1. Inspector qualifications. The SOW states inspections "will be conducted by degreed engineer." 40 CFR 112.3(d) requires PE certification of the SPCC Plan itself; routine monthly and quarterly inspections under 112.7(e) are performed by personnel trained in accordance with 112.7(f) and the facility's written inspection procedures. The California Aboveground Petroleum Storage Act likewise does not require an engineering degree for periodic visual inspections.
Please identify the regulatory basis for requiring a degreed engineer to perform routine visual inspections, or confirm that inspections may be performed by a qualified inspector trained per the site SPCC Plans, consistent with 40 CFR 112.
- The EPA does not mandate a rigid, one-size-fits-all federal certification or licenses for routine or periodic SPCC inspections. The SPCC (Spill Prevention Containment & Contingency rule is performance based relying on good engineering practices and industry standards.
Given the complexity and number of tanks and transformers at 3 facilities – based on past contractor performance, VA Safety requires a degreed engineer for these SPCC inspections as non-degreed inspector reports have not been satisfactory enough. Such a qualified individual has the knowledge and skill to diagnose the severity of deficiencies and recommend appropriate approaches for assessing source of leakage and which non-destructive testing procedures to affect appropriate repairs.
2. HAZWOPER requirement. The SOW requires 24-hour HAZWOPER certification per 29 CFR 1910.120(p)(8)(iii)(B), a provision applicable to emergency response personnel at hazardous waste treatment, storage, and disposal facilities. Visual inspection of in-service ASTs and transformers is not an operation covered by 1910.120.
Please identify the basis for this requirement or confirm it will be removed or revised.
- This requirement will be removed, however SPCC training for VA staff on SPCC plan requires an individual with detailed knowledge of SPCC plans and reporting in event of contingencies.
3. WLA transformer count. The SOW scope section states 36 transformers at WLA. Exhibit 1 lists 35 transformers for the North Campus and 18 for the South Campus, totaling 53.
Please confirm the governing count and equipment list for pricing purposes.

4. LAACC equipment count. The SOW states LAACC has "a total of 2 equipment items to be inspected," then lists one 5,000-gallon vaulted AST, a remote generator day tank, and two hydraulic elevator tanks.
Please confirm the complete LAACC equipment list.
- The equipment is all located in P2 underground garage level o 5000-gallon vaulted AST o Generator day tank o Hydraulic elevator tank
5. WLA hydraulic elevator tanks. Exhibit 1 lists "6-10 hydraulic elevator tanks (new)" at WLA.
Please provide the actual count and locations.
- These are for existing hydraulic elevators at West Los Angeles. These are building with elevators – some of the buildings will be taken out service for building renovation as determined by VA maintenance – or not readily accessible for inspection.

6. UST scope and regulatory regime. The scope paragraph references "ASTs, USTs, and transformers," and Exhibit 1 lists a UST at South Bldg. 501. Completely buried tanks are excluded from SPCC applicability under 40 CFR 112.1(d)(4) and are regulated under 40 CFR 280 and California's UST program, which carries separate inspector requirements.
Please confirm whether the Bldg. 501 UST is in scope, and if so, under which regulatory regime and inspection standard.
- Bldg. 501 USTs will be removed by end of fiscal year. Inspections apply to Bldg. 501 ASTs – three in number – 1 in service, 2 to be placed in service shortly.
7. Confined space entry. The SOW places confined space entry and testing responsibility on the contractor, and the LAACC AST is described as vaulted.
Please confirm whether monthly inspection of the vaulted AST, or any other listed equipment, requires permit-required confined space entry, so that entry teams and atmospheric monitoring can be priced accordingly.
- LAACC vaulted AST is located inside underground garage – does not require confined space for inspection
8. Audit support hours. The SOW states regulatory or internal audit support "may or may not occur one (1) or more times per year for up to 8-hours (minimum) or 16-hours (maximum)."
Please clarify the maximum annual hours of audit support included in the firm-fixed price, and whether occurrences beyond that ceiling will be handled by modification.
- LAFD and State Water Resources Board – the local regulatory authorities occasionally schedule inspections of tanks on an irregular basis on the behalf of Federal EPA. These inspections require assistance from contractor – as required as the contracted inspector may need to explain his past findings. These occurrences will be handled under the contract – firm fixed price. Each facility location is subject to such inspections – but frequency of inspections for all sites estimated no more than 16 hours.
9. Records retention. The SOW requires inspection records be retained "for at least 4 years" in one section and "for 3 years after submission" in another. 40 CFR 112.7(e) requires 3 years.
Please confirm the governing retention period.
- The governing retention period is VA Greater Los Angeles Safety office policy.
10. Stale equipment references. Exhibit 1 includes "North Side Bldg. 501 - 2 ASTs (to be service to by May 31, 2025)" and SACC "Bldg. 200 - 1 AST with companion day tanks (to be in service May 2026)," both dates now past.
Please confirm the current in-service status of these tanks and whether they are included in the monthly inspection population.
- West Los Angeles Medical Center o Two north side Bldg. 501 ASTs are about to be placed into service pending completion of electrical hook-up. Service date is now estimated on or about 9/30/26.
- Sepulveda Ambulatory Care Clinic o Bldg. 200 AST is about to be placed into service pending piping and electrical hook-ups. Service date is now estimated on or about 9/30/26
11. The scope appears primarily limited to routine visual SPCC inspections of ASTs, transformers, and associated equipment, along with recordkeeping and SPCC staff training. We do not see an anticipated requirement for contractor personnel to perform hazardous waste operations, cleanup activities, or emergency spill response.
Given the nature of the work, could the Government please confirm whether the 24-hour HAZWOPER certification and current 8-hour refresher are mandatory for personnel performing the inspections, or whether personnel with appropriate SPCC/environmental inspection qualifications may be considered acceptable without HAZWOPER certification?
- These Hazwoper certifications are not required for these inspections. However, such credentials and knowledge of SPCC requirements are needed for training VA Staff in basics of SPCC contingency response.
12. Certification timing. The SOW requires training certificates for assigned personnel "prior to award of contract."
Will the Government accept submission of certificates after award and prior to commencement of performance?
- The Government will request training certificates from selected offerors following primary selection but before final contract award. All required certificates must be submitted prior to award of the contract and must be current and valid at the time of submission.
13. Inspection hours. The SOW states all inspections will be completed 8:00 AM to 3:30 PM, while the Period of Performance section states normal hours of operation are 6:00 AM to 6:00
PM.
Please confirm the hours within which inspections may be scheduled.
- While the normal VA operational hours are 6:00 AM to 6:00 PM, the requesting department has specified that inspections must be conducted within their preferred hours of 8:00 AM to 3:30 PM. Accordingly, inspections may only be scheduled between 8:00 AM and 3:30 PM, as stated in the SOW.
14. Funding availability. Award will be made to the lowest-priced quote "that does not exceed the amount of funding available."
