About this file

This document contains an amendment to a request for proposals for in-home oxygen and ventilator services. The New Mexico VA Healthcare System seeks a contractor to provide oxygen and ventilator equipment, delivery, setup, instruction, and maintenance for VA beneficiaries. The amendment revises the pricing worksheet, adds a requirement for contractor compliance with VA Directive 1193 regarding COVID-19 vaccination of healthcare personnel, and answers additional questions from offerors. Key details include that approximately 50% of current patients use portable oxygen concentrators, the pricing worksheet has been updated, and compliance with the VA vaccination directive for healthcare workers is now required. The impending solicitation for these services is expected to be issued on or about August 10, 2021.

Sandra Fusco Amendment to the RFP:

Section B.3 PERFORMANCE WORK STATEMENT (PWS) is hereby amended to add paragraph 27 to the PWS as follows:

Para 27. COVID-19 Vaccination Program. Certain Contractor personnel performing work under this contract meet the definition of “Health Care Personnel” as that term is defined in VHA Directive 1193, Coronavirus Disease 2019 Vaccination Program for Veterans Health Administration (VHA) Health Care Personnel (HCP), dated August 13, 2021 (“VHA Directive 1193”). VHA Directive 1193 is attached as section D.5 of this contract, is incorporated by reference herein, and is made part of this contract. Contractor shall comply with the requirements of VHA Directive 1193 while performing work under this contract and Contractor shall ensure that all Contractor personnel performing work under this contract who meet the definition of Health Care Personnel (“HCP”), including Contractor’s subcontractor HCP, comply with the requirements applicable to HCP specified in VHA Directive 1193. HCP include Contractor personnel who, regardless of job title or duties performed, perform work at VHA facilities, as well as those whose duties put them in contact with VHA patients in their homes or outside VHA medical facilities. Contractor’s compliance with the requirements of this paragraph is necessary for the management and control of infectious disease. Contractor’s failure to comply, or failure to ensure that Contractor HCP comply, with the requirements of this paragraph shall be a material default of the contract. VA reserves the right to direct Contractor to immediately remove Contractor HCP from performing work under this contract if VA determines, at its sole discretion, that said Contractor HCP are not in compliance with VHA Directive 1193. Contractor shall timely replace Contractor HCP so removed with HCP who meet the requirements of VHA Directive 1193, at Contractor’s sole expense with no adjustment to contract price, in accordance with a replacement schedule Contractor shall submit to, and request approval by, the Contracting Officer.

Additional Questions and Answers Question 1 – Ref Amendment A0001, Q16. It appears, based on the pricing schedule, the NMVAHCS does not yet own their portable oxygen concentrator systems. It also appears the VA will gradually phase out contractor rental portable oxygen concentrator systems with government-owned portable oxygen concentrator systems. Please provide the VA's intended timeline on receiving all the government-owned portable oxygen concentrator systems. Additionally, how many patients on the current contract are prescribed a portable oxygen concentrator system (whether government-owned or contractor rental)?

The answer provided for question A16, Amendment 0001: The expectation is to have VA owned portable concentrators drop shipped to the contractor at the beginning of the contract and have them placed in the homes during the transition period at the beginning of the contract. Approximately 50% of the patients currently have portable oxygen concentrators.

Question: If the expectation is to have VA owned portable concentrators drop shipped to the contractor at the beginning of the contract and have them placed in the homes during the transition period at the beginning of the contract then the estimated quantities for POC rentals (line item 0006) are estimated much higher than it should be. Consider revising the estimated quantity for line item 0006 to coincide with the VA's expectation.

Answer to Question 1. Estimated quantities have been changed. See updated D.3 Price Worksheet.

Question 2 – Ref Amendment A0001, Q17. Page 34 of 81 states: "The Contractor shall perform the services as specified herein twenty-four (24) hours per day seven (7) days per week. Set-ups will normally be requested during normal business hours, however, after hours and weekend set-ups may be required." As it stands now, there is no line item for after hours and weekend set-ups. Can the Government add a line item for after hours and weekend set-ups?

The answer provided for question A17, Amendment 0001. No line item will be added.

Question: Since after hours and weekend set-ups may be required, there needs to be a line item for this service. Should no line item be added, then consider removing this requirement from the PWS.

Answer to Question 2. No line item will be added and the requirement will not be removed.

Question 3 – Ref Amendment A0001, Q18. Line item 0002 states: "Delivery, initial set-up, and education of Government owned portable oxygen concentrator system. Portable system for new set ups includes battery, handcart and/or pouch/backpack. Includes delivery, setup, and education. This is a one-time charge for new set-ups. HCPCS: A9901." And Line Item 0006 states: "Monthly Rental of portable oxygen concentrator system. Portable system includes flow meter, 2 rechargeable batteries, handcart, pouch/backpack and disposable supplies. HCPCS: E1392." Is it the intent of the NMVAHCS that the portable oxygen concentrator systems referenced in these 2 line items are used for portability? Or as the primary source of oxygen?

The answer provided for question A18, Amendment 0001. Both – primary and portability.

Question: May the Government please clarify the make/model of the Government Owned portable oxygen concentrators for primary use and portability?

Answer to Question 3. DeVilbiss iGo2 POC.

A correction to the previous answer, the POC’s will only be used for portability.
