Q&A 36C26226Q0230-Stryker ProCare Equipment Q1 – Limitations on Subcontracting (LOS) feasibility given Stryker-trained technician requirement The SOW states that repairs/maintenance/diagnostics must be performed by Stryker trained and certified field technicians (see SOW technician language, pp. 12–15). Please explain how an SDVOSB prime can comply with VAAR 852.219-75 Limitations on Subcontracting if performance is restricted to Stryker-trained/certified technicians and Stryker is not an SDVOSB.

ANSWER:

The Government acknowledges the requirement for Stryker-trained and certified technicians. Subcontractor will provide Program Management support including responsibility for contract performance, management and oversight; administrative support to include invoicing, collections and payment of vendors; and contracting the OEM-trained and certified technicians.

Q2 – Confirm LOS applicability and measurement period The solicitation requires offerors to sign VAAR 852.219-75 and indicates the LOS box for Services is checked (see VAAR 852.219-75 clause, p. 31). Please confirm that the services LOS requirement applies to this procurement and how LOS will be measured (end of base period, each option period, or other).

ANSWER:

Stryker and San Diego VA which ever SDVOSB is awarded the contract we will check the status of the contract to ensure certification is still valid at the end of base, option year.

Q3 – Define ‘amount paid’ basis for LOS calculation For LOS compliance under VAAR 852.219-75 / 13 CFR 125.6 (see VAAR 852.219-75, p. 31), what is the Government’s interpretation of the ‘amount paid by the Government to the prime’ for purposes of the 50% calculation: (a) total contract dollars, (b) labor dollars only, or (c) another basis?

ANSWER:

Payment made to SDVOSB in its entirety Q4 – OEM subcontracting and LOS enforcement The SOW requires OEM-trained and certified technicians to perform diagnostics and repairs (see SOW technician requirements, pp. 12–15). Please confirm whether the Government anticipates that the OEM (Stryker) will perform some or all repair/PM work as a subcontractor. If yes, please describe how an SDVOSB prime is expected to remain LOS compliant under this structure.

ANSWER:

Assumption is that since the SOW requires OEM-trained and certified technicians to perform diagnostics and repairs, and the OEM (Stryker) is a large business that Subcontractor, will provide Program Management support including responsibility for contract performance, management and oversight; administrative support to include invoicing, collections and payment of vendors, etc.

Q5 – Lease and service bundling clarification The pricing schedule separates equipment lease CLINs (Items 001, 1001, 2001, 3001, 4001) from service/repair CLINs (Items 002, 003, etc.) (see Price Schedule, pp. 47–51). Additionally, pages 52–53 include a distinct ‘ROM FMV 60 Month Lease’ valuation section. Please clarify: (a) whether the Government considers the principal purpose of this acquisition to be equipment leasing or maintenance/repair services; (b) how NAICS 339113 was determined to be appropriate; (c) how VAAR 852.219-75 LOS is intended to apply to the equipment lease portion; and (d) whether VA considered issuing separate lease and service procurements, and if not, how combining them does not unduly restrict competition, particularly for SDVOSB primes who cannot directly provide OEM leasing or proprietary service.

ANSWER:

(a) The principal purpose of this acquisition is to ensure continued operational readiness of Government-owned medical equipment through leasing and maintenance support.

(b) NAICS 339113 was selected based on market research and the nature of the equipment involved.

(c) LOS applies to the service portion of the contract.

(d) The Government determined that a combined procurement best meets mission requirements and does not unduly restrict competition.

Q6 – NAICS code rationale The solicitation assigns NAICS 339113 (manufacturing) (see SF-1449 cover page, p. 1), while the PSC and SOW are predominantly service-based. Please confirm the rationale for NAICS selection.

ANSWER: NAICS code 339113 was chosen based off the market research that was conducted by the source sought.

Q7 – Lease vs service LOS treatment Please clarify how equipment lease payments are treated for LOS purposes under VAAR 852.219-75 (see VAAR 852.219-75 clause, p. 31).

ANSWER:

All-inclusive Lease and Service on a monthly basis.

Q8 – Duplicate and repeating equipment schedule lines The equipment schedule contains repeating and duplicative line items across CLINs and option years (see Equipment Schedule, pp. 47–51 and ROM FMV section, pp. 52–53). Please clarify: (a) which equipment schedule is the authoritative list for pricing and performance obligations; (b) whether repeated entries represent distinct equipment, duplicate entries, or drafting errors; (c) whether VA intends to issue a corrected consolidated equipment schedule; and (d) how VA will handle pricing and performance responsibility if duplicates remain unresolved at time of award.

ANSWER:

Reference the Contractor Master Lease Proposal / Equipment Lease. There are no duplicate entries. No corrected equipment schedule needed (please reference Master Lease Proposal as that is the authoritative list. There are no duplicate entries.

