Amendment 0003 Attachment 1

QUESTIONS AND ANSWERS TO SOLICITATION

Question 1:

One area we would like clarified sooner rather than later pertains to the D-4 Attachment. Based off those requirements we will be providing 12 or so hearing aids for testing. The D-4 requirements fall under the Volume II Technical section… which notes we need ‘7 copies’. It appears that we only need to provide 12 based off of the language in E.4 but we wanted to check in case it truly was 84 aids we need to send out.

Answer 1:

You are required to provide 7 copies of the Volume II-Technical. In addition, 12 aids (with Attachment D-5) are required to be sent in for testing.

Question 2:

Will there be a pre-proposal conference for this solicitation?

Answer 2:

The Government will not be conducting a pre-proposal conference for this requirement.

Question 3:

In reference to 65--Hearing Aids and Wireless Systems Recompete Contract (VA-18-00121268), can you confirm if this is a small business designation for submission?

Answer 3:

Please refer to the solicitation notice for the answer to your question. Specifically:

The contract period will be November 1, 2019 through October 31, 2024. Subject procurement is being procured as a commercial item as defined in FAR Part 12. Contract awards will be made in accordance with FAR Parts 12 and 15. Subject announcement is being made in accordance with the requirements of FAR Part 5. The North American Industry Classification System code is 334510 and the Small Business Size Standard is 1,250 employees. The requirement package will be issued as a full and open solicitation for any and all qualified, experienced, and knowledgeable business entities who can meet the requirements. The acquisition will be procured as a Lowest Priced Technically Acceptable type of acquisition under which offers will be determined to be technically acceptable or unacceptable based on the requirements, then evaluated for overall price. Trade-offs will not be used.

Question 4:

I have a question regarding the solicitation language as it relates to the fitting software. The context and question are as follows:

“The solicitation language at §B.17(a) states that “failure to submit the (fitting) software as described below and in Appendix D-12, will preclude the VA from packaging and deploying the software to the VA Audiology workstations…” §B.17(e) states that “contractor shall confirm that software is compatible with the Noah Link wireless programmer.”

Question: Are we to construe this language to mean that our software must be compatible with the Noah Link wireless programmer and, if not, the VA will not package and deploy the software to the VA Audiology workstations?

If the answer to this question is yes, can you further define/elaborate on the term “compatibility?” Specifically, does the software truly have to program using the Noah Link wireless or does it need only to not cause conflict when downloaded on the same computer as the Noah Link wireless?

Further, will the VA still support the programming of hearing aids with the contractor’s proprietary programmers?

Answer 4:

The programming software submitted by the Contractor must be compatible with the Noah Link wireless programmer and at least one of the models submitted in Group 3 must utilize the Noah Link wireless programmer. Per section B.17 (a) & (e), the Contractor shall confirm that software is compatible with the Noah Link wireless programmer. Failure to follow this guideline will preclude VA from packaging and deploying said software to the VA Audiology workstations. Per section B.12 V (b), at least one model in Group 3 must utilize the Noah Link wireless programmer. The use of the Contractor’s proprietary wireless programming interface will still be supported by VA but the guidelines stated above must be followed.

Question 5:

Required Document: Complete the statements in 52.209-5(b) (Section E.5) and 52.209-7(b) (Section E.6).

Question: Statement for 52.209-7(b) can be found on page 136 of solicitation, however, 52.209-5(b)(Section E.5.) is stated as a contract type (page 139). Is there documentation that needs to be completed by prospective vendors related to this listed required document, or do we print and include ‘Section E.5’ as is?

Required Document: Authorized Negotiators at E.15.

Question: When reviewing the solicitation ‘Authorized Negotiators’ is mentioned one time, which is on page 138 as a required document for submission. We are unable to find section E. 15 and are wondering if what is required is the request from B.1 (1)(Contractor) related to maintaining a letter designating the primary and primary/alternate points of contact(s) with contractual authority.

Answer 5:

52.209-5 – Certification Regarding Responsibility Matters (Oct 2015) has been added to the solicitation as section E.13 and shall be completed and returned with proposals.

Authorized Negotiators reference has been changed to E.14 and has been added to the solicitation. This shall be completed and returned with proposals.

