About this file
This Limited Source/Brand Name Justification document from the United States Department of Agriculture (USDA) details a procurement for 60 (20KG) bags of FNI 205 Yeast, a water-soluble yeast extract critical for the Sterile Insect Technique production of the Mexican fruit fly at the USDA Plant Protection and Quarantine facility in Edinburg, TX. The document justifies sole-source procurement from Lallemand Bio-Ingredients USA, LLC at $18.45/kg, with a total estimated first-year cost of $23,140 and a projected 5-year agreement value of $125,000.
Market research conducted by USDA found no alternative vendors with sufficient quantities of this specialized yeast extract, which is essential for supporting adult Mexican fruit fly development. The urgency stems from the critical nature of this ingredient in the fly rearing process, with potential work stoppages if the product is unavailable. The Facility Director determined that additional market research would cause substantial administrative costs without likely improving competition, thus recommending direct procurement from the incumbent vendor to ensure uninterrupted scientific operations.

United States Department of Agriculture Limited Source/Brand Name Justification
FAR 13.106-1(b)(1) – Simplified Acquisitions Control No. (if applicable) ______________________
1. Identification of the agency and the contracting activity.
1a. Requesting Activity Agency:
USDA/APHIS/PPQ
22675 N. Moorefield Rd.
Edinburg, TX 78541
1b. Contracting Activity:
USDA, APHIS-AAMD Contracting 250 Marquette Ave Suite 410 Minneapolis, MN 55401
2. Description of supply or service required to meet the agency’s needs.
The USDA Plant Protection and Quarantine facility in Edinburg, TX has a requirement for a delivery of 60 (20KG) bags of FNI 205 Yeast, a water-soluble yeast extract of the genus Saccharomyces cerevisae.
FNI 205 yeast is a type of brewers yeast that contains the essential microbial growth factors to help the development of the adult Mexican fruit fly, Anastrepha ludens. Primary Grown for accordance to the specifications on the Statement of work.
3. The rationale or circumstances for limiting competition.
Urgency Product is needed as soon as possible to continue with the Sterile Insect Technique production of the Mexican fruit fly, Anastrepha ludens. The FNI 205 Yeast is a crucial part of the Mexican fruit fly artificial diet of the adult fly. There is currently no alternative diet ingredient for this product and without it available, can cause a major work decrease in production and/or work stoppage due to low egg production, egg collection, and fly release.
The current pricing of the FNI205 Yeast is $18.45/kg with the vendor (Lallemand Bio-Ingredients USA, LLC). The Guatemala rearing facility with International Services currently holds a contract and have provided some supply support to the Edinburg, TX rearing facility.
4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
Market research was conducted to find an alternative vendor for FNI 205 yeast, or similar type of brewers yeast, but found no vendor with the needed amounts onhand. Minimal vendors online had small quantities available with a significant price increase per kilogram.
International Services Rearing facilities in Guatemala use the same product and have the same operational standards and have been supporting our supply need for FNI205 yeast during the approval procees in contracting.
Facility Director determined the additional administrative cost for further market research and time for solicitation procedures are not deemed warranted and would only cause substantial duplication of cost to the government that is not expected to be recovered through more competition, which would cause unacceptable delays in fulfilling the agency’s requirements.
5. Estimated price, including all options, if applicable.
FY25 - One delivery of 60 (20KG) bags (@ $18.45/KG) = $ 22,140.00 Estimated Delivery Cost $ 1,000.00 Total Dollar amount $ 23,140.00 for the FY25.
Delivery needed as soon as possible. Will need approximately 60-70 (20KG) bags delivered per FY for an approximate total of $24,000 per year, with potential for increase due to supply cost and shipping.
Estimation for a 5-year agreement $125,000.00

For acquisitions greater than the micro-purchase threshold but less than the Simplified Acquisition Threshold (SAT) the Contracting Officer may solicit from one source only if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, etc.). Contracting Officers must document the rationale for soliciting from a single source, including brand name in accordance with FAR 13.106- 1(b)(1)(i) and FAR 13.106-3(b)(3)(i).
Program personnel are advised to work with contracting personnel early on in order to promote and provide for full and open competition to the maximum extent practicable. In circumstances permitting other than full and open competition, program personnel shall provide necessary information to contracting personnel to support and document the circumstances limiting competition through the use of this form
Advance planning. Contracting without providing for full and open competition shall not be justified on the basis of (1) a lack of advance planning by the requiring activity or (2) concerns related to the amount of funds available to the agency or activity for the acquisition of supplies or services.
Brand Name. Items peculiar to one manufacturer can be a particular brand name, product, or feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer. Brand name specifications shall not be used unless the particular brand name, product or feature is essential to the Government’s requirements and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet the Agency’s needs.
Posting. When an acquisition contains brand name specifications, the Contracting Officer shall include the justification required by FAR 13.106-1(b) or 13.501 with the solicitation when synopsizing in the GPE (actions exceeding $25,000) or displaying in a public place (actions exceeding $15,000 but not expected to exceed $25,000), as required by FAR 5.102(1)(6).
