SECTION 5. CYLINDERS AND CONTAINERS (ALL CYLINDERS)

5.1 Cylinder Requirements

Cylinders, tanks, valves and other containers for gaseous and liquid gases shall comply with applicable FDA, CGA, and DOT requirements and applicable codes and standards regarding manufacture, maintenance, filling, marking, labeling, transportation, packaging, color-coding, valves, valve protection caps, valve brazing, fittings, hydrostatic testing, visual inspection, and

360-degree cryoband placement.

Marking, color coding, and valve connections shall follow applicable CGA publications (Annex

D).

Hydrostatic testing and visual inspection shall follow CGA standards and DOT requirements.

Contractor is responsible for testing of contractor‑owned cylinders; government‑owned cylinder testing will be ordered separately by SAVAHCS when required.

Cylinders shall be filled to the maximum manufacturer’s recommended level unless a lesser amount is specified by the facility or agreed in writing by the CO.

All cylinders shall be clean, free of dirt/rust, and acceptable for inpatient and outpatient health care environments.

Vendor shall verify actual tank sizes; tank storage locations and refill quantities are subject to change with supply/demand.

E-size aluminum oxygen cylinders with fixed regulators (where specified by the ordering activity): lightweight aluminum construction; wide permanent carry handle; flow range 0.25 to 25

LPM (minimum 15 LPM available); DISS 50 PSI fitting for transport ventilator hook-up; MRI-conditional where ordered for MRI use; easy-to-read contents gauge; single-stage valves only.

5.2 Price of Services

Unit prices for gases are all-inclusive and include all services required at each filling to comply with applicable regulations and good practices, including cylinder tagging (Full/In Use/Empty), inspections, cleaning, pin‑indexing where required, attachment of government-furnished warning tags when required, attachment to manifolds when required, delivery, taxes, storage, tracking, and maintenance/testing of contractor‑owned cylinders.

SECTION 6. GOVERNMENT-FURNISHED EQUIPMENT (GFE) – MEDICAL GAS CYLINDERS

The Contractor shall pick up GFE medical gas cylinders including attached appurtenances, inspect them, and fill them to maximum functional capacity during each refilling. Each GFE cylinder and appurtenance shall be returned one-for-one to match the pick-up number. Empty

GFE cylinders shall be transported per DOT regulations using normal commercial practice to prevent damage, at Contractor expense.

All GFE will be labeled, colored, and tagged by VA for identification and tracking. The

Contractor shall provide accurate GFE counts for pickup and delivery on each delivery; missing quantities will be documented on the delivery slip. The Contractor is responsible for lost or damaged GFE at agreed-upon rates identified in the contract.

Any GFE (cylinders, parts, fittings, appurtenances) found non-compliant requires the Contractor to inform the COR and Ordering Officer in writing (or email) and by telephone so the order can be revised. Non-compliant GFE shall be returned on the next delivery at no cost, clearly marked defective with documentation.

GFE remains the property of the ordering SAVAHCS location and is not exchangeable with other VA facilities. Disposition of non‑repairable GFE requires prior facility direction and, if disposal is requested, a separate order.

At the request of SAVAHCS, the Contractor shall perform hydrostatic testing on GFE at the

CLIN price, provide written results per cylinder, return non-compliant GFE marked defective at no additional cost, and fill and deliver compliant GFE per normal procedure.

SECTION 7. CONTRACTOR-PROVIDED CYLINDERS AND EQUIPMENT

7.1 General

Contractor shall provide and maintain cylinders/tanks and equipment and is liable for the integrity, suitability, safety, maintenance, inspection, and tracking of contractor-provided cylinders.

Contractor-provided equipment shall be installed, inspected, inventoried, and maintained at

Contractor expense and kept in good operating condition and appearance (clean, rust free, labeled). SAVAHCS will provide reasonable access to storage areas for this purpose.

Documentation of all safety testing, including hydrostatic testing, shall be provided upon request at no charge.

SAVAHCS has the right to refuse dirty cylinders or cylinders that do not meet applicable regulations and standards. The Contractor must replace rejected cylinders within 24 hours at no additional cost to the Government.

The Contractor shall provide training to VA staff upon request at no additional cost, including upon equipment change, technology upgrade, or manufacturer specification change.