Question 6:

One additional question, when looking at Business submission #7 (pg. 137), it refers to ‘(Section E.14)’, which we do not see in the solicitation. Is this referring to the registration process in System for Award Management website only, or is there a statement within the solicitation that must be completed to fulfil this requirement?

(7) Offeror’s Representations and Certifications completed and/or registration in System for Award Management website at www.sam.gov. Offerors must ensure the statement at FAR 52.212-3(k)(1) (Section E.14) has been completed.

Answer 6:

Offerors must ensure the statement at FAR 52.212-3(k)(1) (Section E.14) has been completed. This language has been removed from the solicitation.

Question 7:

Our supply chain team has asked for some clarification around the subcontracting plan that we include with the bid proposal. Should we include our current subcontracting plan (October 1, 2018-September 30, 2019) that we are working within for contract [REDACTED] to satisfy this requirement or should we submit a “new” plan and if so, what date range would the subcontracting plan follow?

Answer 7:

A new plan that covers then entire period of performance (November 1, 2019 through October 31, 2024).

Question 8:

When completing Attachment D-1 we recognized that there aren’t Earmold Classification Codes (Attachment D-3) that represent some of our earmold options. In these cases, how would you like us to proceed?

Answer 8:

To confirm, this question is in reference to the Attachment D-1 for solicitation 36C79119R0006. The codes for earmolds on the Attachment D-3 are a guide to input information onto the Attachment D-1. If in the event there isn’t a code listed on the Attachment D-3 that closely matches what your organization needs, it is acceptable to write in the earmold information onto the Attachment D-1.

Question 9:

I have a question related to the ‘Schedule of Items’ for solicitation 36C79119R0006. In ‘Group 4’ there is a required line asking for Est. Total Price for each item. Due to the unpredictability of estimated quantity and the variability of price across each accessory this is challenging for us to accurately forecast. Considering this, is there a formula we should use when completing the Est. Total Price fields?

Answer 9:

Unit Price is all that is required for this Group. You may put “N/A” in the “Est. Total Price” column to read as the following for each offered device:

CLIN-10a Model Name: HCPCS Code:

Pricing:

10a Unit Price $__________ Est. Total Price $_N/A_________

Question 10:

Definitions

Solid State batteries-batteries that use solid electrolytes

Q) Could you provide an example of a solid state micro battery?

Answer 10:

This is referencing potential emerging battery technologies over the life of the contract, not necessarily any currently in production.

Question 11:

Do you classify silver zinc (ZPower) as solid state?

Answer 11:

No

Question 12:

B.10 Instructions for Pricing

Group 4, Category 1 is listed as optional, however in B.11 Schedule of items and E.11 it states required

Answer 12:

The listing in the pricing table in Section B.10 Instructions for Pricing is a typo; Group 4 Category 1 is required. This will be corrected via Solicitation Amendment.

Question 13:

B.14 Extra Components (hearing aid only)

Section (b), Earmolds may be ordered for a charge any time after the 180-day trial period Q) If an earmold is placed after the initial order, but within the 180 day trial, will that order come through ROES at $0?

Answer 13:

Yes – see also B.30 (a) (1) (i) (A)

Question 14:

B.30 Ordering Procedures, (a) VA Audiology Clinics and Other Government Agencies using ROES, (6) Earmold (Only) Orders after the trial period expiration., V

Q) If we change the style, how will that be reflected in ROES since that is a different model/ROES code? If the changes are not updated in ROES, and the clinic re-orders in the future, their order would then be incorrect.

Answer 14:

Unclear about what is being as asked, but it appears this is asking about changes after a contract has been awarded. No contracts have been awarded, at this time, therefore any future activity cannot be discussed.

Question 15:

Q) Also, there is mention under earmold only orders (through ROES) of printing the earmold remake form, however this currently does not work due to a glitch in ROES, will this be corrected?

Answer 15:

This does currently work.

Question 16:

Attachment D-4 Product Evaluation, II ANSI/ASA TD and EIN Test

Required models include, Two RIC power hearing aids with non-rechargeable power with an attached power dome and receiver with a matrix at or above a maximum power output of 125 dB SPL and maximum gain of 60 dB SPL

Q) Our understanding of the test process, this would occur in a test box. For optimal results with this power level, we provide a custom earpiece which will use the same coupler as a power dome, is there a concern with this option?

