OEM DELL ECM UNITY SERVER SUPPORT
1. NOTICE TO ALL OFFERORS: The Government anticipates awarding a firm, fixed price contract in accordance with in FAR Part 12 and 13 response to quotes/proposals received in response to this solicitation. A firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.
2. See block 8 on page 1 of the solicitation for the closing date and time.
3. The deadline for submission of questions regarding the solicitation's terms, conditions, and/or specifications is prior to the solicitation's 2 days closing date. Submit via email, to the Contracting Official prior to solicitation closing date: 4 days

4. In accordance with FAR 13.106, the Government will select the most advantageous offer based on the following evaluation factors: technical including delivery date, price, and past performance in no order of relative importance.
5. All quoters MUST note all exceptions from the solicitation's terms, conditions, specifications, and/or the statement of work / EXCEPTIONS:
performance work statement, if any. It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation.
6. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the quoter whose quote is considered in the best interest of the government, price and other factors considered. Therefore, quoters who quote less than the entire effort specified herein may be determined to be unacceptable.
7. This acquisition will be solicited on a BRAND NAME basis with Original Equipment Manufacturer (OEM) BRAND NAME STATEMENT:
per FAR 11. Interested AUTHORIZED DISTRIBUTORS may identify their interest DELL or AUTHORIZED DISTRIBUTORS/PARTNERS and capability to respond to the requirement or submit proposals prior to offer due date. AUTHORIZED DISTRIBUTOR/PARTNER letter or documentation from the OEM is required to be submitted with quotes.

Information for Contractor Employees Seeking to Enter Japan
1. The following is provided for the information of contractors to the U.S. Navy whose employees need to enter Japan to perform contract requirements. The information is current as of February 2023. While the information is believed to be accurate, policies and procedures are continuing to change on a regular basis.

3. All contractor personnel arriving in Japan should utilize the process outlined in the USFJ Instruction to ensure they are recognized as members of the civilian component under Article 1.b. of the SOFA. The process requires that a contractor contact the contracting officer for the contract on which its employee will perform in Japan prior to the employee traveling to Japan. Contact is made through the Synchronized Pre-deployment and Operational Tracker (SPOT) system. The contractor will provide information to the contracting officer about the traveling employee. Following review, the contracting officer will issue the contractor a Letter of Authorization (LOA). The incoming contractor employee will hand carry a copy of the LOA and show it to the Japanese immigration authority at the port of entry as evidence of SOFA status. Contractors who do not have current access to SPOT should contact their contracting officer for information about accessing SPOT.
4. This memo is intended to provide current information for contractors whose employees need to enter Japan to perform contract requirements.
Nothing in the memo should be understood to change the terms or conditions of an existing contract. Any such changes must be made by an authorized contracting officer per 52.212-4.

NOTES:
1. These documents must be sent through DOD SAFE or ENCRYPTED email (due to PII) 14 days prior to scheduled visit.
2. Contractors will not enter Japan without a SPOT LOA, which shall present copy of SPOT LOA to the Japanese immigration official upon entry into Japan and keep a copy of the LOA in their possession while present in Japan. A copy does not need to be kept on the employee's person but should be in the employee's possession so they may produce the copy within a reasonable time as required for administrative processing and renewal purposes as per USFJINST 64-100.

STATEMENT OF WORK (SOW)
DELL EMC Unity Server Support Services Locations: Yokosuka, Japan and Sasebo, Japan
1. Scope of Work
The Contractor shall provide comprehensive hardware and software maintenance, technical support, and onsite repair services for two (2) Dell EMC Unity servers identified by Asset Tags and located at U.S. Government facilities in .4PMPJM3 4P1RJM3 Yokosuka, Japan and Sasebo, Japan
Support services shall ensure continuous operational availability, rapid fault resolution, and authorized component retention in accordance with the requirements outlined in this Statement of Work.
All services shall be provided under a pricing arrangement.Firm-Fixed-Price (FFP)
2. Covered Equipment

Diagnosis, troubleshooting, and replacement of defective hardware components.
Labor, parts, and logistics included.
3.2 Technical Support and Assistance
ProSupport 4-Hour 7x24 Technical Support and Assistance (SKU 887-1599) Access to certified technical support engineers.
Remote troubleshooting, diagnostics, and escalation management.
Coordination of onsite dispatch when required.
3.3 Software Support Maintenance
ProSupport Software Support Maintenance (SKU 826-9764) Software updates, patches, and maintenance support for supported Dell EMC Unity software.
Troubleshooting and remediation of software-related issues.
3.4 Component Retention Services
Keep Your Component for Enterprise (SKU 846-6488) Government retains failed components in accordance with data security and disposal policies.
Keep Your Hard Drive for Enterprise SSD Medium Capacity Add-On (SKU 870-8326) Government retains replaced SSD components.

Services shall be performed at U.S. Government facilities located in:

Remote technical support may be provided as necessary.
7. Security and Access Requirements
Contractor personnel shall comply with all base access, security, and escort requirements.
All retained components shall remain Government property in accordance with data protection policies.
8. Deliverables
Access to technical support services.
Onsite repair services when required.
Replacement parts and logistics.
Incident tracking and service documentation upon request.
No recurring deliverables are required beyond service performance.
9. Government Responsibilities
The Government shall:
Provide access to facilities and equipment.
Designate points of contact for service requests.
Ensure compliance with base access procedures.
10. Pricing
This contract is a arrangement. The price includes all labor, parts, travel, shipping, tools, and incidental costs necessary to Firm-Fixed-Price (FFP) perform the services described herein.

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)
(a) As used in this clause- Definitions.
"Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization.
"Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
"Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system.
"Payment request" and "receiving report" are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as Electronic invoicing.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

"Automatic identification device" means a device, such as a reader or interrogator, used to retrieve data encoded on machine-readable media.
