Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold

1. Contracting Activity: Department of Veterans Affairs (VA), Network Contracting

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This purchase is part of the VA Martinez Clinic Operating

Room (OR) instrument replacement, prompted by damage to existing instruments and the subsequent temporary shutdown of the operating room, resulting in halted operations. For the sake of expediency and efficiency, the agency replaced the instruments available through the existing Medical-Surgical Prime Vendor Program contract with Medline. However, not all required items were included under that contract. To assemble complete, compatible kits, the clinic is seeking to purchase the remaining items from the same manufacturer to ensure compatibility and consistency in surgical instrument trays and sets as well as surgical instrument cleaning and maintenance.

The estimated cost for this requirement is $57,919.98.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Department of Veterans Affairs, Northern California Health Care System, Martinez VA Medical Center has an urgent need to replace sterile surgical instruments that have been rendered defective and unsuitable for surgical use. Across the Northern California Healthcare System, the sterile processing service maintains Medline surgical instrument trays and sets that can be utilized across multiple clinics to ensure there are no delays to patient care. Currently, there aren’t sufficient Medline surgical instrument sets and trays to support each clinic and the amount of operations that need to be performed, which is creating a strain on the sterile processing service. Relying on a limited number of surgical instruments across a broad service area and large geographic region is not a sustainable long-term solution. Failure to fulfill this request may lead to surgery cancellations due to the unavailability of essential instruments. To assemble complete, compatible kits, the clinic requires the remaining items from the same manufacturer, Medline Industries, to ensure compatibility and consistency in

4. Description of market research conducted and results or statement why it was not conducted: The applicable NAICS code for this requirement is 339112, with the Small Business Administration (SBA) size standard of 1,000 employees. A review of the U.S. SBA Nonmanufacturer Rule Class Waiver Database, updated as of June 2022 and queried on August 5, 2026, confirmed that no waiver exists. Additionally, a search of the SBA Dynamic Small Business Search (DSBS) database under NAICS code 339112 identified 981 Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and Veteran-Owned Small Businesses (VOSB). Market research included a review of Medline surgical instrument and tray searches on GSA, SAM.gov, ADDS UP, and FPDS did not identify SDVOSB, VOSB, and Small Business capable vendors that can provide the required branded surgical trays and instruments to complete the surgical sets. Market research also included a SAM.gov, ADDS UP, and FPDS search for Medline trays, Medline surgical, and Medline product #s for Medline distributors and suppliers but could not identify any additional available sources or vendors. Market research has determined that Medline Industries, a large business, is the sole source capable of providing the required surgical instruments. As a result, it is recommended to proceed with a sole-source procurement to Medline Industries, as they are anticipated to submit a fair and reasonable quote to the government.