Answer 16:

Per the specifications in attachment D, a custom earpiece cannot be provided. The testing has to be completed with a power dome.

Question 17:

E. 4 Specific instructions to offerors regarding proposal preparation

6) Complete the statements in 52.209-5 (b) (Section E.5) and 9) Authorized Negotiators at E.15, these sections are not provided in the solicitation

Answer 17:

This was corrected via solicitation Amendment 0002

Question 18:

VA information and Information System Security/Privacy Language

Q) This section is not present in the current solicitation, does the MOU/ISA take the place of this clause?

Answer 18:

This is not required for this solicitation.

Question 19:

I see that you are asking for pricing for up to eight Groups of hearing aids and systems with five “required” Groups and Categories to be submitted to be considered. At this time, we have two total product offerings in the CHA, rechargeable space and will be adding a third offering in the RIC, rechargeable space shortly thereafter. If our submission is only for these groups and categories, will it preclude us from consideration entirely? Or would we still be considered for just these Groups and Categories?

Answer 19:

Devices must be submitted for all required groups and categories for the proposal to be considered.

Question 20:

In the CHA Group, do we need to have offerings in all four form factors (full shell, half shell, canal, and CIC) to be considered, or again, could we be considered just for the form factor(s) that we have to offer? Our products have a premium, consumer electronics-style color palette and finish; if we do not have the requested “light/medium/dark skin tone” colors, will this also take us out of consideration?

Answer 20:

The group 1 product line requires that the offeror offer at least one model in each of the following forms factors: full shell, half shell, canal and CIC. Hearing aids for all groups and categories must be offered in dark, medium and light skin colors at a minimum to be considered.

Question 21:

Per Section E.3 - when providing information on Place of Performance, should we provide all facilities used in manufacturing, distribution, sales and operations globally, or just those located in the United States?

Answer 21:

The provision states:

(a) The offeror or respondent, in the performance of any contract resulting from this solicitation, intends, does not intend [check applicable block] to use one or more plants or facilities located at a different address from the address of the offeror or respondent as indicated in this proposal or response to request for information.

Please include all locations as applicable.

Question 22:

Per Section B.21 (b), should we provide our consumer technical support hotline number with this submission? Or can it be provided at any point to the Contract Officer?

Answer 22:

If it is available at time of proposal submission it should be provided at that time.

Question 23:

Do the NIST sample devices have to be provided in the same package as the Business and Technical proposal documents? Or can they arrive in a separate shipment before the submission deadline date?

Answer 23:

They may be shipped separately but must arrive by the solicitation closing date and time. However, Denver Logistics Center/Commodities and Services Acquisition Services is not responsible for improperly labeled packages.

Question 24:

In Section B.20 Contract Product Training, the approved and prohibited topics for Health Technicians makes no mention of educating on impression taking. Is this allowed or prohibited?

Answer 24:

Hands on training of taking impressions is prohibited, but discussing issues related to poor impressions and the effects on hearing aids that are made from bad impressions is allowed.

Question 25:

Does a hearing aid price defined in Category 1 have to remain the same if offered in Category 2 of the same Group? (i.e. all RIC hearing aids must be the same price whether in Category 1 or 2 of Group 3, before the additional charges for battery/charger).

Answer 25:

Please refer to Section B.10 Instructions for Pricing for information.

Question 26:

If we offer an in-the-ear, non-custom device, also available as a CROS, and in the future be rechargeable, could this be considered a variant of a Group 1, Category 2 CIC shell type?

Answer 26:

An instrument designated as ‘custom’ will fit only one ear of one individual. Custom aids are made with shells designed from a cast or mold made from an individual ear. Group 1 devices are defined as Custom Hearing Aid Digital Products and, as such, adhere to this requirement.

Question 27:

In order to be offered on contract, would a hearing aid charger accessory be required to have a UL listing?

Answer 27:

Hearing Aid accessories at not part of this solicitation.

