1. Contracting Activity: Department of Veterans Affairs, Regional Procurement

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This action is for a sole source XTRAC Excimer Laser, IAW FAR 12.102 Acquisition of Commercial Products and Commercial Services, where acquisitions conducted are exempt from the requirements of FAR Part 6, but still requires a justification using the format of FAR 6.303-2. The excimer laser uses a highly targeted beam of therapeutic UVB light to treat affected skin areas without damaging surrounding healthy skin. This laser produces a monochromatic utilized for psoriasis treatment.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The XTRAC Excimer laser is the only FDA approved 308 nm laser for the treatment of psoriasis, eczema, vitiligo, cutaneous skin lymphoma and other skin conditions. It is the only 308nm laser available on the market and only laser that has the wave length breadth of coverage to treat these conditions. XTRAC therapy is a safe treatment option which uses a specific wavelength of UVB light (308 nanometers) to treat only the affected skin. It is much safer than phototherapy which exposes the entire body to ultraviolet rays.
XTRAC does not cause any side effects common in other treatments for veteran patients; steroids causes risk of stretch marks and medications have the risk of birth defects, liver damage, and increased risk of infections.

4. Description of market research conducted and results or statement why it was not conducted: The CO reviewed: GSA Advantage, GSA eLibrary, the SCMC, the NAC, ADDs UP, USA Spending, and SAM.gov. A posted JOFOC was found on SAM.gov, under AP 36C256-22-AP-2030. A letter was received from the Original Equipment Manufacturer (OEM), STRATA Skin Sciences Inc, stating that there were no authorized distributors.
The CO had difficulty distinguishing between the different types of Excimer lasers and whether they were used for treatment of psoriasis (though further research suggests that the typical use of excimer lasers medically are for eye surgeries). The CO believes that the subject STRATA laser is the only item on market FDA approved for psoriasis treatment.
SBA.gov was reviewed utilizing NAICS code 334510: 446 Service Disabled Veteran Owned Small Businesses (SDVOSBs) and 471 Veteran Owned Small Businesses (VOSBs) were found respectively.
GSA Advantage and GSA eLibrary were reviewed, with no significant results found.
The SCMC was reviewed, with no significant results found.
The NAC was reviewed, with no significant results found.
SAM.gov was reviewed, where 36C24222Q0690 was found, a notice of intent to sole source to STRATA Skin Sciences for an Excimer laser. Additionally, a justification for sole source to the OEM for an Excimer laser was found under ID 36C25622Q0713; which stated that STRATA Skin sciences was the only known manufacturer of Excimer lasers for patented treatment of psoriasis with FDA approval.
A letter was included in the initial package submission from the OEM. The letter is dated 01/02/2024 and states that the OEM, STRATA Skin Sciences Inc, is the only provider of its XTRAC Excimer laser systems, with no distributors.
ADDs UP and USA Spending were reviewed. The CO found the following recent awards:
NNG15SD22B 36C26026F0136 was found awarded to in the amount of for a Philips Nexcimer Laser System on 01/06/2026. This system appears to be utilized for Coronary surgeries.
36C25622P0911 was found awarded to in the amount of for a XTRAC Velocity Excimer laser on 05/13/2026.
