About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for electromagnetic interference (EMI) and windblast testing of Dräger AviAir devices. The Naval Medical Research Command (NMRC) intends to award a sole source contract to Dayton T. Brown, Inc. in Bohemia, NY for testing two Dräger AviAir devices and peripheral equipment. The testing will include initial device setup, radiated emissions and electrical field testing, four windblast tests at 450 and 600 Knots Equivalent Air Speed (KEAS) with high-speed camera monitoring, and a comprehensive test report. Dayton T. Brown was selected as the sole source based on market research showing they are the only Continental United States (CONUS) windblast facility capable of performing both EMI and windblast testing, with previous successful contracts for similar testing for the Navy and 711th Human Performance Wing. The contract will be a firm-fixed price for a 12-month period, with the government anticipating a discounted price from the contractor's commercial rate.

JUSTIFICATION AND APPROVAL

OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity.

This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.

2. Nature and/or description of the action.

3. Description of Supplies or Services.

The proposed action is for Electromagnetic Interference (EMI) and Windblast testing performed on the Dräger AviAir to determine survivability in extreme environments. The testing will consist of device set up, Radiated Emissions and Electrical Field testing, four windblast tests at varying Knots Equivalent Air Speed (KEAS) with camera monitoring for each device, and a test report for each of the two types of testing. This proposed source is Dayton T. Brown, 1195 Church Street, Bohemia, NY 11716.

NAMRU-Dayton requests (two) Dräger AviAir devices and peripheral equipment be sent to Dayton T. Brown (DTB) for EMI testing to assess the efficacy of the devices during EMI. The DTB test facility must provide the following capabilities:

1. Initial device and testing environment setup

2. RE 102, radiated emissions in an electric field

3. RS 103, radiated susceptibility in an electric field

4. Testing report of findings

4. Identification of the statutory exceptions permitting other than full and open competition.

The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C.

2304(c)(1), Only one responsible source, 10 U.S.C. 2304(c)(3), Industrial mobilization; engineering, developmental, or research capability; or expert services, and FAR 13.106-1(b)(1) <$150K

Additionally, we are requesting (two) Dräger AviAir devices and peripheral equipment be sent to DTB for Windblast testing to assess the efficacy of the device in a simulated flight ejection environment. The DTB test facility must provide the following capabilities:

1. Initial device and testing environment setup

2. Two Windblast shots at 450 KEAS

3. Two Windblast shots at 600 KEAS

4. High speed video cameras usage

5. Testing report of findings

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market research was performed, the results of which are in paragraph 8. This requirement will be posted to the government point of entry in accordance with FAR 5.202.

7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.

9. Other facts supporting the use of other than full and open competition.

Previous contracts from NAMRU-D and 711th Human Performance Wing have been awarded to Dayton T. Brown for EMI and Windblast testing with the same test parameters according to MIL- STD-461G and MIL-STD-810H (N3239824P0603, $46,700). Contracting for 711th HPW was completed in 2022 and awarded to DTB through CREDA agreement No. 00-127-HE-01, totaling $44,650. The contract was awarded due to the ability to perform both types of testing in a single facility.

The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from Dayton T. Brown’s commercial price list and will be determined fair and reasonable.

DTB is one of the largest and most versatile independent testing laboratories in the nation. As a proven leader in Environmental testing, DTB offers customized solutions. DTB's enhanced Windblast Facility simulates uniform airstream velocities consistent with velocities experienced in actual ejections from aircraft up to 700 KEAS. DTB is the only CONUS windblast facility capable of meeting this air blast profile. The facilities and services are in alignment with AS9100D requirements to include:

comprehensive test reporting, product development support, product conformance inspection, and product improvement. DTB designs, develops, and implements specialized test equipment for customers in government, military, and commercial markets. DTB is also a proven leader in EMI testing. DTB verifies the ability of equipment to withstand EMI by bombarding it with electromagnetic energy.

Market research was conduced in June 2023 and again in February 2025 time frame. This research consisted of previous procurements of these types of testing and a market survey through search engines of open market contractors and government contractors. Search engines utilized include Google, USA Spending, and GSA Advantage using the following search words: windblast, electromagnetic interference, EMI, pilot ejection. Search results showed that Dayton T. Brown was the only windblast testing facility that was also able to perform EMI testing. Other companies with wind based testing only perform wind tunnel testing for the purpose of testing vehicles and aerospace parts, and not Windblast or EMI. The 711th Human Performance Wing was also contacted based on their previous correspondence and contract with DTB. Dayton T. Brown is the only source that can meet the Government’s requirements.

10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.

To date, no other sources have written to express an interest.

11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

For the reasons set forth in Paragraph 5, (contracting activity) has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, (NMRC) will assess whether competition for future requirements are feasible.

12. Point of Contact:

The point of contact at the Naval Medical Research Command, Silver Spring, MD, regarding the contents of the sole source justification are the Contracting Officers in the Material Management Department (MMD) and can be reached by emailing usn.detrick.nmrc.mbx.mmd-contracts@health.mil.
