B.2 PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT

1) CONTRACT TITLE: Security Guard Services for the VA Puget Sound CBOC’s and CRRC

2) BACKGROUND: The Department of Veterans Affairs (VHA), Puget Sound Healthcare System, Police Service has a requirement to provide contract security unarmed guard services at seven VA Puget Sound Community Based Outpatient Clinics (CBOC) and one Community and Resource Referral Center (CRRC). This will aid in providing a safe and secure environment to VA Puget Sound Staff at these locations.

3) SCOPE: The contractor shall furnish all personnel, equipment, and supplies, except as specified as Government-furnished, to provide Security Services at the locations listed in Place and Time of Performance.

4) GENERAL REQUIREMENTS

a. Non-Personal Services.

i. The Government shall neither supervise the contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer immediately.

ii. It shall be the responsibility of the contractor to manage its employees effectively to ensure services are provided in accordance with this PWS.

iii. The dedicated supervisor shall have the same qualifications (at a minimum) as required for the security guard. The supervisor shall be available during the entire time while the guard is on duty and perform scheduled and unscheduled reviews for quality, compliance assurance and contract compliance. The supervisor shall not be the same person as one performing the security guard services (unless approved by the COR or Contracting Officer is special circumstances). Supervisor shall have a background with a minimum of two years of successful experience supervising commercial or industrial security guards.

iv. Contractor must maintain supervision of Security Guards despite the distance of the CBOC/CRRC. Contractor must have clear controls in place to oversee Security Guards, such as daily/weekly communication with employees and timecard attendance.

v. It is the responsibility of the Contractor to immediately correct performance issues with on-duty Security Guards. If performance issues are repeated or severe in nature, the Contractor shall provide a replacement Security Guard, at no additional expense of the Government. The request for a replacement Security Guard will be made by the Contracting Officer.

vi. Deliverable: 1. Supervisor. Contractor shall provide at least one Supervisor name and point of contact information 30 days after award and 5 days after change of personnel to the COR and Contracting Officer.

b. Contract Administration

i. The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single point of contact between the Government and Contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on the requirement.

ii. Deliverable: 2. Contract Administer. Contractor shall provide contract administer name and point of contact information 5 days after award and 3 days after change of personnel to the COR and Contracting Officer.

c. Place and Time of Performance.

i. One (1) security guard shall be stationed at, patrol and survey the surrounding areas at the following locations:

ii. The Guard(s) will be required 50 hours per week, except for Federal recognized holidays. Monday through Friday 7:00am – 5:00pm (local time).

One guard must be present, on-campus at all times within the hours posted.

The shift can either be split between multiple guards OR a single guard can be present all day with a working lunch on campus. If taking a working lunch on campus, the guard must still respond to calls.

iii. Work schedules may fluctuate, based on staff coverage, weather and building closure. No guard shall provide more than twelve (12) hours of service in any twenty-four (24) hour period unless the work periods are separated by an eight (8) hour non duty period (“service” includes VA contract work and also any other employment). This limitation may be temporarily adjusted by the COR verbally in emergency situations which are beyond the control of the

Contractor (i.e. weather conditions that prevent the next shift from getting to the building, civil disturbances, etc). A written confirmation of waiver must be obtained for each occurrence.

iv. Special Events / Emergency Services/ Call backs, Selected Saturday and Holidays: Upon the request of the COR the contractor shall provide Security Guard Services for special events, emergencies, call backs, selected Saturday and holiday during the year, whether scheduled or unscheduled.

These events can be holidays or other days designated by the Contracting Officer only prior to any services performed. These special events, emergency situations, call backs and selected Saturday and Holiday may require work after the normal work hours or an increase in personnel during normal work hours. In the event special event notification will be given to the contractor at least 6 hours advance. The special event task will be on an as needed basis at the hourly labor rate agreed to and specified in the Price Schedule.

5) SECURITY & ONBOARDING REQUIREMENTS

a. Contractor employees must complete all VHA Contractor onboarding requirements within five (5) business days of award. The COR will assist the contractor throughout this process and must work diligently to complete the onboarding documents.

FORMS MUST BE LEGIBLE.

b. After onboarding documents are completed, COR will schedule fingerprinting appointment. Fingerprints must be submitted by contractor employees at any Veterans Affairs Medical Center (VAMC) with a PIV enrollment. In Washington, the following VAMC location conducts fingerprinting:

c. Contractor employees must complete Background Investigation and Special Agreement Checks

i. All contractor employees are subject to the same level of investigation as VA employees who have access to VA sensitive information and routine access to VA Facilities. The level of background investigation commensurate with the level of access needed to perform the PWS is Tier 1. All Contractor employees shall be required to complete a Special Agreement Check (SAC), and a National Agency Check with Written Inquiries (NACI) prior to beginning services. Both SAC and NACI must be favorably adjudicated prior to start of work.

