About this file

This is a Justification for Other Than Full and Open Competition for a succeeding lease filed by the U.S. General Services Administration, GSA Region 7 Leasing Division.

The General Services Administration seeks to negotiate a succeeding lease with the incumbent lessor at Ice Building - Rio Rico, located at 41 Paseo De Yucatán, Rio Rico, AZ 85648-2806, for Immigration & Customs Enforcement (ICE). The requirement is for 23,393 ABOA/24,152 rentable square feet (RSF) of warehouse and office space, commencing June 23, 2026, following the expiration of the current lease on June 22, 2026. The delineated area is limited to Rio Rico, AZ city limits. The justification invokes 41 U.S.C. 3304(a)(1) and GSAR 570.402, citing that only one responsible source can satisfy agency requirements and that award to any other offeror would result in substantial duplication of costs to the Government that cannot be recovered through competition. GSA conducted market research using CoStar and LoopNet databases and outreach to local brokers, posting a presolicitation notice on SAM.gov from February 18, 2025 to March 15, 2025. Only the incumbent lessor (41 Paseo De Yucatan) submitted an expression of interest. The GSA Lease Contracting Officer determined that no potentially acceptable alternative locations were identified. Recent market surveys in Rio Rico and Nogales, Arizona confirmed that the proposed rental rate is within current market range and fair and reasonable. The justification notes that all facility improvements would require replication if ICE relocated, and the incumbent's past performance documentation and Lease Administration Management reports were reviewed and deemed satisfactory.

ACQUISITION.

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, GSA will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s tenant improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo a competitive action.

Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.
