About this file
This is a Justification for an Exception to Fair Opportunity document for a federal contract to procure audiovisual equipment for the U.S. Fleet Forces Command. The procurement, valued under the simplified acquisition threshold, will be conducted through NASA's Solutions for Enterprise-Wide Procurement (SEWP) multiple-award Government-Wide Acquisition Contract (GWAC).
The equipment list includes specific branded items from manufacturers like Christie Digital, Cisco, Crestron, Extron, Legrand, Shure, and others, totaling over 40 different products such as displays, video conferencing equipment, microphones, matrix switchers, cables, and rack mounting components. The justification emphasizes the need to maintain system compatibility and avoid disrupting existing network infrastructure, with the contracting office determining these specific manufacturers are the only ones meeting the government's minimum requirements. The procurement supports an audiovisual upgrade for the U.S. Fleet Forces Command's life cycle management plan, with the contract to be awarded to authorized resellers of the specified manufacturers.

4. Identification of the justification rationale.
The statutory authority that permits not providing each awardee a fair opportunity to be considered for each order exceeding the MPT issued under a multiple award contract is 10 U.S.C. 3406(c)(5), as implemented by FAR 16.505(b)(2)(i). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding the MPT, but not exceeding the simplified acquisition threshold, is: This is a justification for the use of items particular to one manufacturer, under the authority of 10 U.S.C. 3406(c)(5), as implemented by FAR 16.505(a)).
The required supplies allows for the audiovisual spaces to function as designed. These specific items of equipment, cables, and hardware have previously been tested and confirmed to function with new and existing equipment in all USFFC audiovisual environments.
Supporting this equipment will prevent additional unnecessary costs by requiring the purchase of additional items to avoid incompatibility issues.
5. Specific characteristics of the supplies or services support an exception to the fair opportunity process (i.e., unique features, function of the item, etc.). Describe in detail why only this/these supplies/services and/or awardee(s) can furnish the requirements to the exclusion of other supplies/services and/or awardees.
The USFFC Enterprise Networks employs a three (3) layer, industry standard configuration method utilizing Cisco network switches and routers, Crestron Electronics programmer, and Extron audio. The USFFC networks are managed using the industry standard Cisco proprietary network management software. The software provides detailed management services and data that are compatible solely with Cisco network equipment. If a vendor other than Cisco Systems or a Cisco Systems authorized reseller provides replacement codec, USFFC would be required to engage in other brand proprietary software and licenses that would generate high-cost volumes. It would be in the best interest of the Government to avoid additional costs by maintaining the current proprietary software and licenses associated specifically for Cisco codec endpoints. This will enable the command to leverage available resources and continue to utilize Cisco equipment. Cisco equipment has proven to be effective and compatible with Crestron Electronics programmer, and Extron audio and USFFC mission objectives. Certified Crestron Electronics programmer are utilized to control and design all audio-visual suites within the USFFC command. If a vendor other than Crestron Electronics or a Crestron Electronics authorized reseller provides replacement, equipment it would void our warranty that is currently in place. Causing unduly amounts of fiduciary stress upon the command and an additional loss due to warranty voids.
Equipment in the audio-visual suites currently utilize Extron audio-visual matrix switchers and HDMI cables, Christie Digital displays, Shure microphones, Crestron, Audio Technica microphones, , Legrand display mounts and equipment racks, Vaddio camera wall mounts, and Biamp digital signal processors to enable the command to leverage available resources. Extron Electronics, Christie Digital displays, Shure, Crestron, Audio Technica, Legrand, Vaddio, and Biamp match the government issued source specifications already in place. These brand names listed above comprise our network system. Any deviation from the aforementioned brand names will cause disturbance in USFFC system and will hinder the impact their mission. An award of any other brand names would cause a substantial duplication of cost and unacceptable performance of the USFFC networks.
6. Market Research. Provide a description of the market research conducted among awardees and the results thereof OR a statement of the reason market research was not conducted.
The requiring activity, through their in-depth knowledge of the market, has determined that the only items that meet the Governments minimum requirement are manufactured by and proprietary to the previously identified manufacturers. The contracting offices market research resulted in the conclusion that the only items that meet the Governments minimum requirement are the items previously identified.
The requiring activity and contracting office analyzed various strategic sourcing vehicles and the multiple contract holders for each to determine if any would be appropriate for the proposed acquisition. After a thorough evaluation, it was determined As part of their market research, the contracting office determined that there are multiple authorized resellers associated with each of the four (4) Groups (A, B, C, and D) of the NASA SEWP GWAC.
However, based on the current market research, the contracting office was able to identify at least two (2) small
