SECTION C – CONTRACT CLAUSES
C.7 VAAR 852.219-78 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING—CERTIFICATE OF COMPLIANCE FOR SUPPLIES AND PRODUCTS (SEP 2021) (DEVIATION)
(a) Pursuant to 38 U.S.C. 8127(k)(2), the offeror certifies that—
(1) If awarded a contract (see F(a)FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows: [Offeror check the appropriate box]
(i) [ ] In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), it will not pay more than 50% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219-10 or VOSBs as set forth in 852.219-11. Any work that a similarly situated VIP-listed subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(ii) [ ] In the case of a contract for supplies from a nonmanufacturer, it will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) is granted. The offeror understands that, as provided in 13 CFR 121.406(b)(7), such a waiver has no effect on requirements external to the Small Business Act, such as the Buy American Act or the Trade Agreements Act.
(2) Manufacturer or nonmanufacturer representation and certification. [Offeror fill-in—check each applicable box below. The offeror must select the applicable provision below, identifying itself as either a manufacturer or nonmanufacturer]:
(i) [ ] Manufacturer or producer. The offeror certifies that it is the manufacturer or producer of the end item being procured, and the end item is manufactured or produced in the United States, in accordance with paragraph (a)(1)(i).
(ii) [ ] Nonmanufacturer. The offeror certifies that it qualifies as a nonmanufacturer in accordance with the requirements of 13 CFR 121.406(b) and paragraph (a)(1)(ii). The offeror further certifies it meets each element below as required to qualify as a nonmanufacturer. [Offeror fill-in—check each box below.] [ ] The offeror certifies that it does not exceed 500 employees (or 150 employees for the Information Technology Value Added Reseller exception to NAICS code 541519, which is found at 13 CFR 121.201, footnote 18).
[ ] The offeror certifies that it is primarily engaged in the retail or wholesale trade and normally sells the type of item being supplied.
[ ] The offeror certifies that it will take ownership or possession of the item(s) with its personnel, equipment, or facilities in a manner consistent with industry practice.
(iii) [ ] The offeror certifies that it will supply the end item of a small business manufacturer, processor, or producer made in the United States, unless a waiver as provided in 13 CFR 121.406(b)(5) has been issued by SBA. [Contracting Officer fill-in or removal (see 13 CFR 121.1205). This requirement must be included for a single end item. However, if SBA has issued an applicable waiver of the nonmanufacturer rule for the end item, this requirement must be removed in the final solicitation or contract.] or [Contracting Officer tailor clause to remove one or other block under subparagraph (iii).] [ ] If this is a multiple item acquisition, the offeror certifies that at least 50% of the estimated contract value is composed of items that are manufactured by small business concerns. [Contracting Officer fill-in or removal. See 13 CFR 121.406(d) for multiple end items. If SBA has issued an applicable nonmanufacturer rule waiver, this requirement must be removed in the final solicitation or contract.]
(3) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.
(4) If VA determines that an SDVOSB/VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:
(i) Referral to the VA Suspension and Debarment Committee;
(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and
(iii) Prosecution for violating section 1001 of title 18.
(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract or to determine whether the offeror qualifies as a manufacturer or nonmanufacturer in compliance with the limitations on subcontracting requirement. Contracting Officer may, at their discretion, require the Contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the Contracting Officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.
(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed, and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.
Certification:
I hereby certify that if awarded the contract, [insert name of offeror] qualifies as a manufacturer or nonmanufacturer as stated herein and that if awarded the contract, [insert name of offeror] will comply with the limitations on subcontracting requirement specified in the resultant contract, unless a waiver as described in 13 CFR 121.406(b)(5) is granted. I further certify that I am authorized to execute this certification on behalf of [insert name of offeror].

SECTION E – SOLICITATION PROVISIONS E.1 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES These instructions prescribe the format of quotes and the development and presentation of the quote. Quoters shall carefully review this section prior to commencing quote preparation and take the necessary measures to ensure that the information submitted is factual, accurate, and complete. In order for a quote to be considered, quoters must strictly comply with all instructions outlined in this RFQ. Failure to furnish quotes that comply with the instructions, at the predetermined due date for submission, may result in elimination from consideration for award. Furthermore, all RFQ amendments (if any) must be acknowledged.
SUBMISSION INSTRUCTIONS
Instructions for Quote Submission
1) Quotes will be accepted in PDF form via e-mail to Linda D. Shirley-Diaz at Linda.Shirleydiaz@va.gov and a scanned (pdf) copy of the signed SF-1449. Electronic quotes shall consist of two volumes (Technical and Price). Please note that faxed quotes are not acceptable and will be rejected. Please note, zip files and folders are rejected by VA NAC servers, and emails with large attachments may not be received. However, please note, they can be split into multiple emails, as long as they are appropriately labeled within the subject line (e.g., “Email 1 of 3 for Sioux Falls, SD Laundry Requirement”). VA suggests that quoters submit their quotes well before the deadline and confirm receipt of all attachments with the Contracting Officer listed on the SF-1449.
2) RFQ VOLUME CONTENTS
Volume I, Technical Quote Volume II, Price - The quote shall consist of a properly completed and signed RFQ document as specified in Block 28 of SF-1449. Total price offered must be included on the SF-1449. All price information shall be included in Volume II.
