About this file
This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more. The certification pertains to the Deerfield Island ADA Dock project, which involves the installation of an aluminum floating dock and gangway, concrete piling, concrete abutment, fire line with hose cabinet, and miscellaneous appurtenant items at 1720 Deerfield Island Park in Deerfield Beach, Florida. The floating dock will be supplied and delivered by the Parks and Recreation Division, while the contractor is responsible for supplying, installing, and constructing all other project components. Vendors must submit their solicitation responses electronically through BPRO by the specified closing date and time and must return the completed certification form with their submittal or within three business days of the County's request.
Section 26-125(d) of the Broward County Code of Ordinances mandates that vendors certify implementation of policies, practices, and procedures that preclude inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the position. This requirement applies only to positions located within the United States that will foreseeably perform work under the contract. Vendors may claim exemption if applicable federal, state, or local law requires criminal history background checks at a different time or manner, or if the vendor is a governmental agency. Failure to comply with these requirements constitutes a material breach of the contract, and non-compliance may result in contract termination, debarment, or suspension proceedings consistent with Broward County Administrative Code procedures.
