Any staging area will only be allowed if the Contracting Officer’s Representative (COR) approves one and only if space is available. The Contractor must not park in any Patient Parking areas, without exception or authorization from the COR. NCHCS will not void, dismiss, or reimburse any parking citations or towing fees incurred by Contractor personnel under any circumstances.
D. The Contractor must remove and legally dispose of all materials, debris, and components demolished or replaced under this project. Disposal must follow all applicable Federal, State, local, and VA requirements. The Contractor will keep the site clean, prevent debris from accumulating, and transport all waste in a safe manner to approved disposal or recycling facilities. No debris may be stored in unauthorized areas or left on site once removal work is complete.
E. Schedule of work; the Contractor must perform all work during normal working hours, which are 7:30 AM(PT) to 4:00 PM(PT), Monday through Friday, excluding OPM officel Federal holidays(OPM. GOV,link: https://www.opm.gov/policy-data-oversight/pay-leave/federal-holidays/#url=Overview). Some activities, such as ACM abatement, work that blocks more than one exit route, or work requiring the temporary relocation of VA staff or furnishings cannot be performed during https://www.opm.gov/policy-data-oversight/pay-leave/federal-holidays/#url=Overview https://www.opm.gov/policy-data-oversight/pay-leave/federal-holidays/#url=Overview normal hours. F. If the Contractor needs to work outside normal hours, the Contractor must submit a written request to the VA Contracting Officer’s Representative (COR) and CO at least three (3) working days in advance. All after‑hours requests must include the proposed dates and times, the location, the type of work, justification, and any noise‑control or safety measures.
Written authorization from both the COR and CO is required before any after‑hours work may begin

H. The Contractor will utilize hydraulic and jacking systems to lift VA furniture in place so that Contractor’s work can be performed without interruption to VA operations. Contractor may submit a formal request for approval to the VA COR a minimum of three (3) working days in advance of the Contractor’s need for relocating VA furniture. However, approval is based on the Facility’s acceptance of the request and availability of space for furniture storage. The Contractor is responsible for the disassembly and reassembly, relocation, storage and security of VA owned furniture and equipment throughout this project.
I. ACM has been reported to exist in Building 209. Past asbestos reports from 1996 and 2017 are attached to this SOW for reference. 1.2 Platform Approval
Before use, the Contractor will submit the proposed electronic platform to the Contracting Officer’s Representative (COR) for review and approval via email. Approved platforms may include industry systems such as Procore or Autodesk. The platform must remain fully accessible to both the COR and Contracting Officer (CO) throughout the period of performance and per records requirements after completion as well as cited in the SOW and specifications.

The Contractor must ensure that all submittals and RFIs are transmitted exclusively through the approved platform and that all related documentation, logs, and tracking remain accurate and up to date. All RFIs must adhere to contract requirements, including numbering, supporting documentation, and identification of critical‑path RFIs when applicable. Any deviation from approved procedures may result in rejection of the submittal or RFI.
2. Meeting Minutes Requirements
2.1 Contractor Responsibility
The Contractor will draft complete and accurate meeting minutes for every project meeting conducted during the contract, including progress meetings, coordination meetings, and any meeting where project status, decisions, or direction are discussed.
2.2 Submission Timeline
Draft meeting minutes must be submitted to the COR for review and final approval no later than seven (7) calendar days after each meeting.
Meeting minutes are not considered official until the COR provides written concurrence.
2.3 Accuracy Standards and Review
The Contractor must ensure that all meeting minutes are factually accurate and fully reflect discussions, decisions, and action items from each meeting. While AI‑assisted drafting tools may be used, all AI‑generated content must be thoroughly reviewed and corrected by both the Contractor and COR approval received before submission and acceptance to avoid inaccuracies or misinterpretations. Official recording of meetings is not recommended and if done, must be approved by the VA ahead of time in writing and be in compliance with all federal and local VA policies and regulations, including permission received from all attendees in the meeting.
