About this file
This is Amendment 0003 to Solicitation 36C26026Q0852, issued by the Department of Veterans Affairs Network Contracting Office 20. The amendment extends the offer receipt deadline to August 31, 2026 at 1:00 PM MDT and makes three substantive changes to the solicitation: a correction to the Technical or Quality Evaluation clause (52.212-2(b)(2)), a revision to the Period of Performance, and responses to 21 vendor questions received during the solicitation period.
The corrected evaluation criterion now specifies that offerors must provide authorization letters or documentation from the University of California - San Francisco for the use of algorithms, code, and graphics owned by the creators of My Birth Control at UCSF. The services involve maintenance and support for the MyPath and MyPath Postpartum tools, which are reproductive health decision-support applications currently hosted on AWS via Heroku using a Ruby on Rails/React/PostgreSQL technology stack. VA owns the source code except for the birth control modules, which are UCSF-owned and licensed to VA. The Period of Performance is revised to consist of a one-year base period beginning on the award date (anticipated September 2026), followed by two optional one-year periods. Cloud hosting must be FedRAMP certified. Task 2 includes a 320-hour miscellaneous pool exercisable across contract years without guaranteed annual minimums, authorized in writing by the Contracting Officer. All products must be 508 compliant. Monthly invoicing is required. The Contracting Officer's Representative is Barbara Majerczyk, and standing meetings are not expected. Current website traffic is approximately 500 users per month.

A.1 QUESTIONS AND ANSWERS SOLICITATION 36C26026Q0852
1) Question: Section E.5 states that offerors must provide an authorization letter or other documentation from Nitid Bit, LLC to perform maintenance and support services for the existing proprietary system. Is a direct authorization letter from Nitid Bit, LLC an absolute requirement for technical acceptability, or would the VA accept other documentation demonstrating that the selected contractor will receive sufficient legal and technical access to maintain and modernize the system?
Answer: Offerors shall provide an authorization letter or other documentation from the University of California - San Francisco for the use of algorithm, code, graphics owned by creators of My Birth Control at University of California-San Franciso. See answers to questions below regarding ownership.
2) Question: Will the VA provide the awarded contractor with access to the existing MyPath and MyPath Postpartum source code, hosting environment, analytics infrastructure, technical documentation, design assets, databases, deployment procedures, and other materials necessary to perform the Statement of Work?
Answer: VA owns MyPath and MyPath Postpartum source code and graphics, except for the birth control modules of these tools (including the decision-support algorithm and related code), which are owned by the creators of the My Birth Control tool and the University of California-San Francisco (UCSF) and licensed by VA for use in the MyPath and MyPath Postpartum tools. VA can facilitate transfer of all assets that are owned by VA to the awarded contractor. A vendor must obtain authorization from UCSF for use of any code or software components derived from the My Birth Control tool.
3) Question: Could the VA clarify its current ownership, licensing, and data rights regarding the MyPath source code, algorithms, graphics, user-interface designs, documentation, analytics infrastructure, and other assets developed under previous VA contracts?
Answer: VA owns MyPath and MyPath Postpartum source code, graphics, user-interface, and analytics data. The graphics, user-interface, and decision-support algorithm embedded within the birth control modules of these tools is owned by the creators of the My Birth Control tool and the University of California-San Francisco and licensed by VA for use in the MyPath and MyPath Postpartum tools.
4) Question: Under Task 2.4, would the VA consider a substantial re-platforming or reconstruction of the existing MyPath applications using a modern software architecture, provided that the medically reviewed content, decision-support functionality, privacy protections, analytics requirements, and essential user experience are preserved?
Answer: Yes
5) Question: If continued maintenance of the current proprietary code base requires authorization that may not be available to other small businesses, would the VA consider an approach in which the required functionality is recreated and modernized in a new code base controlled by the VA?
Answer: Aside from the birth control modules embedded within MyPath and MyPath Postpartum (algorithm, code, graphics owned by creators of My Birth Control at University of California-San Franciso), VA owns the code base of MyPath and MyPath Postpartum. The VA would consider this approach; however, MyPath and MyPath Postpartum are currently (actively) in use by numerous VA health care systems and VA will prioritize maintaining continuous, ongoing access to the tools for VA users.
