Please note: The Statement of Qualifications and Management Plan points from the Stage I: Request for Proposals score sheet do not carry over to the Stage II: Invitation to Interview score sheet. DFCM VBS Construction Stage II with Bonds: Invitation to Interview, 5.15.2026 8

Before submitting a cost proposal, the Contractor shall carefully examine the solicitation; shall visit the site of the Work; shall fully inform themselves as to all existing conditions and limitations; and shall include in their proposal the cost of all items required by the solicitation. If the Contractor observes that portions of the Contract Documents are at variance with applicable laws, building codes, rules, regulations or contain obvious erroneous or uncoordinated information, the Contractor shall promptly notify the DFCM Project Manager, and the necessary changes shall be accomplished by addendum.

By submitting a cost proposal or bid, in any format, the Contractor / Bidder / Vendor certifies that: 1) no product to be supplied by the Contractor / Bidder / Vendor in connection with this Solicitation is a “forced labor product” as that term is defined in Utah Code 63G-6a-121; and 2) to the extent, if any, that this solicitation involves technology, or technology services, networks or systems, the Contractor / Bidder / Vendor is not a “restricted foreign entity” as that term is defined in Utah Code 63G-6a-121.

- Construction Project Time: All plans, schedules, and the cost proposal are required to reflect the construction project time. Non-compliance with the construction project schedule will not result in automatic disqualification but will be evaluated by the Selection Committee in determining the final selection. Of particular interest and concern are the management team and the ability of the prime contractors to deliver the project within the construction time.

- Compliance with the Construction Budget: DFCM expects to receive cost proposals that are within the stated construction budget. While all Contractors are generally encouraged to submit value engineering proposals as appropriate, those who are not able to submit a cost proposal within the budget are particularly requested to submit value engineering proposals containing sufficient information for the evaluator to understand what is being offered to bring the cost within the budget. Contractors may, however, submit cost proposals that exceed the budget, but they will be addressed in the manner explained below.

DFCM will identify those Contractors whose cost proposals, less any potentially accepted value engineering, are within the stated budget. If no cost proposals are within the stated budget, DFCM will determine which of the following actions to take:

1) DFCM may increase the stated budget and proceed with the selection process with only those Contractors whose cost proposals, less any potentially accepted value engineering proposals, are within the revised budget.

2) DFCM may modify the project scope or requirements. This will be provided in an addendum which will also set a new deadline for Contractors to submit revised cost and value engineering proposals. Only Contractors who had previously submitted a cost proposal compliant with the RFP will be considered.

3) DFCM may reject all proposals and cancel the solicitation.

Cost proposals will be kept confidential and will not be disclosed to the Selection Committee until after the interviews and preliminary deliberations are completed. No information regarding Contractor’s cost and value engineering proposals will be disclosed to competing contractors prior to the completion of the selection process.

- Value Engineering Proposals: Value engineering proposals must be submitted to through the U3P website no later than the time and date specified on the Solicitation Schedule. Value engineering proposals may include modification of the original cost proposal including, but not limited to, a simple reduction in price. The value engineering proposals may be evaluated by the Selection Committee and the project A/E to determine what is potentially acceptable and who will consider those which are reasonable and desirable in the evaluation of the cost criterion. Value engineering proposals shall contain sufficient information for the Selection Committee to understand what is being proposed, the areas that will be affected, and any other impacts that acceptance of said value engineering proposals will affect. Value engineering proposals shall be inclusive of all the costs or credits of said proposal.

The Selection Committee and the DFCM Director reserve the right to reject any value engineering proposal that is not desirable for the project. DFCM reserves the right to use any value engineering information proposed by any Contractor for the project and use the concepts for the benefit of the project.

DFCM VBS Construction Stage II with Bonds: Invitation to Interview, 5.15.2026 9

Additional Requirements The following items are not part of the scoring criteria but are requirements that may disqualify the Contractor from the selection process if not submitted.

E. Bid Bonds A bid bond properly signed by the Contractor and a qualified surety and submitted on the AIA Document A310 – 2010 Bid Bond form, or equivalent, in the amount of 5% of the cost proposal shall accompany the bid submitted within U3P. If the bid bond is not provided with the cost proposal, the bid is nonresponsive, and the Contractor may be disqualified from the selection process.

The bid bond must be submitted on the AIA document A310 – 2010 Bid Bond form, or equivalent, to be accepted unless only one bid is received by DFCM, or the failure to comply with the bid bond requirements is determined by the Director of DFCM to be immaterial based on the following:

1) the bid bond is submitted on a form other than the AIA Document A310 – 2010 Bid Bond form, or equivalent, and the bid bond meets all other requirements including being issued by a surety firm authorized to do business in the State of Utah and be listed in the U.S. Department of the Treasury Circular 570, Companies Holding Certificates of Authority as Acceptable Securities on Federal Bonds and as Acceptable Reinsuring Companies for an amount not less than the amount of the bond to be issued. A co-surety may be utilized to satisfy this requirement; and

2) the Contractor provides a bid bond properly signed by a qualified surety and on the AIA Document A310

– 2010 Bid Bond form, or equivalent, by the close of business of the next business day after DFCM notifies the Contractor of the defective bid bond.

DFCM VBS Construction Stage II with Bonds: Invitation to Interview, 5.15.2026 10

Proposal Documents The Stage II proposal documents consist of the Cost Proposal, bid bond, and Value Engineering proposal. These documents must be submitted to DFCM via U3P no later than the date and time specified in the Solicitation Schedule. Late cost proposals will not be accepted.