2. SCOPE OF WORK
A. The contractor will replace flooring, stair treads, and wall bases throughout three VANCHCS sites at their McClellan campus. There is approximately 43,008 SF of flooring, 750 SF of stair treads, and 9,610 LF of wall base to be replaced throughout McClellan buildings 98, 209 and 949, as shown in the attached Reference Drawings. These are a brief description of quantities and are estimates only and are provided for information and planning purposes. They do not represent guaranteed amounts, and the Contractor is fully responsible for verifying actual conditions and quantities before and during performance of the work.
B. Before any construction begins, the Contractor must have a certified asbestos inspector examine, sample, and test work areas in building 209 that they suspect to contain asbestos. The inspector will send all collected samples to an accredited laboratory for analysis. After testing is completed, the inspector will provide both the Contractor and the VA with a written report that identifies the location, type, and condition of all asbestos‑containing materials and includes a risk assessment describing the likelihood of disturbance during demolition or construction. The Contractor must use this report to develop a complete and safe asbestos‑abatement work plan.
C. The contractor will remove and install new accessories associated with the flooring including, but not limited to, subfloors, carpet tack strips, carpet padding, and vinyl/rubber adhesive.
D. The contractor must meet with the COR to discuss and outline phasing requirements for the project. These phasing requirements will describe the general sequence of the project work, estimated project duration, and what Government constraints will exist that will influence the Contractor’s approach to the construction project.
E. If the Contractor’s planned work alters existing egress routes, Contractor must submit a formal request to the COR for Interim Life Safety Measure (ILSM) approval at least three (3) working days in advance. Contractor’s ILSM request will detail the egress route affected, the start and completion dates, and the duration of the work hours affecting egress. ILSM approval is at the discretion of VA Safety officials.
F. VANCHCS administrative staff will be actively working throughout construction;
therefore, the Contractor must plan all work to maintain VA access to all areas of Buildings 98, 209, and 949. The Contractor will account for staff movement, ongoing operations, and any access needs while developing and executing the project schedule.
G. The Contractor will be responsible for the administration and management of all aspects of this SOW. This includes responsibility for all Contractor employees, Subcontractors, Agents, and anyone acting for or on behalf of the Contractor.
H. The Period of Performance for this project is 160 calendar days from the date the Government issues the Notice to Proceed (NTP).
I. Only the Contracting Officer (CO) is authorized to modify the contract. All change orders initiated by the contractor require the contractor to formally submit a request to the CO for their consideration. Performing work in addition to the contract without the CO agreeing to scope, price and schedule is not authorized.
J. Final Inspection, Punch List, and Acceptance; the Contractor must schedule the Final Inspection and acceptance of all contract deliverables and completed work at least forty‑eight (48) hours in advance of the requested inspection date.
During the Final Inspection, any outstanding deficiencies will be documented on a punch list by the COR and provided electronically to the Contractor. The Contractor must correct all punch‑list items and provide verification to the COR that corrective actions have been completed. For project acceptance, the Contractor must use the official Final Inspection and Acceptance Form provided by the COR, or, if proposing an alternate form, must obtain written approval from the COR prior to its use. Final acceptance will not occur, and no final payment will be processed, until the COR confirms that all punch‑list items have been resolved and all work, reports, documentation, warranty letters, and deliverables fully comply with contract requirements.

8. ADDITIONAL SBA INFORMATION:
mailto:Rosario.chaidez1@va.gov https://sam.gov/SAM/
(a) Eligibility of SDVOSBs continues to be governed by the Small Business Administration regulations, 13 CFR subparts 125.8 through 125.13, as well as the RFO, except where expressly directed otherwise by the VAAR, and 38 CFR verification regulations for SDVOSBs.
(b) At the time of submission of offer, the Quoter must represent to the contracting officer that it is a—
(1) SDVOSB concern
(2) Small business concern under the North American Industry Classification System
(NAICS) code assigned to the acquisition; and
(3) Offerors must be verified in the SBA Veteran Small Business Certification Program as an SDVOSB to be eligible for an award. The Contracting Officer (CO) will use the
SBA Small Business Search (SBA SBS) (https://search.certifications.sba.gov/) to verify SDVOSB status until further guidance is provided by the Department of
Veterans Affairs.
