IAW FAR 14.109-1(a)(1)(iii), when award is made to other than a low bidder, state the reason for rejection in the notice to each of the unsuccessful low bidders.

On 12 March 2024, a Virtual Bid Opening was conducted at 1300 (1:00 P.M.) EST, for IFB No. 36C78624B0005 and there were four (4) Bids in receipt. Abstract of Bids were reviewed, and Veterans Contracting Group Inc (VCG) was the Lowest Bidder; however, VCG’s Bid was significantly lower than the other Bidders and lower than Government Independent Cost Estimate (IGCE). In Accordance With (IAW) FAR Part 14.407-3 (g) (1), collectively the NCA wanted to give VCG the opportunity to Verify their Bid ONLY, for it was thought to have contained possible errors.

A modified Bid was submitted to the Contracting Officer (CO) in response to the request of VCG’s Bid Verification submitted, However, Veterans Contracting Group Inc’s did NOT respond as requested by NCA to verify their Bid Only. VCG, chose to divert and instead submit an Un-Requested modification of Bid.

Veterans Contracting Group Inc (VCG) alleged that numerous items were not included in the submitted Bid on 12th March 2024, but provided no proof of why multiple portions of the project cost were not included in the original Bid. Instead, VCG attempted to add in numerous costs and increase originally submitted costs. To allow VCG to materially change its Bid with no evidence of a legitimate mistake, would be completely unfair to the other Bidders/competitors, in addition of loss of faith in the integrity of the Government procurement process.

The agency, National Cemetery Administration, Contracting Service, Construction Department, determined that the evidence compiled relating to the mistaken Bid provided by VCG was not clear and convincing as to the intended Bid, and the modified Bid could not be accepted.

The Contracting Officer (CO) recommend Withdrawal of the Bid as opposed to modifying the Bid because VCG failed to provide sufficient evidence to support the numerous alleged mistakes.

On 13 May 2024, Veterans Contracting Group Inc (VCG) requested to withdraw their Bid, for IFB No. 36C78624B0005, Facility Renovations, Improvements, and Repairs, under Project No. 815CM3041.

NOTE: Government Will Not consider subsequent revisions of the Offeror’s Bids.

We appreciate your interest in this IFB Solicitation and encourage your continued interest in future NCA procurements.
