About this file
This is a Change Order Notice issued by the Chief Procurement Office for General Services of the Illinois Toll Highway Authority (THA) for Amendment I-19-4475, I-57 Widening over CSX and B&O CT Railroad Bridges and I-57 Restriping project. The original construction contract was advertised on February 11, 2021, with bids received on March 23, 2021. The contract was awarded to Dunnet Bay Construction Co. on April 22, 2021, via Tollway Board Resolution 22229 in the amount of $20,793,926.70. The contract is currently set to expire on October 28, 2026. The change order requests a one-year amendment extension to accommodate contractor claim processing and potential resulting payments, with no additional funds required.
The project has experienced multiple delays throughout execution, including differing site conditions, utility delays, permit delays, right of way delays, coordination with an adjacent resurfacing construction contract, and an electrical maintenance transfer. The contractor has submitted a claim that is under review by the Construction Manager, Project Manager, Deputy Project Manager, and Claim Administrator. If the claim is found to have merit, an Authorization to Proceed (ATP), Change Order, and/or Extra Work Order will be processed, followed by payment through a pay estimate. The claim review and payment processing can require up to one year to complete. The contract is nearly closed out except for the pending claim, and the one-year amendment extension is necessary to allow sufficient time for full claim resolution and any associated payments.

| thedetails: This construction contract was advertised on 02/11/21, BidBuy# 21-557THA-ENGCO-B-20356. Bids were received on 03/23/21. The contract was awarded by the Tollway Board to Dunnet Bay Construction Co. on 04/22/21 via board resolution 22229 in the amount of $20,793,926.70. |
Once a claim is submitted, it is reviewed by the CM, PM, DPM, and the Claim Administrator. If the initial claim is rejected, the contractor may choose to appeal.
In the event of an appeal, a formal claim meeting will be held with the Tollway, and any resulting outcomes will need to be evaluated. Depending on the nature of the claim, this may involve multiple Tollway reviewers, and due to the complexity of certain claims, the review process can take a considerable amount of time.
If the claim, or any portion of the claim, is found to have merit, an ATP will need to be processed, followed by a Change Order and/or an Extra Work Order. Once those documents are approved, the work can be processed and submitted on a pay estimate for payment. Based on the typical timelines associated with these steps, up to one year may be required to fully process the claim and any resulting payment.
The contract is nearly closed out, with the exception of the claim noted above. Several delays occurred throughout the course of the project, including differing site conditions, utility delays, permit delays, right of way delays, coordination with an adjacent resurfacing construction contract, and an electrical maintenance transfer.
The contract is set to expire on 10/28/26. A one-year amendment is requested as the contractor will be submitting a claim, and if there is merit, payment may need to be processed through the contract. No additional funds are required.
