About this file
This is a Special Notice of Intent to Sole Source a commissioning services contract. The Veterans Health Administration (VHA) Program Contracting Activity intends to negotiate exclusively with DuBois and King Inc., a Small Business, to provide commissioning services for the final completion of the EHRM (Electronic Health Records Modernization) Project at the Edward P. Boland VA Medical Center in Independence, Ohio. The contract is classified under NAICS code 541330 (Engineering Services) with a small business size standard of $25.5 million. The sole-source justification is based on the authority of FAR 6.103-1, citing that only one responsible source can satisfy agency requirements per 41 USC 3304(a)(1). The VA's rationale includes that the commissioning process is already more than 20% complete with the incumbent Commissioning Agent (CxA), and engaging a new CxA would necessitate restarting the commissioning of mechanical systems, resulting in significant additional costs and duplication of completed submittals and testing.
The solicitation number is 36C77626Q0176, issued by the Department of Veterans Affairs Technology Acquisition Center with a contracting office zip code of 44131 (Independence, Ohio). Interested parties may submit a capability statement (not a proposal or quote) to charles.white2@va.gov and megan.dohm@va.gov no later than June 5, 2026 at 1:00 PM Eastern Time. This notice does not obligate the Government to award a contract, does not constitute a request for proposals or quotes, and will not result in payment for information submitted. The Government reserves the right to use submitted information for market research purposes.

Special Notice
NOTICE OF INTENT TO SOLE SOURCE:
The Veterans Health Administration (VHA) Program Contracting Activity (PCAC) intends to negotiate on a sole-source basis with Dubois and King Inc., a Small Business (SB), to provide commissioning services to complete the final commissioning of the EHRM Project at The Edward P. Boland VA Medical Center.
The North American Industry Classification System (NAICS) code for this requirement is 541330 with a small business size Standard of $25.5 million. The authority for restricting competition on this requirement is FAR 6.103-1. Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1), and as implemented by RFO 6.103-1.
Following the termination for default of the Prime Architect-Engineer (AE) contract, the VA seeks to complete commissioning with the AE’s subcontracted Commissioning Agent (CxA). The commissioning process for the EHRM project is more than 20% complete. Engaging a new CxA would require restarting commissioning for mechanical systems, resulting in additional funding for the construction contractor to re-perform submittals and tests already completed. The VA is satisfied with the performance of the incumbent CxA. For these reasons, it is in the Department's best financial and operational interest to award this effort to the project's existing CxA.
This Notice of Intent is not a request for quotes or proposals. No contract award will be made based on quotations or proposals received in response to this notice. No telephone or email inquiries will be accepted.
Any responsible source who believes it is capable of meeting the requirement may submit a capability statement to charles.white2@va.gov and megan.dohm@va.gov no later than June 5, 2026 at 1:00
PM (ET).
Disclaimer and Important Notes: No proprietary, classified, confidential, or sensitive information should be included in responses to this notice. This notice does not obligate the Government to award a contract.
The Government will not pay for information provided in response to this notice. The Government reserves the right to use information provided by respondents for market research purposes. The Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted.