Q9 – Acceptance of exchange / loaner equipment The SOW references replacement of unserviceable parts on an ‘exchange basis’ and provision of ‘loaner equipment’ (see SOW repair/exchange language, pp. 14–16), but does not clearly state whether clinical end users are required to accept exchange or loaner equipment as an operational substitute. Please clarify: (a) whether VA clinical end users will accept exchange or loaner equipment in lieu of waiting for repair and return of the original equipment; (b) whether acceptance of exchange equipment fully satisfies contractor performance obligations; and (d) whether any circumstances exist where end users may decline exchange equipment and how that affects performance metrics.

ANSWER:

(a) Exchange or loaner equipment may be used to maintain continuity of care.

(b) Acceptance of exchange equipment satisfies performance requirements when clinically appropriate.

(c) N/A

(d) End users may decline exchange equipment based on clinical need, which will be coordinated through the Contracting Officer.

Q10 – Define ‘factory trained and certified’ The SOW requires ‘factory trained and certified’ technicians (see SOW technician qualification language, pp. 12–15). Please clarify whether ‘factory trained and certified’ means: (a) Stryker employees only, (b) third-party technicians trained/certified by Stryker, or (c) another definition.

ANSWER:

“Factory trained and certified” refers to technicians who have successfully completed OEM-approved training and certification, including OEM-authorized third-party technicians.

Q11 – Subcontracted technician permissibility Please confirm whether subcontracted technicians are permitted to perform SOW-required diagnostics and repairs provided they meet training/certification requirements.

ANSWER:

Yes. Subcontracted technicians may perform required services provided they meet all training and certification requirements.

Q12 – OEM authorization Does VA require offerors to provide proof of OEM authorization to access manuals/diagnostics/parts? If so, please confirm acceptable documentation.

ANSWER: Yes, letter from Stryker that the vendor is an authorized reseller Q13 – OEM parts requirement Please clarify whether non-OEM parts are permitted if they meet or exceed OEM specifications or whether strictly OEM parts are required.

ANSWER:

Non OEM parts are not permitted.

Q14 – Experience requirement Please confirm whether experience on functionally equivalent non-Stryker equipment will be considered acceptable for the experience factor.

ANSWER:

The Government requirement is for Stryker-trained and certified technicians.

Q15 – Subcontractor experience credit Please confirm whether subcontractor experience may satisfy experience requirements if the SDVOSB prime has limited Stryker PM history.

ANSWER:

Yes. Subcontractor experience may be considered in the evaluation of experience, provided the prime demonstrates effective integration and management.

Q16 – Technical approach evaluation Please clarify how VA will determine whether a technical approach is acceptable versus unacceptable.

ANSWER: Please refer to the technical approach with the factors and if you can meet the Statement of Work.

Q17 – Past performance sources Please confirm whether non-CPARS references will be considered.

ANSWER: If this is saying if the vendor does not have a CPARS record, will they be considered, then the answer is yes. They will be considered satisfactory/neutral.

Q18 – Responsibility determination Please clarify whether a responsibility determination under FAR Subpart 9.1 will be conducted.

ANSWER: Please refer to FAR part 9.104-1 General Standards Q19 – Response-time standards Please define required response times for on-site service and restoration.

ANSWER:

Repairs / Loaners are 24hrs onsite services within 60 minutes.

Q20 – On-call coverage window Please define expected coverage hours and whether on-call requirements apply on federal holidays.

ANSWER:

Coverage hours are 6:30 AM to 3:00 PM Mon-Friday. Holidays excluded Q21 – Training deliverables Please clarify training frequency, format, and whether included in fixed pricing.

ANSWER:

Training requirements, frequency, and format are defined in the Statement of Work and are included in contract pricing unless otherwise stated.

Q22 – Equipment list authority Please confirm which equipment list governs pricing and performance obligations.

ANSWER:

The equipment list included in the final awarded contract governs pricing and performance obligations.

Q23 – Misuse/abuse exclusions Please clarify how misuse or abuse determinations will be made and by whom.

ANSWER:

Upon OEM inspection, abuse determination will be made.

Q24 – Solicitation number inconsistency Please confirm correct solicitation number given references to 36C26226Q0230_1 in submission instructions.

ASNWER: All documentation shall reference solicitation number 36C26226Q0230 and all documentation that requires a signature must be signed.

Q25 – ‘Two versions’ reference Please clarify what ‘two versions’ refers to and confirm offerors will be evaluated only against the final controlled solicitation.

ASNWER: Not sure what this question is referring to but if you mean _2 that does not refer to version. It is how the system numbers the same document.

Q26 – Unrelated subcontractor text Subcontractor instructions reference sleep apnea testing. Please confirm this is a drafting error and clarify required subcontractor information.

ANSWER: Sleep apnea was left in by mistake and should not be referred to and will be updated.

Q27 – Loaner requirements Please clarify required loaner response times, whether loaners must be identical OEM models, and whether loaner costs must be included in the fixed monthly price.

ANSWER:

24hrs and is included in the fixed monthly price and it will be identical model Q28 – Eight-hour exchange requirement Please clarify whether the eight-hour exchange requirement begins at notification, diagnosis, or part determination, and whether local stocking is required.