6) Question: If a complete reconstruction or replacement platform is outside the scope of the current solicitation, would the VA consider a separate future acquisition for the development of a modern, VA-controlled replacement platform?
Answer: Future acquisitions will be determined based on the needs of the Government
7) Question: If authorization from Nitid Bit, LLC remains mandatory, will the VA facilitate coordination between prospective offerors and Nitid Bit, LLC, or must each offeror independently obtain the required authorization before the quotation deadline?
Answer: Offerors shall provide an authorization letter or other documentation from the University of California - San Francisco for the use of algorithm, code, graphics owned by
8) Question: Could you confirm whether the RFQ attachment includes details on the current MyPath technology stack and hosting environment?
Answer: The current RFQ does not include these details. The MyPath websites are currently hosted using AWS via Heroku. The application stack is:
• Server-side: Ruby on Rails
• Front-end: React
• Database: PostgreSQL
9) Question: The Statement of Work in §D.1 identifies Nitid Bit, LLC as the original developer and prior maintenance vendor under Contract Nos. 36C26018P3544 and 36C26021D0028.
Is Nitid Bit, LLC the current incumbent maintenance vendor at the time of this solicitation, and if so, what is the exact end date of the current period of performance? If a transition is required, is a specific transition period or knowledge-transfer duration contemplated by the Government?
Answer: Nitid Bit, LLC is not currently under contract with the VA for maintenance of the MyPath and MyPath Postpartum tools; however, Nitid Bit, LLC currently maintains and hosts the tools with support from non-VA funding sources. No specific transition period or knowledge-transfer duration has been contemplated at this time.
10) Question: In the event a successor vendor other than the current incumbent is awarded this contract, will the Government require or facilitate the transfer of source code, hosting infrastructure, DNS records, analytics database contents, per-implementation-site URL configurations, email server, and other OEM-owned assets to the successor? Or is the vendor expected to obtain such continuity solely through commercial arrangements with Nitid Bit, LLC as authorized OEM?
Answer: The VA will facilitate the transfer of source code and other assets to the successor.
This process should not require separate commercial arrangement(s). The vendor will, however, need authorization to conduct maintenance and support for the MyPath tools from the University of California-San Francisco, which owns the birth control decision-support content and code included within the MyPath and MyPath Postpartum tools.
11) Question: Section D.1 states that Certification and Accreditation requirements do not apply and that the vendor will not have access to VA sensitive or protected information. However, VAAR 852.239-71 (Information System Security Plan and Accreditation) is listed in §E.4 as an incorporated provision. Please confirm whether VAAR 852.239-71 imposes any Information System Security Plan submission or approval requirements on the vendor’s hosting environment for this contract.
Answer: As prescribed in VAAR 839.106-70 (a), the clause at 852.239-71, Information System Security Plan and Accreditation (and 839.239-70, Security Requirements for Information Technology Resources), shall be included in all solicitations, contracts, and orders exceeding the micro-purchase threshold that include information technology services.
All offers submitted in response to this solicitation shall comply with the requirements outlined in the solicitation to include all clauses and provisions.
The C&A language included in the SOW applies specifically to scenarios where contractor-owned equipment is connected to the VA network. Per Item 6 of the VA 6500.6 Security Checklist instructions, this language should be included in the SOW.
In the case of this contract, the contractor will not connect any contractor-owned equipment to a VA internal trusted network.
12) Question: Does the Government have a required or preferred cloud hosting platform, region, or FedRAMP authorization baseline (e.g., FedRAMP Moderate) for Task 1.2 hosting of the MyPath®, MyPath Postpartum®, and Dissemination Page properties and their analytics infrastructure? If yes, please identify the required baseline; if not, please confirm the vendor may propose an equivalent commercial cloud solution meeting the SOW privacy and continuity requirements.
Answer: Yes, the cloud hosting platform shall be FedRAMP certified.