Question 28:

This question seeks to clarify the solicitation requirements set forth under B.17(e) & B.12V(b) when considered together. By way of example: a Contractor submits in Group 3 a mix of two different product lines each utilizing different programming software packages. One product line uses Noah Link wireless programmer and one does not, which is acceptable under section B.12V(b) (which requires that at least one model in Group 3 must utilize the Noah Link wireless programmer). This product line also satisfies section B.17(e) (which requires the programming software be compatible with the Noah Link wireless programmer).

Question: since the other product line does not utilize the Noah Link wireless programmer (which is permissible under B.12V(b)) does the VA still require that the programming software for this product line satisfy section B.17(e)?

Answer 28:

Any software module or contractor’s proprietary interface provided by the contractor to the Government shall conform to the requirement list in B.17 (e) - “Contractor shall confirm that software is compatible with the Noah Link wireless programmer.”

Question 29:

In the RFP, under the requirements for Group 1 – Category 1, Minimum Technical Requirement #13 indicates that the contractor shall have a range of models appropriate for mild, moderate, and severe hearing losses; however, this is not listed as a requirement for Group 1 – Category 2. Is this a requirement for Group 1 – Category 2 and was not listed, or is it genuinely not a requirement for submission for Category 2?

Answer 29:

Group 1 Category 2 does not have a minimal technical requirement requiring a range of models appropriate for mild, moderate, and severe hearing losses.

Question 30:

As we continue to develop new products in this space that won’t be commercially available by the time the contract begins, would we have the future opportunity to introduce them to the VA during the duration of the contract? Or would they only be considered at the time of the next RFP issuance?

Answer 30:

You must meet the requirements as stated in the solicitation to be considered.

Question 31:

If an offeror provides products under the solicitation, manufactured by another party, but otherwise standard in the hearing aid industry, will the contracting officer identify which products will require letters of supply during contract negotiations?

Answer 31:

The offeror is required to complete E.12 52.212-3 Offeror Representations and Certifications-Commercial Items (Oct 2018) as well as the Dealer/Supplier Letter as stated in Section E.4 Specific Instruction to Offerors Regarding Proposal Preparation. (12) Dealers / Suppliers. If other than the manufacturer, the Offeror must submit, with the offer, a letter of commitment from the manufacturer, which assures the offeror source of supply sufficient to satisfy the Government requirements for the duration of the period, to include base and options. The letter must be from the manufacturer on company letterhead and noting the commitment by the product name, brand, and origin of the product. It should also provide an overview of how this business relationship will work between the Dealer and Supplier. Offers from dealer/suppliers that do not submit the letter of commitment with all the information noted above will be rejected.

Question 32:

Per the below on the D-4 Product evaluation, a custom earpiece is not acceptable and a power dome must be used for testing purposes.

Our RIC products meet/exceed the technical requirements provided in the B-12, highlighted below. However, our concern is regarding the NIST testing process for the 60/125 with power dome.

For the NIST testing, they mention that the RTG on the technical spec sheet will be used, will they be using the 2cc or Ear Simulator data?

Answer 32:

As stated in the solicitation, the RTG measurement will be done in a 2cc coupler as specified in ANSI/ASA S3.22-2014. The measured RTG for the given sample shall match within +- 6 dB of the 2cc coupler values reported on the specification sheet for the model of the submitted sample. In addition, NIST will measure the total harmonic distortion (THD) and equivalent input noise level (EIN) of each sample for VA to check against VA requirements for THD and EIN. Samples are to be programmed by the offeror to the reference test setting and will only be tested with that setting. There are no other measurements that will be made for the aids submitted for ANSI/ASA S3.22-2014 THD, EIN and RTG tests.

Question 33:

(B.19) Our current employees generally complete their annual TMS training in January-March of each year. Do we need these employees to re-take the same TMS tests ‘two weeks prior to the effective date of the contract’ or does their completion from earlier this year satisfy this requirement? Understood that completely new employees who have never taken TMS training before would need to comply with the above clause before the contract would go live.

Answer 33:

If an individual has already established an account in VA Talent Management System (TMS) and taken annually required training, the training is valid for 1 year from completion date. Since no contract award has been made at this time, future contractual activity cannot be discussed, but all requirements as stated in the solicitation must be met in order to be considered.