7.2 Cylinder Rental

Except as provided below for Research Service Line refills, rental charges for contractor-provided cylinders shall begin on the date of delivery, subject to Government verification of receipt, and shall cease on the date of pickup shown on the delivery slip.

Rental shall be calculated daily based on the actual number of contractor-owned cylinders in the

Government’s possession during the billing period. Monthly invoices shall reflect the cumulative daily rental charges earned during the applicable invoice month.

Research Service Line Refill Exception and Qualifying Refill Definition. No cylinder rental fee shall apply to a Qualifying Refill for a Research Service Line account. A “Qualifying Refill” means a transaction in which: (1) the cylinder is assigned to and used by the Research Service

Line; (2) the cylinder is Government-owned or otherwise not furnished by the Contractor, and the Contractor returns that same cylinder after filling; or, for a contractor-provided Research cylinder, an empty cylinder is exchanged one-for-one for a filled cylinder of the same gas service, cylinder type, size or capacity, and applicable valve connection on the established recurring Research delivery schedule, ordinarily every four to five days; (3) the transaction does not increase the number of contractor-owned cylinders assigned to or held by the Research

Service Line; and (4) the delivery slip identifies the Research account and location, gas, cylinder type and size, quantity picked up, quantity returned or exchanged, transaction date, and cylinder serial or other unique identifier when available. CO2 and O2 cylinders meeting these conditions qualify.

Within five (5) business days after each rental period, the Contractor shall provide the COR a monthly summary per delivery location (sub-account) showing: beginning balance; cylinders delivered by date; cylinders picked up by date; ending balance. The COR will verify against delivery slips and resolve discrepancies with the Contractor within five (5) business days.

Outside normal pickups/deliveries, no rental shall accrue on any cylinder five (5) business days

(excluding weekends and federal holidays) after SAVAHCS notifies the Contractor that cylinders are ready for pickup. The notification day is excluded. Verbal notifications will be documented by

SAVAHCS (date, time, Contractor representative).

7.3 Lost or Damaged Contractor-Owned Cylinders – Loss of Use (LOU)

For each contractor-owned cylinder lost or damaged beyond repair while in Government possession, the Government shall pay the replacement value less allocable rental paid; such cylinders become Government property.

To receive LOU payment, the Contractor shall submit an LOU quote to the Contracting Office;

LOU will be paid via a separate Purchase Order executed upon agreement by the CO and

Contractor. LOU cylinders shall be removed from the rental balance only after the separate PO has been issued and removed from rental inventory upon execution of the LOU agreement.

If a lost cylinder is located within 90 days after payment, it may be returned to the Contractor, and the Contractor shall credit/refund the Government the LOU amount paid, less rental computed per this SOW.

7.4 Installation and Removal of Contractor Equipment

Unless otherwise directed, contractor equipment shall be installed by the effective date of the contract. Where the Contractor’s equipment replaces equipment in use, installation shall be completed within ninety (90) days after notice of award without interruption of gas supply.

If the Contractor subcontracts to the vendor currently servicing the facility and no exchange applies, the Contractor is solely responsible for inventorying that equipment.

Contractor/subcontractor equipment remains Contractor property and shall be removed upon contract termination as directed, in cooperation with any successor, without interruption of gas supply.

To permit orderly transition, the Contractor shall continue to honor contract rental and gas pricing for up to ninety (90) days beyond contract expiration, prorating partial months, and continue to provide and maintain its equipment during that period.

Offerors are strongly encouraged to visit the site before quoting; site visits may be arranged through the COR.

SECTION 8. TRANSITION / IMPLEMENTATION

The Contractor shall provide an orientation meeting and training within twenty (20) business days of award for SAVAHCS (main campus, Research Service Line, and CBOC points of contact), covering delivery, ordering, account numbers, and Contractor points of contact.

If the awardee is not the incumbent, the incoming Contractor shall coordinate with VA and the incumbent during phase-in so there is no disruption of supplies. Outgoing Contractor cylinders shall be stored apart from incoming Contractor cylinders to prevent pickup by the wrong

Contractor.