The quoter shall be held responsible for the validity of all information supplied in the quote, including information provided by potential subcontractors. Should subsequent investigation disclose that the fact and conditions were not as stated, the quote may be rejected and receive no further consideration.
The quoter shall confine submissions to essential matters and in sufficient detail in order to permit a complete and accurate evaluation of the quote. Any proprietary information shall be clearly marked.
3) QUOTE EVALUATION
| The Government will first conduct a review of the quotes to ensure that the offered equipment meets the minimum technical requirements as specified in the attached Technical Specifications. Only those quotes that meet the minimum technical requirements, according to the submission requirements, will be deemed to be technically acceptable and further evaluated against the factors listed below. |
| EVALUATION FACTORS |
The following factors will be included in the RFQ and will be used to evaluate quotes:
| 1. | Equipment Capabilities |
| 2. | Space Utilization |
| 3. | Past Performance |
| 4. | Price |
FACTOR 1 – EQUIPMENT CAPABILITY:
Quoters shall describe the offered equipment capabilities and/or features that meet/exceed the requirements of this RFQ. Quoters shall be specific in identifying the equipment’s specifications and/or features that exceed the requirements. Quoters shall provide product literature, equipment specification sheet, or other materials that document the equipment’s capabilities. Equipment capabilities must align with the requirements set forth within the Technical Specifications. Quoters must describe the capabilities of equipment offered as alternate/optional equipment items along with the required literature/brochures.
a) Descriptive literature means information (e.g., cuts, illustrations, drawings, and brochures) that is submitted as part of a technical quote. Descriptive literature is required to establish, for the purpose of evaluation, details of the product offered that are specified in the attached Technical Specifications (refer to section B.3), and pertain to significant elements such as design, materials, components, performance characteristics, and methods of manufacture, assembly, or operation.
For the purpose of determining technical acceptability, descriptive literature must be identified (Highlighted) to show the appropriate paragraph number of the purchase description item to which it applies, the specific model and type and all component items for functions offered and clearly show that the item(s) offered are in compliance with VA requirements as specified in the Technical Specifications.
b) Performance capabilities shall be listed for all offered equipment. Identify in the submitted technical data where these capabilities are described. The statement "COMPLIES" is not acceptable.
c) Production and Storage Calculations: Production and storage calculations of the laundry requirements and all data that substantiates the computations shall be submitted as a separate document. Sources and references for this submitted data are required.
FACTOR 2: SPACE UTILIZATION (LAYOUT):
Quoters shall submit space utilization information that fully includes all of the Government’s requirements, with details, that show satisfactory egress around all pieces of equipment. The minimum requirement around all non-moving pieces is a space allowance of 24 inches. Egress above 24 inches shall be detailed and will be considered more highly. The minimum requirement around all moving pieces is a space allowance of 36 inches. An equipment layout design must be presented, which demonstrate no disturbance of the current workflow. Space utilization shall demonstrate the installation of equipment in accepted layout design, presented in design submissions, allowing maximum use of new and existing equipment. Additionally, space utilization information must show that there are no bottlenecks with equipment offered that will affect overall production and space utilization. Units provide sufficient access for daily maintenance and cleanup with minimal adjustment of equipment or components. The footprint utilizes specified space to prevent additional construction, plumbing, electrical or other utility connection.
a) Textile Care Processing Equipment Layout Drawings (for information and evaluation): Submit descriptive literature, technical quotes, and five 1/4-inch scale drawings of the layout of the new textile care processing equipment offered. Drawings shall be self- explanatory showing:
i. Building column line identification, north arrow, arrow indicating soil in, and arrow indicating clean out.
ii. Overall layout dimensions in relationship to floor space requirements, plus monorail heights and sling bags.
iii. Include minimum clearance of thirty-six (36) inches between moving parts and fixed objects and twenty-four (24) inches between non-moving parts and fixed objects.
iv. Drawings shall have a legend listing all equipment proposed, including quantities, and identify locations of equipment.
v. Actual filled sling locations that comply with VA storage and sling requirements specified elsewhere in this document.
vi) Mathematical calculations, depicting volume requirements for all conveyors and all equipment offered, including a summation that depicts total system compliance.
vii) Drawings shall include adjacent equipment in laundry facility to show that equipment offered will fit into the exact location or space of current equipment with no relocating of existing equipment. The drawings shall show the egress to all pieces of equipment. Any changes necessary to complete installation due to incomplete or erroneous drawings and/or instructions furnished to the VA will be the responsibility of the contractor.
b) Written Narratives Outlining the Workflow: Written narratives outlining the workflow must show that there are no bottlenecks in the system that will affect overall production and that all work will be transferred by mechanical transport without use of carts.
PAST PERFORMANCE
The Government will conduct a performance confidence assessment and the Government may use data provided by the quoter and/or data obtained from other sources, including the Contractor Performance Assessment Reporting System (CPARS) and the Federal Awardee Performance and Integrity Information System (FAPPIS). In the case of a quoter that is without a record of past performance or for whom information on past performance is not available, the quoter will not be evaluated favorably or unfavorably on past performance.
PRICE
The total evaluated price of each quote will be determined by adding the equipment quoted price (line item 0001) plus the installation quoted price (line item 0003) and deducting the trade-in value (line item 0002) to render the total evaluated price. The award of this contract will be based on the best value for the Government.
