sure they complete the submission process and receive a message that their response was successfully submitted.
5. Only Quotes submitted through the Content Section of the Ariba Sourcing Event will be considered. Quotes submitted through the Message Board will not be accepted or considered for award.
If confidential and proprietary information is included in the quote, also submit one (1) signed, REDACTED copy of the quote.
Such information may include trade secrets defined by N.C. Gen. Stat. § 66-152 and other information exempted from the Public Records Act pursuant to N.C. Gen. Stat. §132- 1.2. Vendor may designate information, Products, Services, or appropriate portions of its response as confidential, consistent with and to the extent permitted under the statutes and rules set forth above. By so redacting any page, or portion of a page, the Vendor warrants that it has formed a good faith opinion, having received such necessary or proper review by counsel and other knowledgeable advisors, that the portions determined to be confidential and proprietary and redacted as such, meet the requirements of the Rules and Statutes set forth above. However, under no circumstances shall price information be designated as confidential.
If the Vendor does not provide a redacted version of the quote with its quote submission, the Department may release an unredacted version if a record request is received.
2.7 REQUEST FOR PROPOSAL CONTENTS
Vendors shall provide responses to all questions and complete all attachments for this RFP that require the Vendor to provide information and upload them to the Sourcing Event in the Sourcing Tool. Vendor may not be able to submit its response in the Sourcing Tool unless all required items are addressed. Vendors shall provide authorized signatures where requested. Failure to provide all required items, or Vendor’s submission of incomplete items, may result in the State rejecting Vendor’s quote, in the State’s sole discretion.

From the grouping of the top three (3) design-builders, the State shall select the design-builder who is the lowest responsive, responsible bidder based on the proposed price. The State may request additional formal responses or submissions from any or all Vendors for the purpose of clarification or to amplify the materials presented in the RFP. Vendors are cautioned, however, that the State is not required to request clarification, and often does not.
Therefore, all responses should be complete and reflect the most favorable terms available from Vendor. Prices cannot be altered or modified as part of a clarification.
d) The State reserves the right to contract references as well as any other known sources to verify Vendor’s past performance. This information may be considered in making an award.
e) Vendors are cautioned that this is a Request for Proposal, not a request or an offer to contract, and the State reserves the unqualified right to reject any and all offers at any time if such rejection is deemed to be in the best interest of the State.
3.4 INTERPRETATION OF TERMS AND PHRASES
This RFP serves two functions: (1) to advise potential Vendors of the parameters of the solution being sought by the State; and
(2) to provide a (together with other specified documents) the terms of the Work Orders resulting from this procurement. The use of phrases such as “shall,” “must,” and “requirements” are intended to create enforceable conditions. In determining whether bids should be evaluated or rejected, the State will take into consideration the degree to which Vendors have proposed or failed to propose solutions that will satisfy the State’s needs as described in the RFP. However, failure to comply with any single requirement may result in the State exercising its discretion to reject a bid in its entirety.
3.5 CONFIDENTIALITY DURING PROCESS
During the evaluation period and prior to award, all information concerning the responses and evaluation is confidential, and possession of the responses and accompanying information is limited to personnel of the issuing agency and any third parties involved in this procurement process, and to the committee responsible for participating in the evaluation. Any attempt on behalf of Vendor to gain such confidential information, or to influence the evaluation process (e.g., contact anyone involved in the evaluation, criticize another Vendor, offer any benefit or information not contained in the bid) in any way is a violation of North Carolina purchasing law and regulations and shall constitute sufficient grounds for disqualification of Vendor’s offer from further evaluation or consideration in the discretion of the State (NCAC 05B. 0103).

3.6 NOTICE TO VENDORS REGARDING TERMS AND CONDITIONS
It shall be Vendor’s responsibility to read the Instructions, the State’s terms and conditions, all relevant exhibits and attachments, and any other components made a part of this RFP and comply with all requirements and specifications herein.
Vendors also are responsible for obtaining and complying with all Addenda and other changes that may be issued in connection with this RFP.
If Vendors have questions, issues, or exceptions regarding any term, condition, instruction, or other component within this RFP, those shall be submitted as questions to the Agency pursuant to Section 2.3 of this RFP. If the State determines that any changes will be made as a result of the points raised, then such decisions will be communicated in the form of an addendum. Other than through this process, and subject to the provisions of Section 2.3, the State rejects and shall not be required to evaluate or consider any additional or modified terms and conditions or Instructions to Vendor submitted with Vendor’s bid. This applies to any language appearing in or attached to the RFP as part of the Vendor’s bid that purport to vary any terms and conditions or FEMA rules, requirements, standards, HMGP requirements and/or the State’s instructions herein or to render the RFP as non-binding or subject to further negotiation. Vendor’s bid shall constitute a firm offer to perform HMGP contracts assigned or awarded to Vendor after competitive bidding. By execution and delivery of a response to the RFP, Vendor agrees that any additional or modified terms and conditions, including Instructions to Vendors, whether submitted purposely or inadvertently, or any purported condition to the offer shall have no force or effect, and will be disregarded unless expressly agreed upon through negotiations and incorporated by way of a Best and Final Offer (BAFO). Noncompliance with, or any attempt to alter or delete, this paragraph shall constitute grounds to reject Vendor’s Bid as nonresponsive.