SECTION 9. ORDERING PROCEDURES

9.1 Authorized Ordering Officials

Orders will be placed by the CO or authorized Ordering Officers (or COR/FPOC as authorized);

OOs are the primary ordering method.

The CO will furnish the names of OOs by letter within twenty (20) days of award and update the list as appointments change; COR names/contact info will be provided within twenty (20) days of award.

OOs may not negotiate or modify contract terms, determine price reasonableness, or determine best value.

The Contractor shall accept orders only from the CO or authorized OOs; fulfilling orders from anyone else may result in an unauthorized commitment.

9.2 Order Placement and Acknowledgement

Orders may be placed by email, telephone, or EDI using the CLIN structure of the awarded contract, on any day of the billing period.

The Contractor shall acknowledge receipt within two (2) hours of order placement.

Non-EDI orders shall use an agreed form (or standardized email) established by the Contractor and Government containing at minimum: date of order; Contractor name; contract number;

SAVAHCS location and account number; PO number; CLIN; item description; manufacturer part number (if applicable); quantity; unit price; total amount; place of delivery (building/room).

The Contractor shall maintain a separate account number for each SAVAHCS delivery location listed in Annex A.

For non-emergency orders, the Contractor shall confirm order entry electronically within twenty-four (24) hours; orders placed on Friday shall be confirmed the following Monday (or Tuesday if

Monday is a federal holiday).

9.3 EDI Orders (if used)

Fill/Call – Contractor calls the facility for a decision to backorder or cancel unfilled items.

Fill/Kill – unfilled items not shipped by the required date are cancelled unless a substitute was pre-approved.

EDI order confirmation within two (2) hours, listing for each line: PO number, CLIN, manufacturer part number, description, unit of purchase, quantity ordered/confirmed, backorder status and ETA, substitution approval (Y/N), unit and extended price, total order cost.

9.4 Substitutions

If a CLIN cannot be supplied, the Contractor may propose a substitute item on the contract by telephone to the COR or OO. VA will evaluate clinical acceptability; only the OO may authorize an on-contract substitution. Off-contract substitutes require a CO modification, or VA may purchase on the open market. Substitutes shall comply with all applicable regulations and not compromise patient care. Training on substitutes shall be provided on request at no charge.

9.5 Manual Ordering Capability

The Contractor shall designate email, phone, and (if applicable) fax points of contact for routine and emergency orders and shall be able to receive, manage, and fulfill manual orders during power outages, security events, or electronic system failures.

SECTION 10. DELIVERY REQUIREMENTS

10.1 Delivery Hours

Standard (non-emergency) deliveries Monday–Friday between 7:00 a.m. and 2:00 p.m. local

(Arizona) time, excluding federal holidays. Routine orders shall be accepted until 2:00 p.m. local time the business day before the required delivery date.

10.2 F.O.B. Destination / Pricing

All transportation charges are included in the gas unit prices. No separate delivery, hazmat, fuel surcharge, cylinder tracking, or similar fees may be billed. All transportation for empty government-owned and contractor-provided cylinders is at Contractor expense.

10.3 Delivery Slips/Tickets

Each delivery requires a legible signed (or electronic) delivery slip signed and dated by the driver and countersigned by the SAVAHCS representative. The driver and VA representative shall jointly count cylinders delivered and picked up and record both counts with the date and driver ID. Contractor-provided cylinder slips shall show: contract number, PO/delivery order number, location account number, order date, delivery date, CLIN(s), quantity ordered, items ordered but not delivered, number/type delivered, number/type picked up. GFE slips shall show:

GFE count prior to delivery, number delivered, number picked up, and any one-for-one discrepancy. The Contractor shall provide the COR electronic access to scanned delivery slips.

10.4 Backorders

The Contractor shall immediately notify the COR/designated POC of any backorder, with estimated lead time and market-shortage details, and provide weekly status updates until filled.

The Government may investigate the cause of a backorder. Cancellation of a backorder by the

Contractor is a failure to perform and may be grounds for adverse action.

SECTION 11. EMERGENCY SERVICE AND RESPONSE TIMES

11.1 Emergency Orders

SAVAHCS may, at its discretion, place emergency orders 24 hours a day, 7 days a week, including after business hours, weekends, and federal holidays. Emergency orders will be placed by an OO (or COR/FPOC as authorized) by telephone to a Contractor-designated 24/7 emergency number.

