BASIS FOR AWARD
1. INTRODUCTION
a. This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) Part 15, Contracting by Negotiation, supplemented by the Department of Veterans Affairs Acquisition Regulation (VAAR). These regulations are available electronically at https://www.acquisition.gov/ and https://www.va.gov/oal/library/vaar/
b. The Government intends to award a firm fixed price (FFP) contract to the technically acceptable offer, with the lowest evaluated fair and reasonable price, which is responsible in accordance with FAR 9.104 received in response to this solicitation.
c. Offers are cautioned that the Government intends to award without discussions based solely on initial offers received. Therefore, each initial offer received should be submitted on the most favorable terms from both a price and a technical standpoint. If, during the evaluations it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.
d. Only one award will be made in response to the solicitation.
2. EVALUATION PROCESS. Offers will be evaluated as follows:
a. Step 1: All offers will be evaluated for adherence to the solicitation requirements. (Failure to provide all necessary and required documents will make the offer ineligible to be ranked based on the lowest price)
b. Step 2: All offers adhering to the requirements of the solicitation will be evaluated for technical acceptability. To be considered technically acceptable the offer must be rated technically acceptable for each technical sub-factor (Phasing Plan Schedule, Representation of Limitation on Subcontracting requirements, and Safety & Environmental Record and EMR).
c. Step 3: All technically acceptable offers will then be ranked by price with the lowest price ranked first.
d. Step 4: The Government will evaluate the lowest price offer to determine if the price is fair and reasonable for the work to be performed and not materially unbalanced at the line item or total contract level.
e. Step 5: If the responsive lowest price technically acceptable offer is determined fair and reasonable for the work to be performed and not materially unbalanced, the Government will evaluate the offer for responsibility in accordance with FAR Part 9.104.
f. Step 6: If the responsive lowest price technically acceptable offer is fair and reasonable and responsible under FAR 9.104, award will be made to that offeror.
g. Step 7: If not, the Government will evaluate the next lowest evaluated price offeror adhering to the requirements of the solicitation, repeating steps 4-6 until a responsive, responsible technically acceptable lowest evaluated fair and reasonable priced offer is identified. The Government intends to award without discussions. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
3. EVALUATION FACTORS AND SUB-FACTORS
a. Factor #1 – Technical (Acceptable/Unacceptable): Proposals will be evaluated against the following technical sub-factors. For the technical factor to be considered technically acceptable, the offer must be rated technically acceptable in sub-factors 1A, 1B and 1C.
i. Evaluation Sub-Factor 1A: Phasing Plan Schedule:
The contract documents provide a five-phased plan for completing the work required for this project. Offerors shall provide a basic project schedule with major milestones for execution of the phased plan suggested in the solicitation documents. The schedule shall show all five phases complete within 300 calendar days.
ii. Evaluation Factor 1B: Representation of how meeting Limitation on Subcontracting Requirements:
Provide documentation of how the offeror will meet the limitations on subcontracting requirements. This project is being solicited using NAICS 237110 Water and Sewer Line and Related Structures Construction. This is a specialty NAICS code and this solicitation is being set aside to Service-Disabled Veteran Owned Small Business concerns. In accordance with 13 CFR 125.6 “no more than 75% of the amount paid by the government to the prime may be paid to firms that are not similarly situated.” The offeror shall show how 25% of labor costs will be paid to the prime SDVOSB concern and/or other SDVOSB subcontractors.
Offerors may utilize the pricing schedule included in the solicitation to show how the limitations on subcontracting will be met by highlighted the labor costs that will be paid to Service Disabled Veteran Owned Small Business concerns.
iii. Evaluation Factor 1C: Contractor Certification regarding Safety and Environmental:
PER VHA DIRECTIVE 7715 (06 April 2017): SAFETY & ENVIRONMENTAL RECORD AND EXPERIENCE MODIFICATION RATE (EMR): To be eligible for consideration and award, the contractor shall have no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years and have an EMR of equal to or less than 1.0. (VHA Directive 7715 attached) All Bidders shall submit the following information pertaining to their past Safety & Environmental Record and EMR with their bid/proposal:

2. EMR: All bidders shall submit information regarding their current EMR. This information shall be obtained from the bidder’s insurance carrier and be furnished on the insurance carrier’s letterhead.
Company’s Current Insurance Experience Modification Rate (EMR) = ____________ (Note: Contractor must support the EMR with a signed letter from Insurance Carrier on their letterhead.)
b. Factor #2 - Price The Government will evaluate the lowest price offer to determine if the price is fair and reasonable for the work to be performed through the use of price analysis. To be considered fair and reasonable for the work performed, the evaluators will also check for appearance of unbalanced line item prices. If deemed necessary, the pricing schedule information will be used to assist the Government in performing the price evaluation described above. Offers which are materially unbalanced as to prices for the basic requirement and the option quantities are not fair and reasonable. An Offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
The pricing schedule is a requirement of the Price Factor. The offer must have a completed pricing schedule included to be considered responsive. The price schedule may also be used by the offeror to meet the requirements of Evaluation Factor 1B.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.
(End of Provision)
2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:
Goals for minority participation for each trade
Goals for female participation for each trade
25.6 %
6.9 %
These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