4.0 REQUIREMENTS
This section lists the requirements related to this RFP. By submitting a response, the Vendor agrees to meet all the stated requirements in this Section as well as any other specifications, requirements, and terms and conditions stated in this RFP. If the Vendor is unclear or has any questions about the specifications, requirements, or terms and conditions herein, it is urged and cautioned to contact the issuing agency Contract Lead as specified in this Request.
4.1 PRICING
This RFP requires Vendor to provide its best price per line item for each project, whether that be per square-foot or a lump-sum fixed price, including all applicable charges for including all applicable charges for labor, materials, transportation, general and administrative overhead, and profit for each project within this RFP. Complete ATTACHMENT A: BID WORKSHEET and Attachment A supplement (Worksheets Attached in Email) and include in Bid. The individual pricing items provided in ATTACHMENT A and Attachment A supplement, or resulting from any negotiations, is incorporated herein and shall become the price for each element on the resulting Contract.
This RFP will require the Vendor to provide the best price per square foot (or lump sum fixed price) for each project bid for elevation. Any costs not reflected in the Work Order (WO) will be paid out according to an authorized change order after showing documentation that additional costs are required by the Authority Having Jurisdiction. The Work Order (WO) is a comprehensive document that contains the awarded vendor name, price awarded pursuant to this RFP, address of the project, program and insurance requirements that shall be followed by awarded vendor. Change Order pricing shall be negotiated between Vendor and NCEM.
Price shall constitute the total cost to the State for all deliverables required in each Work Order. Vendor shall not invoice for any amounts not specifically allowed for in this Work Order Batch per ATTACHMENT A: BID WORKSHEET and included with Vendor’s bid. Vendor shall submit for any and all projects in this RFP.
4.2 IMPORT TARIFF TEMPORARY SURCHARGE
Pricing shall be exclusive of any pending tariffs or temporary tariff surcharge. Vendor may request a temporary tariff surcharge in ATTACHMENT A: PRICING SUBMITTAL WORKBOOK as a charge separate from the contract price. Any temporary tariff surcharge(s) associated with purchases shall be provided by way of a percentage tariff surcharge. All tariff surcharges proposed are intended to be temporary and based on current tariff implications specific to related commodities with evidence of submitted documentation of affected MSRP products. Vendor understands that the agency may request additional justification. Any temporary tariff surcharge percentage will be negotiated and mutually agreed upon. The state is not obligated to accept any proposed import tariff surcharge. Proposed tariff surcharges may be used as a factor for evaluation and award.
Ver: 11/2025 12
4.3 APPROVED PRICING AND COSTS
CONSTRUCTION COSTS: Vendors will have to agree to pricing, which is different depending upon the batch awarded. For projects $30,000 and above, Vendors shall provide proposing pricing for appropriate items specified on ATTACHMENT A: BID WORKSHEET.
Any changes to prices will be used for future bids and will not be retroactive for projects which already have signed Notices to Proceed.
4.4 CHANGE ORDER
The State may at any time, as the need arises, order changes within the Scope of Work without invalidating the contract. If such changes increase or decrease the amount due under the contract, or in the time required for performance of the work, an equitable adjustment shall be authorized by Change Order.
At any point during the construction or design process, if the Scope of Work changes, a Change Order shall be submitted, and pricing shall be negotiated with the State prior to proceeding. These Change Orders will have to be approved by NCEM and/or by the Authority Having Jurisdiction. Vendors shall provide NCEM with documentation of these required changes with submitted Change Order.
4.5 WORK ORDER TERM
Each Work Order shall have an initial term of 12 months after Notice to Proceed for elevation projects.
At the end of the Work Order’s current term, the State shall have the option, in its sole discretion, to extend the Work Order on the same terms and conditions.
4.6 HUB PARTICIPATION
Pursuant to North Carolina General Statute G.S. 143-48, it is State policy to encourage and promote the use of small, minority, physically handicapped, and women contractors in purchasing Goods and Services. As such, this RFP will serve to identify those Vendors that are minority owned or have a strategic plan to support the State’s Historically Underutilized Business program by meeting or exceeding the goal of 10% utilization of diverse firms as 1st or 2nd tier subcontractors. Vendor shall complete ATTACHMENT C: SUNCONTRACTOR FORM to identify subcontractors that are HUB certified.
4.7 WITHDRAWAL
NCEM makes no guarantee of volume of work under any contract. Homeowner(s) may elect to withdraw from the program at any time up until the start of construction. All parties (Homeowner, Subrecipient, Vendor and State) shall be notified within 7 days of the signed withdrawal letter. At time of withdrawal, the Vendor shall submit a final invoice for all tasks completed during the pre-elevation work phase identified in the Attachment A supplement bid property worksheet. The final invoice shall also contain evidence that the itemized work being claimed has been completed. Only the itemized cost identified in the Attachment A supplement Bid Property worksheet shall be paid for work completed prior to withdrawal of the property. Once the final invoice for a withdrawn property has been processed, no additional invoices may be submitted in association with the property unless approved by NCEM in writing.
