BASIS FOR AWARD

1. INTRODUCTION

a. This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) Part 15, Contracting by Negotiation, supplemented by the Department of Veterans Affairs Acquisition Regulation (VAAR). These regulations are available electronically at http://farsite.hill.af.mil and https://www.va.gov/oal/library/vaar/

b. The Government intends to award a firm fixed price (FFP) contract to the technically acceptable offer, with the lowest evaluated fair and reasonable price, which is responsible in accordance with FAR 9.104 received in response to this solicitation.

c. Offers are cautioned that the Government intends to award without discussions based solely on initial offers received. Therefore, each initial offer received should be submitted on the most favorable terms from both a price and a technical standpoint. If, during the evaluations it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.

d. Only one award will be made in response to the solicitation.

2. EVALUATION PROCESS. Offers will be evaluated as follows:

a. Step 1: All offers will be evaluated for responsiveness to the solicitation requirements.

b. Step 2: All responsive offers will be ranked by price, with the lowest evaluated price offer first.

c. Step 3: The responsive lowest price offer will be evaluated for technical acceptability. To be considered technically acceptable the offer must be rated technically acceptable for each technical sub-factor (Key Personnel Experience and Prime Construction Management Previous Experience).

d. Step 4: If the responsive lowest evaluated priced offer is determined technically acceptable, the Government will evaluate the offer to determine if the price is fair and reasonable for the work to be performed and not materially unbalanced at the line item or total contract level.

e. Step 5: If the responsive lowest price technically acceptable offer is determined fair and reasonable for the work to be performed and not materially unbalanced, the Government will evaluate the offer for responsibility in accordance with FAR Part 9.104.

f. Step 6: If the responsive lowest price technically acceptable offer is fair and reasonable and responsible under FAR 9.104, award will be made to that offeror.

g. Step 7: If not, the Government will evaluate the next lowest evaluated price offeror, repeat steps 2-6 until a responsive, responsible technically acceptable lowest evaluated fair and reasonable priced offer is identified.

3. EVALUATION FACTORS AND SUB-FACTORS

a. Factor #1 – Technical (Acceptable/Unacceptable): Proposals will be evaluated against the following technical sub-factors. For the technical factor to be considered technically acceptable, the offer must be rated technically acceptable in sub-factors 1A and 1B.

i. Evaluation Sub-Factor 1A: Key Personnel Experience; in order for a technical offer to be rated acceptable for 1A, all four listed below must be rated acceptable.

1. Superintendent:

1) Detailed resume

2) Letter of Intent

3) Minimum of three (3) years of experience as a Construction Superintendent

4) Superintendent on a minimum of two (2) projects of similar scope and complexity

2. Project Manager:

1) Detailed resume

2) Letter of Intent

3) Minimum of three (3) years of experience as a Contraction Project Manager

4) Project Manager on a minimum of two (2) projects of similar scope and complexity

3. Safety Manager

1) Detailed resume

2) Letter of Intent

3) Minimum of three (3) years of experience as a Safety Manager

4) Safety Manager on a minimum of two (2) projects of similar scope and complexity

4. Quality Control Manager

1) Detailed resume

2) Letter of Intent

3) Minimum of three (3) years of experience as a Quality Control Manager

4) Quality Control Manager on a minimum of two (2) projects of similar scope and complexity

ii. Evaluation Sub-Factor 1B: Prime Construction Management Previous Experience:

Minimum of two (2) projects completed within the preceding five (5) years similar in magnitude and complexity to this project.

b. Factor #2 - Price The Government will evaluate the lowest price offer to determine if the price is fair and reasonable for the work to be performed through the use of price analysis. To be considered fair and reasonable for the work performed, the evaluators will also check for appearance of unbalanced line item prices. If deemed necessary, the supplemental price breakdown information will be used to assist the Government in performing the price evaluation described above. Offers which are materially unbalanced as to prices for the basic requirement and the option quantities are not fair and reasonable. An Offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

Compliance with the goals will be measured against the total work hours performed.

(d) Alternate offers.

(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
