About this file
This document is a Justification and Approval (J&A) for a sole-source contract for Emergency Berthing Services issued by Naval Supply Systems Command, Fleet Logistics Center, Jacksonville (FLCJ). The contract will be awarded to Jacksonville Port Authority (JAXPORT) to provide emergency berthing for disabled U.S. Navy ships during tropical storms and hurricanes near Naval Station Mayport, FL. JAXPORT is the only facility within towing distance capable of accommodating Navy vessel length and depth requirements.
The contract is firm-fixed-price with a total estimated value of $375,000.00, consisting of a base period (FY26) and four one-year option periods from FY27-FY30, each valued at $75,000.00. The base period will be funded by FY26 Operation & Maintenance Navy funds. The sole-source justification is based on 10 U.S.C. 3204(a)(1), citing that only one responsible source is available to satisfy agency requirements. No competitive solicitation efforts were made due to JAXPORT being the única facility meeting the Navy's specific berthing needs.

ANNEX 1 – JUSTIFICATION AND APPROVAL
J&A No. 25-J032
(CLASS) JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Supply Systems Command, Fleet Logistics Center, Jacksonville (FLCJ), FL.
2. Description of the Action Being Approved.
This is a sole-source requirement for Emergency Berthing Services to be awarded to Jacksonville Port Authority (JAXPORT), 2831 Talleyrand Ave, Jacksonville, FL 32206.
3. Description of Supplies/Services.
This requirement is to provide emergency berthing for disabled U.S. Navy ships during destructive weather identified as tropical storms and hurricanes by the National Weather Service (NWS) and the National Oceanic and Atmospheric Administration (NOAA). Due to the potential impact of destructive weather, this is a necessary contingency plan to dock U.S. Navy ships disabled during scheduled maintenance availabilities at Naval Station (NS) Mayport, FL.
Due to limited facilities in the Mayport and Jacksonville, FL area, if a disabled Naval Vessel is caught in port at NS Mayport with a hurricane approaching, the only facility identified by the Navy as a safe mooring site is the JAXPORT Talleyrand Marine Terminal Wharf (TMT). The Contractor (JAXPORT) shall furnish the management, labor, and materials to provide emergency berthing/docking of a maximum of one Navy vessel for up to a total of 600 linear feet.
The contract will be Firm-Fixed-Price. The estimated dollar value for each period of performance and fiscal year (FY) is shown in the table below. The total estimated amount of the contract, one-year base plus four one-year options, is $375,000.00. FY26 Operation & Maintenance Navy funs (O&MN) in the amount of $75,000.00 will be provided to fund the Base Period.
PERIOD OF PERFORMANCE AMOUNT
Base Period (FY26) 01 Oct 2025 – 30 Sep 2026 $75,000.00 Option Period I (FY27) 01 Oct 2026 – 30 Sep 2027 $75,000.00 Option Period II (FY28) 01 Oct 2027 – 30 Sep 2028 $75,000.00 Option Period III (FY29) 01 Oct 2028 – 30 Sep 2029 $75,000.00 Option Period IV (FY30) 01 Oct 2029 – 30 Sep 2030 $75,000.00
TOTAL $375,000.00
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Approval is being sought for a sole source contract based on only one responsible source being available and no other supplies or services satisfying agency requirements. JAXPORT is the only company or facility within towing distance of NS Mayport, FL that can accommodate the length and depth requirement of Navy vessels.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
No efforts were made to solicit offers from other companies/facilities due to JAXPORT being the only company/facility within towing distance of NS Mayport, FL that can accommodate the length and depth requirement of Navy vessels.
The requirement will be synopsized and a notice of intent to sole source published. Market research in accordance with FAR Part 10 was still conducted to verify that only one responsible source was available.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVSUP Fleet Logistics Center Jacksonville has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP Fleet Logistics Center Jacksonville will assess whether competition for future requirements is feasible.
As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