4.8 LIQUIDATED DAMAGES
The date of beginning and the time for completion of the work within the Project Time Frame are essential conditions of the contract and the work embraced shall be commenced on the date specified in the Notice to Proceed. In addition to the Project Time Frame, other mandatory progress time frames are contained within this solicitation. The Vendor will proceed with work at such a rate of progress to ensure full completion within established time frames. The time frames for completion of work and progress will reviewed and confirmed by the State and the Vendor, in writing, at the time of the pre-construction conference. It is expressly understood and agreed, by and between the Vendor and the State, that the contracted time for the completion of the work described herein is a reasonable time, taking into consideration the average climatic and economic conditions and other factors prevailing in the locality of the work.
The Vendor also understands that if circumstances beyond his/her control cause a delay in the Vendor’s construction schedule, the Vendor may request an amendment to the agreed time frames for completion and progress of work. The time for completion of work may then be amended, in writing, by mutual assent of the Vendor and the State. Any delay in work caused by the Vendor’s
Ver: 11/2025 13 failure to submit deliverables for approval shall not be considered as adequate justification for an extension of the project performance schedule.
For each business day in excess of the above number of days, the sum of $250.00 per day shall be deducted from Vendor’s next draw request as liquidated damages reasonably estimated in advance to cover the losses incurred by NCEM by reason of failure of said Vendor to complete the work within the time frame specified, such time being in the essence of this Contract and a material consideration thereof.
The Vendor shall not be charged with liquidated damages or any excess cost when the delay in completion of work is due to the following and the Vendor has promptly given written notice of such delay to the State:
a) To any preference, priority or allocation order duly issued by the State in writing.
b) To unforeseeable causes beyond the control and without the fault or negligence of the Vendor, including by not restricted to, acts of God, or of the public enemy, acts of the State, acts of another Vendor in performance of a contract with the State, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and abnormal and unforeseeable weather; and
c) To any delays of subcontractors occasioned by any of the causes specified in paragraph (b) of this section.
4.9 VENDOR’S REPRESENTATION
a) Vendor warrants that qualified personnel shall provide all services that may be required under the Work Order in a professional manner. “Professional manner” means that the personnel performing the services shall possess the skill and competence consistent with at least the prevailing business standards in the industry. Vendor agrees that it shall not enter any agreement with a third party that may abridge any rights of the State under the Contract. Vendor shall serve as the Prime Contractor under the Work Order and shall be responsible for the performance and payment of all subcontractor(s) that may be approved by the State. Names of any third-party vendors or subcontractors of Vendor may appear for purposes of convenience in Work Order documents; and shall not limit Vendor’s obligations hereunder.

Unless otherwise expressly provided herein, Vendor will furnish all of its own necessary management, supervision, labor, facilities, furniture, computer and telecommunications equipment, software, supplies and materials necessary for the Vendor to provide and deliver the goods and services.
c) Vendor warrants that it has the financial capacity to perform and to continue performing its obligations under the contract; that Vendor has no constructive or actual knowledge of an actual or potential legal proceeding being brought against Vendor that could materially adversely affect performance of the Work Order; and that entering into the Work Order is not prohibited by any contract, or an order by any court of competent jurisdiction.
d) Compliance with the Copeland “Anti-Kickback” Act
i. VENDOR: Vendor shall comply with 18 U.S.C. § 840, 40 U.S.C. § 3145, and the requirements of 29 C.F.R. pt. 3 as may be applicable, which are incorporated by reference into this contract.
ii. SUBCONTRACTS: Vendor or subcontractor shall insert in any subcontracts the clause above and such other clauses as FEMA may by appropriate instructions require, and also a clause requiring the subcontractors to include these clauses in any lower tier subcontracts. 4.10 SECRETARY OF STATE REGISTRATION
Prior to entering into a contract with the State, the awarded Vendor(s) must complete registration with the NC Secretary of State.

5.0 SPECIFICATIONS AND SCOPE OF WORK
NCEM is seeking to procure the services of Prime Contractors (Vendors) to oversee several aspects of the implementation process for elevation projects. It is the responsibility of the selected Prime Contractor(s) to manage the overall construction before, during, and after elevating the structure, obtaining approved engineered designs, acquiring all necessary permits and inspections from local jurisdictions, and the completion of elevation certificates and certificates of occupancy. Upon completion, the site shall be returned to a state that meets and/or exceeds the pre-elevation condition as well as any modifications necessary to bring the site into compliance with local, State, and Federal requirements.
NCEM has prequalified Prime Contractors based on work/project capacity, construction experience, experience with lead, asbestos and environmental abatements, and such other considerations that may be identified in grant eligibility determinations and HMGP rules/standards and/or NCEM best practices and/or financial controls. NCEM shall award HMGP projects in a process that is in the best interest of the HMGP and/or specific areas or communities.
