About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition under 10 U.S.C. 3204(a)(2), Unusual and Compelling Urgency. The J&A seeks approval to increase the maximum Not-To-Exceed (NTE) capacity of an Indefinite-Delivery Indefinite-Quantity (IDIQ) Contract N40084-20-D-0411 CLIN 0005 by $719,537.43 to support urgent requirements for Base Support Vehicles and Equipment (BSVE) in Yokosuka, Japan. The IDIQ contract provides delivery, rental, and operator services for BSVE. The additional capacity is needed to award task orders for projects, including supporting the return of ships such as the USS George Washington to the U.S. Commander Fleet Activities Yokosuka. Due to the urgent nature of the requirements, the government does not have sufficient time to conduct a full and open competition for these services before 1 November 2024. The current contractor, Rental Plus Co., LTD, is the only vendor capable of providing the required services within the necessary timeframe. Prices were determined fair and reasonable at the time of the original IDIQ contract award.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(2), Unusual and compelling urgency
5. Rational Justifying Use of Cited Statutory Authority.
This contract was awarded on the basis of full and open competition to RENTAL PLUS CO., LTD on June 2, 2020, for one (1) 12-month base period and four (4) 12-month option periods.
On 17 October, 2024, NAVFAC FE CFAY received an unplanned, last minute task order request for BSVE from the Ship Repair Facility – Japan Region Center (SRF-JRMC) to support CNV-73 George Washington (GW) and other ships port call operations starting 1 November 2024 (Total value requested detailed in section 3). Unusual and compelling nature of the requirements preclude full and open competition. Delay in servicing the CNV-73 and other ships would harm mission readiness and could result in serious injury to the Government’s ability to respond to incidents in the area of operation in a timely fashion.
The remaining capacity for N40084-20-D-0411 IDIQ is $39,949.96 and is insufficient to meet the urgent requirements of PRY33’s requirements to support various ships returning to CFAY, Japan. Orders off the current contract are needed by 1 November 2024. Only the current
Ryouhei.Shindo.JA Rectangle contractor, Rental Plus Co, LTD, is mobilized to provide the services required and will be able to deliver the required to support the ships returning to port within the required time.
If additional capacity is not granted the FEAD would not be able to provide support for requiring commands and ships, i.e. CVN-73 GW, SRF-JRMC, which would cause significant delays to servicing ships scheduled to return to CFAY in early November. Additional contingency is required in the event that other emergent requirements are submitted prior to the follow-on contract award.
A solicitation re-competing the requirement by full and open competition has already been issued; however, the effort will not be awarded in time to meet the timeframe of the requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
This Justification is using the authority provided in 10 U.S.C. 3204(a)(2) and delay of order awards would result in serious injury, financial or other, to the government. The contracting officer has determined that full and open competition will not allow for execution of contract actions in the required time frame.
NAVFAC FE FEAD Yokosuka has issued a solicited to renew the subject contract; however, it is currently undergoing evaluation and award will not be made in order to meet the requirements need by date. Due to the urgency of the requirement, the Government does not have sufficient time to develop and upload a sources sought notice in sam.gov to seek potential offerors that are capable of providing service the above service and executing a contract before substantial harm will be done.
In accordance with FAR 6.305(b), this justification will be posted within 30 days after contract award.
7. Determination of Fair and Reasonable Cost.
Prices were determined fair and reasonable at the time of the basic contract award and pre-priced ELINS will be used.
8. Actions to Remove Barriers to Future Competition.
NAVFAC FE FEAD Far East has issued solicitation N40084-24-R-0411 which allows for full and open competition to and competition to the maximum extent practicable.
