About this file

This is a Presolicitation Notice for a sole source contract from the Department of Veterans Affairs (VA) for Critical Power Management System/Automatic Transfer Switches Maintenance Services at the Minneapolis VA Health Care System. The VA intends to award a Firm Fixed Price contract to ASCO Power Services, Inc. for a Base + 1 Option Year contract, citing unique proprietary characteristics that limit availability to only one source. The sole source justification is based on ASCO's proprietary equipment and software that monitors and operates Automatic Transfer Switches during power outages, with no third-party service access permitted.

Key details include a solicitation number of 36C26326Q0213, response deadline of December 19, 2025 at 12:00 PM Central Time, and a requirement for vendors to submit capability statements electronically to Contracting Officer Alisha Milander. The procurement uses NAICS code 811310 and product service code J059. While market research identified 1,115 SDVOSB and 1,257 VOSB vendors in the database, only ASCO can provide the specific maintenance services required, resulting in a planned sole source award that bypasses standard competitive bidding processes.

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards For Over Micro-Purchase Threshold but Not Exceeding the SAT ($350K)

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23, 316 Robert St N, Ste 506, St. Paul, MN 55101 Requesting Activity: Minneapolis VA Health Care System, One Veterans Drive, Minneapolis, MN 55417

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This Base + 1 Option Year contract is for Critical Power Management System (CPMS) / Automatic Transfer Switches (ATS) Maintenance Services for the Minneapolis VA Health Care System.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

ASCO Power Services, Inc. (ASCO) provided a sole source letter stating that they do not allow third parties to perform work on their proprietary equipment. All accessories and controls upgrades require an ASCO employee to install, as they are engineered kits and are not sold direct for installation by third party entities. Propritary software is used to operate this system. The ASCO CPMS server monitors and operates ASCO ATSes in the event of a power outage. The CPMS and the ATSes work together to automatically connect and disconnect power from the facility during a power outage.

4. Description of market research conducted and results or statement why it was not conducted:

The SBA Small Business database was searched using NAICS 811310 resulting in 1,115 SDVOSB vendors and 1,257 VOSB vendors. The market research conducted indicates that there are many SD/VOSBs performing services under the NAICS Code; however, only ASCO Power Services, Inc. can provide the services required for this procurement. They have provided a sole source letter stating that they do not allow third parties to perform work on their proprietary equipment. Since other contractors will not be able to access parts or software to service or repair this equipment, a sole source award will be made to fulfill the requirement. Neither the VA Rule of Two nor the SBA rule of two could be met.
