Cameron Rick Contracting Officer Questions Concerning Solicitation:

36C26324Q0117: Legionella Water Testing Fort Meade VA Medical Clinic

1. Question: Page 10 B.2 Price/Cost Schedule shows Unit “EA”, should this be Unit “JOB” or “JB”? If so, can the government provide an updated CLIN table.

A: The CLIN has been updated to JB for job.

2. Question: Page 10 B.2 Price/Cost Schedule – Can the government clarify that pricing should be provided in the CLIN table on Page 10?

A: Yes, in the RFQ on page 10 at the CLIN, Grand Total is the proper location for pricing.

3. Question: Page 49 – Instructions to Offerors c. Pricing proposal states “Offeror must indicate pricing on each and every line item listed in the Pricing Schedule….” Can the government clarify if the reference to “Pricing Schedule” refers to B.2 Price/Cost Schedule in the RFQ document OR if offerors should submit pricing on the CLIN table provided in Attachment_SOW line items Legionella FY24 Testing.docx??

A: Pricing for the items on the SOW line items Legionella FY 24 Testing would be acceptable.

4. Question: Addendum to FAR 52.212-1 Instructions to Offerors-Commercial Items b. Past Performance 1. states, “Offeror must provide up to (3) letters of recommendation/references from a firm or agency in which your company has provided the same or similar type of services and complexity described in the Statement of Work.” Can the government clarify if providing references including name, address, telephone number and point of contact of the firm or agency. is acceptable?

A. If the references are GOV contracts/contacts (VA in particular) providing references including name, address, telephone number and point of contact of the firm or agency would be acceptable.

5. Can the government clarify that actual letters of recommendations are not required?

A. Offeror must provide up to (3) letters of recommendation/references from a firm or agency in which your company has provided the same or similar type of services and complexity described in the Statement of Work. Each reference must represent services that are on-going or that you’ve provided in the past three (3) years.

6. If actual letters of recommendations are required and as these letters will put a burden on the customer/agency such as a VA contract POC, can the government provide the required format and information other than name, address, telephone number and point of contact of the firm or agency that must be included so Offerors can provide to VA customer POCs to complete?

A. There is no required format for the letters of recommendation. The letters provide information on on-going or past services from clients of the potential vendor for this solicitation.

7. Will the government accept a copy of CPARS in lieu of “letter of recommendation/references”?

A. If the CPARS contains the name, address, telephone number and point of contact of the firm or agency it would be acceptable.

8. E.2 52.212-2 Evaluation-Commercial Items (NOV 2021) (a) (1) states, Price (Base Year + 4 Option Years) B.2 Price/Cost Schedule only provides one CLIN for a 6-month period. Can the government clarify the period of performance for this contract and provide a new CLIN table if needed?

A. Paragraph 2(A) under clause 52.212-2 “Contractor must be able to provide all services requested in the SOW in the appropriate timeframes stated. This solicitation is for a base year only. The period of performance is in CLIN 0001.

9. Is this requirement subject to Clause 52.222-44, Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment (MAY 2014) (29 U.S.C 206 and 41 U.S.C. chapter 67)? If so, can the government update the RFP and provide an amendment?

A. This clause does not apply.

10. Can you give us a sense of how many visits are typically required to the VA locations for the VA to make all the Legionella sample points available to the contractor in a quarter? That is, if we must bring someone in from a remote location can we expect them to be able to access all sample points or will multiple trips in a quarter be required?

A. One site visit per quarter, typically takes 3-4 days to collect all sites. Black Hills Health Care System personnel will collect resamples and provide shipping to the contractor’s lab in contractor provided sample bottles with a contractor provided associated chain of custody.

11. Could you clarify for each item number on Attachment A who is responsible to pay for shipping samples to the lab for analysis and who is responsible to physically collect samples?

A. Contractor pays for shipping as well as handling and dropping off quarterly routine samples at shipper. Contractor will collect quarterly routine samples onsite.

12. There is potential contradiction between the statement of work and attachment A. For example, SOW 2f states “the contractor will provide a fixed price for the sampling equipment and analysis and for the collection of samples for each healthcare system” while attachment A does not include sample collection for item 0002. In the same vein, “non-routine” Legionella testing is referred to frequently in the specification and has different requirements. Could you verify which item numbers from attachment A are non-routine?

A. Non-routine samples would be samples other than the quarterly samples (collected during the scheduled 3-4 days)

13. Will VA personnel take and record temp, pH, and residual biocide readings when they take Legionella samples?

A. Collection of temp, pH, and residual biocide readings as well as entry into the spreadsheet are the responsibility of the contractor for quarterly routine samples, VA personnel will escort the contractor onsite during quarterly sampling. VA personnel will collect temp, pH, and residual biocide readings for retest and nonroutine samples and ship to the contractor for laboratory analysis.

14. Statement of Work part 2.b states “The numbers and types of samples to be collected and analyzed are specified in Attachment D.” Was this intended to refer to attachment A? If not could you provide attachment D?

A. The Attached SOWlineitems Legionella FY24 Testing should provide clarification as the sample numbers are provided.

15. What does the government want from the contractor when filling in item number 0003? I would suggest that you ask for pricing for the separate elements (testing, shipping, travel, labor) as a bundled unit cost would be very sensitive to the amount of samples to be taken especially for small sample sizes.

A. To clarify, the contractor is required to perform one site visit per quarter (total of two for this contract) lasting 3-4 days to collect quarterly routine samples at sites including testing, shipping, travel, labor. All other samples including retests and non-routine samples will be collected and shipped by VA BHHCS staff in contractor provided sample bottles with an associated chain of custody. VA BHHCS will take and record temp, pH, and residual biocide readings for retests and non-routine samples. Past contracts have provided a cost per sample for legionella samples and a cost for dental samples with the associated costs built in for the once per quarter contractor site visit to collect routine quarter samples.

16. The frequency for Legionella and Dental waterline testing is quarterly, but the Dec 7-June 30 performance period overlaps three quarters of testing (or potentially 2 full quarters and a partial quarter of testing). Could you breakdown the amounts in attachment A so we can know just how many quarterly visits are required?

A. The contract is for 2 quarters of sample collection with associated retesting to follow by VA BHHCS, the first quarter ending in December 2023. Legionella sampling for Q1 will be completed by December end. Q2 sampling needs to be completed by March 2024 end with retests following quarterly sampling as required.
