About this file

This is a Justification and Approval (J&A) document for Other Than Full and Open Competition issued by the Department of Veterans Affairs, Veterans Health Administration, Program Contracting Activity Central (PCAC).

The document justifies a sole-source procurement for the Elevator Upgrade Bed Tower | Pittsburgh – UD Construction project at the Pittsburgh VA Medical Center, to be awarded as a firm-fixed price contract under RFP 36C77626R0105 (Acquisition ID: 36C776-26-AP-1479). The procurement is justified under 41 USC §3304(a)(1) for "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." The sole branded item is a Simplex 4100 series fire alarm system from Johnson Controls of Pittsburgh, PA (866-668-0942, johnsoncontrols.com). The fire alarm system requires complete installation and programming of fire alarm initiating and notification appliances to match existing equipment and maintain proper operation of the facility's fire protection system. The overall construction project has a VAAR magnitude between $2,000,000 and $5,000,000. The Contracting Officer determined the anticipated cost to be fair and reasonable based on a government estimate prepared by the VA team and confirmed by the Contracting Officer's Representative. Market research was conducted by the Contracting Officer's Representative and the Architect/Engineer, confirming that the Simplex 4100 series is manufactured by Johnson Controls in Massachusetts and complies with Buy American Act requirements. The justification notes that no competing vendors possess the necessary programming rights, and alternative equipment would compromise system integrity and create significant duplication costs. Although this specific item is sole-source, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside, with offerors responsible for obtaining pricing from suppliers and submitting competitive proposals.
