52.212-2 Evaluation-Commercial Products and Commercial Services. (Nov 2021)
Evaluation-Commercial Products and Commercial Services (Nov 2021)
1. The Government will award to the offeror, who has the lowest priced, technically acceptable proposal unless the Contracting Officer or Ordering Officer is aware of past performance information related to the lowest priced proposal offeror, which indicates that the proposal may not represent the best value to the Government. In that case, the Government reserves the right to consider the past performance of other offerors with technically acceptable proposals, and conduct a price, past performance tradeoff analysis, and award to an offeror that its proposal price is higher than the lowest priced proposal.
A technically acceptable proposal is one that provides pricing on every item specified in the solicitation and meets all requirements. If not priced accordingly, the Contracting Officer or Ordering Officer may find a proposal unacceptable. If so, the Contracting Officer or Ordering Officer will not consider proposals rated technically unacceptable further for award.
If further past performance evaluation is necessary, the Contracting Officer or Ordering Officer will evaluate past performance first for relevancy and then determine a past performance confidence rating as follows:
Relevancy;
Very Relevant: Present/past performance effort involved essentially the same magnitude of effort and complexities this proposal requires.
Relevant: Present/past performance effort involved much of the magnitude of effort and complexities this proposal requires.
Somewhat Relevant: Present/past performance contractual effort involved some of the magnitude of effort and complexities than this proposal requires.
Not Relevant: Present/past performance effort did not involve any of the magnitude of effort and complexities this proposal requires.
Confidence Rating;
Substantial Confidence: Based on the offeror's recent/relevant performance record, the Government has a high expectation that the offeror willsuccessfully perform the required effort.

Price:
The Contracting Officer will make a fair and reasonable determination in accordance with FAR (S) 15.404-1(b). The total evaluated price is the grand total resulting from the sum of the total price for each visit.
If it is in the Government's best interest, the Contracting Officer or Ordering Officer may split the award between multiple offerors from the proposals received.
If the Contracting/Ordering officer determines that the lack of balanced pricing poses an unacceptable risk to the Government, the Contracting /Ordering Officer may reject an offeror's proposal. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly over or understated.