Question 34:

(B.20) We are concerned that clinicians will not be adequately prepared to fit the new product offerings at the time of contract refreshes (May 1 and November 1) without prior available in-depth training due to the revised 20% rule once products are submitted to contract.

Answer 34:

The question is not relevant to the solicitation or the evaluation process. The time to raise this type of concern was during the Request for Information (RFI) DRAFT Request for Proposal (RFP) that was issued on August 30, 2018.

Question 35:

(B.20) Do regional training dates and locations need to be included on the annual training plan (i.e. how we list national in-house trainings currently) or is there more flexibility surrounding this type of training like on-site trainings based on the needs of the local clinicians?

Answer 35:

Since no contract award has been made at this time, future contractual activity cannot be discussed, but all requirements as stated in the solicitation must be met in order to be considered.

Question 36:

(B.30) For L&D requests, the contractor is required to ship the replacement hearing aid within 24 hours. We are concerned about this turn time for custom or mixed product (standard device plus earmold or embedded receiver) L&D requests. Would DLC consider extending the time frame specifically for L&D requests that have a custom component to them?

Answer 36:

Since no contract award has been made at this time, future contractual activity cannot be discussed, but all requirements as stated in the solicitation must be met in order to be considered. Per Solicitation Section B.30 Ordering Procedures (a)(4) Loss and Damage (L&D) Requests – The loss and damage replacement of hearing aids ordered under this contract and issued by VA or other Government agencies shall only be requested by an authorized Government facility. The Audiology Clinics shall place their L&D requests with DLC and then submit the request to the Contractor electronically or via a ROES Service Request form. The contractor shall use the original purchase order number from the DLC. Twenty-four (24) hours after receipt of the L&D request from the DLC, the Contractor shall ship the replacement hearing aid to the facility on the L&D request, enclosing one copy of either a packing slip or invoice. Meaning the contractor will ship the replacement once 24 hours has passed from receipt of the L&D request.

Question 37:

Section B.10 INSTRUCTIONS FOR PRICING, page 16 The table provided in section B.10 INSTRUCTIONS FOR PRICING shows that Group 4, Category 1 Wireless Systems is an "Optional" group. B.11 SCHEDULE OF ITEMS and B.12 PRODUCT TECHNICAL REQUIREMENTS show that it is a "Required" group. Which is correct?

Answer 37:

The listing in the pricing table in Section B.10 Instructions for Pricing is a typo; Group 4 Category 1 is required. This will be corrected via Solicitation Amendment.

Question 38:

B.26 ELECTRONIC DATA INTERCHANGE a and ATTACHMENT D-8 ELECTRONIC DATA INTERCHANGE GUIDELINES Section B.26 states that "electronic Data Interchange (EDI) according to the ANSI X.12 standard, v.4010 (or later versions) is required for the exchange of authorized purchase orders…". Attachment D-8 (EDI Guidelines) indicates that there may be a possible upgrade which would migrate EDI from v.4010 to v.5010. Will this upgrade occur in conjunction with the start date of the new contract (November 1, 2019)? If so, how much advanced notice will vendors receive?

Answer 38:

At contract implementation, v.5010 will be the standard. The FSC will work with vendors to implement EDI using the v.5010 standard. If any vendors are currently using EDI v.4010 based on an existing contract, the FSC may initiate dialog either before or in conjunction with the new contract date to migrate them to the v.5010 standard.

Question 39:

B.12 PRODUCT TECHNICAL REQUIREMENTS X. GROUP 8 – COCHLEAR IMPLANT (CI) COMPATIBLE DEVICES (OPTIONAL) The Group 8 COCHLEAR IMPLANT (CI) COMPATIBLE DEVICES seems to read that the products that would be submitted here would be hearing aids and/or wireless accessories that were designed specifically for CI processors. It also states that, "A device offered in another Group cannot be included in this Group." We have product in other category(ies) that are also CI compatible. Is there a way to indicate this anywhere in our submission? Would you consider adding this as a "Classification Code/ ROES Code" so that we could identify the applicable products as "CI Compatible"?