13) Question: The Section B.2 Price/Cost Schedule establishes the Task 2 MISC line item as a
320-hour pool exercisable in part or in full during any contract year based on need and completion of Tasks 1.1–1.2. Please confirm the following: (a) there is no guaranteed minimum draw-down of the MISC pool in any given contract year; (b) unexercised MISC hours from any year remain available in subsequent years within the total 320-hour ceiling;
and (c) MISC work orders will be authorized in writing by the Contracting Officer.
Answer: Yes – Tasks 2.1-2.4 can be executed in any contract year. If not executed in a given contract year, they could still be executed in subsequent years. They will be authorized in writing by the Contracting Officer.
14) Question: Section E.4 incorporates VAAR 852.239-75 (Information and Communication
Technology Accessibility). Please confirm whether the Government requires the vendor to submit a Voluntary Product Accessibility Template (VPAT) or Accessibility Conformance Report (ACR) for the MyPath® tools during the base year, and whether Task 2.3 and Task
2.4 upgrade deliverables require separate accessibility conformance testing and reporting.
Answer: All products are mandatorily required to be 508 compliant.
15) Question: Will the Contracting Officer’s Representative for this contract be Dr. Lisa
Callegari, Barbara Majerczyk (identified in the Delivery Schedule and SOW), or another designee? Please also confirm the Government’s expectation for standing meetings and written status reporting cadence.
Answer: The Contracting Officer’s Representative will be Barbara Majerczyk. The contractor will be expected to be available for ad hoc meetings as needed to complete the project. Standing meetings are not expected.
16) Question: Is a signed letter from Nitid Bit specifically authorizing Markel Strategic Holdings
LLC to quote and provide the required MyPath maintenance and support sufficient evidence of OEM authorization?
Answer: Offerors shall provide an authorization letter or other documentation from the University of California - San Francisco for the use of algorithm, code, graphics owned by
17) Question: Should pricing be structured as one annual payment for each performance period, or are monthly invoices required?
Answer: Monthly invoices are required (see Section B.1, Contract Administration, No. 3 Invoices. Offer pricing should be structured as laid out in Section B.2, Price/Cost Schedule.
18) Question: May an offeror rely on the OEM/subcontractor’s directly relevant past performance when the prime contractor is a newly established federal contractor?
Answer: Past performance will be evaluated in accordance with Section E.5 of the solicitation.
19) Question: Is all required support expected to be remote, or should the quotation include any onsite support, travel, or training?
Answer: We do not anticipate that onsite support, travel, or training will be necessary.
20) Question: Are there any amendments, question-and-answer documents, or updated submission instructions that must be acknowledged beyond the files currently posted?
Answer: Any solicitation amendments will be posted to SAM.gov. Please monitor SAM.gov for amendments. Amendments must be acknowledged as required in instructions on any amendment posted and in accordance with guidelines laid out in the solicitation. Please monitor SAM.gov for all solicitation documentation.
21) Question: Potential number of users: Section D.1, “Scope,” on page 16 discusses tracking the number of users accessing the MyPath tools; however, the solicitation does not provide an estimated number of users. Please confirm whether an estimated user volume is available.
Answer: Anticipated website volume depends on how much the tools are utilized and implemented within clinical care contexts across VA in coming years. Currently, we see approximately 500 users per month to the VA instances of MyPath and MyPath Postpartum.
A.2 Correction to 52.212-2(b)(2), Technical or Quality Evaluation
52.212-2(b)(2), Technical or Quality Evaluation previously stated:
This is now corrected to read:
(2) Technical or Quality: The quotation will be evaluated to the extent to which it can meet and/or exceed the Government’s requirements as outlined in the solicitation to include technical capability and based on the information requested in the instructions to quoters section of the solicitation. Vendor’s quoted proposal shall conform to the Statement of Work listed in Section D.1.
Offerors shall provide an authorization letter or other documents from the University of California
- San Francisco for the use of algorithm, code, graphics owned by creators of My Birth Control at University of California-San Franciso at the time of offer to provide maintenance and support services for existing, proprietary equipment/system. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
The government will evaluate in accordance with the Statement of Work/Solicitation based on information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
Failure to meet a requirement may result in an offer being determined technically unsuitable.
Offers received that do not comply with the terms and conditions of the solicitation and/or have missing documentation may be considered non-compliant and may be removed from evaluation.