(c) A joint venture may be considered an SDVOSB or VOSB concern if
(1) At least one member of the joint venture is an SDVOSB or VOSB concern, and makes the representations in paragraph (b) of this section;
(2) Each other concern is small under the size standard corresponding to the NAICS code assigned to the procurement;
(3) The joint venture meets the requirements of paragraph 7 of the size standard explanation of affiliates in RFO 19.101; and
(4) The joint venture meets the requirements of 13 CFR 125.15(b), modified to include
Veteran-owned small businesses where this CFR section refers to SDVOSB concerns.
(d) Any SDVOSB or VOSB concern (nonmanufacturer) must meet the requirements in
RFO 19.103 to receive a benefit under this program.
9. VETS 4212:
Title 38, USC Section 4212(d), codified at 41 CFR Section 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at:
http://www.dol.gov/vets/vets4212.htm. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all vendors are encouraged to file every year. The
Contracting Officer may request a copy of the email confirmation of receipt notification, prior to awarding the project.
10. JOINT VENTURES: See 13 C.F.R. § 121.103(h)
(h) Affiliation based on joint ventures. A joint venture is an association of individuals and/or concerns with interests in any degree or proportion consorting to engage in and carry out no more than three specific or limited-purpose business ventures for joint profit over a two year period, for which purpose they combine their efforts, property, money, skill, or knowledge, but not on a continuing or permanent basis for conducting business generally.
This means that a specific joint venture entity generally may not be awarded more than three contracts over a two-year period, starting from the date of the award of the first contract, without the partners to the joint venture being deemed affiliated for all purposes. Once a joint venture receives one contract, SBA will determine compliance with the three awards in two years rule for future awards as of the date of initial offer including price.
https://search.certifications.sba.gov/ http://www.dol.gov/vets/vets4212.htm
As such, an individual joint venture may be awarded more than three contracts without SBA finding general affiliation between the joint venture partners where the joint venture had received two or fewer contracts as of the date it submitted one or more additional offers which thereafter result in one or more additional contract awards. The same two (or more) entities may create additional joint ventures, and each new joint venture entity may be awarded up to three contracts in accordance with this section. At some point, however, such a longstanding inter-relationship or contractual dependence between the same joint venture partners will lead to a finding of general affiliation between and among them.
For purposes of this provision and in order to facilitate tracking of the number of contract awards made to a joint venture, a joint venture must be in writing and must do business under its own name, and it may (but need not) be in the form of a separate legal entity, and if it is a separate legal entity it may (but need not) be populated (i.e., have its own separate employees). SBA may also determine that the relationship between a prime contractor and its subcontractor is a joint venture, and that affiliation between the two exists, pursuant to paragraph (h)(4) of this section.
11. NOTICE TO PROCEED (NTP): A notice to proceed (NTP) must be issued after award of a fully executed contract. The NTP date and time are “to be determined” after award to a successful offeror. Primary factor in determination to issue NTP must be the Prime Contractor submission of, and the Government review and approval of both Payment and Performance
Bonds, both of which are enforceable legal documents.
12 . SECURITY REQUIREMENTS (GENERAL):
1. All personnel employed by the contractor in the performance of work, issued under this contract, or any representative of the contractor must abide by all security instructions and directives of the Department of Veterans Affairs. Employees are responsible for safeguarding all government property provided for contractor use.
2. At the close for each work period, government facilities, equipment and materials must be secured, lights, and all doors and window secured.
3. The contractor and, as applicable, subcontractor must not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being or operational mission of the station/campus and its population, nor must the contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified during background checks.
4. Contractors must ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Employees and subcontractors later found to be undocumented or illegal aliens will be remanded to the proper authorities.
5. Contractor Badge Policies: All requests for contractor ID badges will be submitted through the station COR, and Police/Security office.
6. Vehicle registration, proof of insurance and a valid driver’s license must be presented for all vehicles while operating on the station/campus. All vehicles entering the station/campus are subject to search. Any refusal or non-consent by an employee will result in termination of their access and immediate confiscation of their ID badge.
13. BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS:
All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform the statement of work is: Low
Risk. This requirement is applicable to all subcontractor personnel requiring the same access. As per VA Directive 0710, costs of background investigations will be borne by the contractor.