Emergent Response – An emergency request will be responded to within two (2) hours, confirming receipt and stating the time and location of expected delivery.

Emergent Delivery – Emergency deliveries will be made within four (4) hours from the time of

Contractor response.

Emergency status is determined by the Government. The Contractor’s failure to maintain the agreed delivery schedule does not constitute an emergency for purposes of charging an emergency delivery fee. Emergency deliveries will be billed under the Emergency Delivery CLIN only.

11.2 Missed Deliveries

Missed deliveries identified by the Contractor/subcontractor shall be reported to SAVAHCS

(COR/FPOC) within 24 hours.

Missed deliveries reported by SAVAHCS shall be delivered within 24 hours of notification.

11.3 Emergency Preparedness / Continuity of Supply

The Contractor shall maintain a written action plan and protocols to ensure continued performance during a declared National or State Emergency that may affect its ability to perform, and shall provide the plan to the CO upon request. If the plan is implemented, the

Contractor shall notify the CO and COR within 48 hours of the declared emergency.

SECTION 12. CYLINDER INVENTORY AUDITS

The VA and the Contractor shall perform a joint on-site inventory of all contractor-provided cylinders at the beginning of the contract and annually thereafter, within 45 calendar days of the end of each ordering period (contract /option period). SAVAHCS will coordinate scheduling and access; Contractor representative(s) shall participate on site until the audit is complete, and audits may be performed outside normal business hours. CBOC counts may be submitted by on-site VA personnel.

If more cylinders are found than on the most recent balance, the count shall be increased and become the beginning balance going forward; if fewer are found, the count shall be decreased and unaccounted cylinders handled as LOU per Section 7.3. Adjustments shall occur only after mutual validation of audit results.

The COR will sign only complete, mutually agreed audits. If discrepancies remain, the

Contractor shall return on a mutually agreed date to redo the audit; if not rescheduled within 90 days, the facility audit findings stand. An inventory report will be provided to the COR and CO.

SECTION 13. REPORTS AND TRACKING SYSTEM

The Contractor shall provide and maintain a tracking system accessible to the COR/designated

SAVAHCS staff that allows review of:

Countersigned delivery tickets

Past invoices

Mutually agreed audits

Current cylinder counts by location/account

SECTION 14. INVOICING

Invoices shall be submitted monthly in arrears electronically via the VA Tungsten Network

(https://portal.tungsten-network.com). No advance payments are authorized; rentals are invoiced monthly in arrears.

A proper invoice shall include: Contractor name and address; SAVAHCS location name/address and account number; invoice date and number; contract and PO number; CLIN(s); description, quantity, unit of measure, unit price and extended price; date of service and delivery receipts;

remit-to name and address; name, title, phone and email of the person to notify if the invoice is defective.

CLINs on the invoice shall match the CLINs, description, quantity and pricing on the PO.

Incorrect invoices will be short paid or rejected until corrected and resubmitted.

SECTION 15. PERSONNEL, CONDUCT, AND SECURITY

The Contractor shall designate in writing to the CO one representative as primary liaison with full authority for daily operations, invoice and delivery issue resolution, and coordination of annual audits. Within 20 days after contract start, the Contractor shall provide a contact list

(name, phone, email) of liaisons serving SAVAHCS.

Contractor employees shall conduct themselves professionally. Loudness, vulgarity, rudeness, or similar offensive conduct will be grounds for denying the employee further access to VA premises.

All contractor personnel shall wear identification (I.D.) badges at all times while at SAVAHCS facilities, including the main campus and all CBOCs. Badges shall include, at minimum, the employee’s picture, first and last name, and the contractor’s name.

Contractor personnel shall park in designated areas. Parking information is available from the

SAVAHCS VA Police Department, which will not invalidate or reimburse parking violations under any circumstance.

SECTION 16. PERFORMANCE MONITORING

Delivery timeliness, order accuracy, emergency response times, backorder notification, and compliance with purity, labeling, and cylinder requirements will be monitored by the COR/FPOC.

Repeated deficiencies may be elevated to the Contracting Officer for corrective action.