Answer 39:

Group 8 is for CI compatible devices that are not offered in other sections of the contract. If devices are offered elsewhere in the contract, they cannot be listed in Group 8. You must adhere and conform to the Solicitation requirements as stated to be considered.

Question 40:

Solicitation Details Is it anticipated that there will be any vendor meeting(s) prior to 11/1/19 for those whose bids result in an award?

Answer 40:

Post award conferences will be held with the successful awardee(s), as applicable.

Question 41:

ATTACHMENT D-8 ELECTRONIC DATA INTERCHANGE GUIDELINES Attachment D-8 states, The FSC ECD team will provide the X.12 mapping documents for all of the EDI transactions used in the solution. Will FSC ECD provide vendors with mapping documents for all required EDI transaction sets prior to the start of the new contract? Will there be changes to the X.12 mapping documents in conjunction with the start date of the new contract?

Answer 41:

Once the contract award(s) are made, mapping documents can be coordinated between vendors and the FSC. Any changes in mapping can be made available prior to the start date, and compliance will be addressed in conjunction with the start date, or within a reasonable grace period following the start date.

Question 42:

ATTACHMENT D-8 ELECTRONIC DATA INTERCHANGE GUIDELINES Attachment D-8 states, The FSC ECD team will set up the appropriate transaction framework to communicate (send/receive) EDI transmissions, e.g., identifiers, mailboxes, etc. Is the vendor allowed to request a change to the transaction framework after the start date of the new contract? For example, change from a VAN SFTP connection to an AS2 connection?

Answer 42:

Yes, changes to the transaction framework can be requested after the contract start date.

Question 43:

RFP B.30 ORDERING PROCEDURES "Regarding Loss and Damage replacements: ""Twenty-four (24) hours after receipt of the L&D request from the DLC, the Contractor shall ship the replacement hearing aid to the facility on the L&D request…"" Does this mean that contractors are to ship the replacement within 24 hours, or that we should hold the order for 24 hours before processing the Loss and Damage replacement to allow time for cancellation in the event that the patient finds their lost hearing aid(s)?"

Answer 43:

Question 44:

B.20 CONTRACT PRODUCT TRAINING "Section (g), paragraph (2 iii) indicates that alcohol shall not be provided by the contractor. This is true today as well. I see that the statement about cash bar has been removed, but there is no language prohibiting the allowance of a cash bar at in-house events. Will cash bars still be allowed?"

Answer 44:

No, cash bars are not allowed.

Question 45:

B.10 INSTRUCTIONS FOR PRICING "Hearing aid Groups will be divided into 2 Categories; Category 1 is Non-Rechargeable, and Category 2 is Rechargeable. The pricing instructions for the Category 2, Rechargeable state, ""There is one price for all models and components offered in Group # Category 2. Pricing includes the cost of the charging unit and battery as applicable."" Is it expected that the offered price for Category 2, Rechargeable products will be the sum of the respective Group's Category 1 products plus the cost of the charging unit (and/or battery)? OR, are we able to offer a unique price for the hearing aid before the charging unit is factored in? The latter would allow for consideration of the fact that rechargeable technology and manufacture costs are higher than that of a non-rechargeable hearing aid when comparing hearing aids alone. "

Answer 45:

Per Section B.10 Instructions for Pricing

Category 2
CHA Rechargeable
There is one price for all models and components offered in this group and category. Pricing includes the cost of the charging unit and battery as applicable.

Question 46:

B.12 PRODUCT TECHNICAL REQUIREMENTS III. GROUP 1 – CUSTOM HEARING AID (CHA) DIGITAL PRODUCTS (REQUIRED)" One of the requirements for custom hearing aids is that the products have three or more programs. Would you consider making a exception for an IIC with one program?

Answer 46:

CIC/IIC devices are not exempt from the 3 or more programs MTR

Question 47:

Question related to Sect. B.17 PROGRAMMING SOFTWARE, subsection c, pp. 38 related to Windows 7 & 10 compatibility:

Microsoft have numerous versions of their Windows 7 & 10 Operation systems. Can you list any specific versions of Microsoft Windows 10 and Windows 7 Operating systems our programming SW shall be compatible with?