d. Pre-performance costs associated with onboarding, including time, travel and any costs for certification(s), are the responsibility of the contractor and may not be billed.

e. The Contractor and Security Guards must possess Security Guard Licensing from the Washington State Department of Licensing. Such licenses shall always remain active during the performance of this requirement. It is the responsibility of the contractor to obtain/maintain all security guard licenses. 6) SECURITY GUARD REQUIREMENTS.

a. The contractor shall supply security guards that meet the following minimum requirements:

i. Have a minimum of six months of performing security guard’s duties. The contractor guard shall have experience working with persons who are veterans and persons may suffer from cognitive, mental health or substance abuse problems.

ii. Have successfully met and passed all pre-employment screening tools, such as drug testing, Washington Security Guard certification (as required by Washington State), criminal background check, and employment reference checks, prior to providing services.

iii. The level of background investigation commensurate with the level of access needed to perform the PWS is Tier 1. All Contractor employees shall be required to complete a Special Agreement Check (SAC), and a National Agency Check with Written Inquiries (NACI) prior to beginning services. Both SAC and NACI must be favorably adjudicated prior to start of work.

iv. Have the ability to de-escalate potentially volatile situations without the use of force, to the problem-solve, i.e., ability to process information combined with experience and knowledge to achieve a reasonable solution, and to mediate the conflict.

v. Demonstrate an understanding of the concepts of community policing, and demonstrate the ability to work, interact, and build effective partnerships with the VA Police, local police agencies, neighbors and/or resident staff.

vi. Security guards shall be literate in English to the extent of reading and understanding printed regulations, detailed written orders and training instructions, and can communicate with all types of persons as well and can resolve conflicts and solve problems in a civil and professional manner.

vii. Security guards will comply with all VA rules and regulations regarding privacy and information security. All security guards stationed at clinics will take VA HIPPA/Privacy training. Security Guards will be issued PIV badges to enable them to gain access to the CBOC/CRRC buildings.

viii. Security Guards shall not utilize VA office spaces except for designated spaces when not on a patrol or interacting with all individuals as to ensure that a constant state of situational awareness is maintained.

ix. Deliverable. 3. Guard License. Contractor shall provide state guard certifications for every guard 14 days prior first shift to the COR and Contracting Officer.

b. Health and Physical Fitness Requirements:

i. A minimum of twenty-one (21) years of age or as required by local laws.

ii. Physically and psychologically capable to perform the required duties.

iii. Free of any communicable diseases.

iv. Required to have documented tuberculosis testing (TB) every two years.

Must have tested as TB-free prior to starting work on this contract.

v. In good general health without physical defects or abnormalities, which would interfere with the performance of these duties. Well-proportioned as to height and weight.

vi. Capable of binocular vision correctable to 20/30 (Snellen).

vii. Free of color blindness.

viii. Capable of hearing ordinary conversation at 15ft.

ix. Assigned guards that are suffering from an illness (common cold, flu, etc.), shall not perform duties and be temporarily replaced.

7) CONTRACTOR REQUIREMENTS/QUALIFICATIONS

a. Contractor shall have a Washington Security Guard Agency license and maintain such license throughout the life of the contract. Government may terminate the contract if such license is not maintained active.

b. The Contractor shall provide regular and continuous training to security guards on subjects such as: legal updates, public relation and cultural diversity training, and policy and procedural updates/changes. VA Police will also conduct training at CBOC/CRRC. Any orientation and site-specific training hours are billable. Please note, hours not billable are listed in ONBOARDING & SECURITY REQUIREMENTS.

c. The Contractor shall develop and implement a process for monitoring and assessing security guard’s performance.

d. The Contractor shall provide randomized drug-testing (testing for Federal controlled substances) on security guards to ensure security guards are free of drug use.

Contractor shall remove guards from providing services for the VA, upon positive drug test results.

e. The contractor shall develop a written Security Guard Standard Operating Procedure (SOP) for each CBOC/CRRC, which addresses the following areas:

i. Communication – Will describe the process for developing and maintaining communication links, collaborative relationships and contacts with the following: local Police agency service the clinic, Business Contacts (Business contacts are defined as having direct contact between the security officer and the businesses in order to develop and maintain good relationships in the designated patrol areas, Local Police and Washington State Troopers office Contacts, Interaction and Reporting, Other Business Security Agency Contacts.

ii. Incident Reporting - Response procedures for reporting incidents, acts, or conditions that may affect the safety and security of individuals and/or property in the area. This would also include identifying the progression of incident reporting from low level up to critical.

iii. Response to Behavioral Issues – Response procedures dealing with some of the following individual conduct issues:

Hostility, aggressive behavior

Outbursts or inappropriate actions/behavior attributable to mental health issues

Intoxication or under the influence of a controlled substance

Aggressive Panhandling

Use of inflammatory or abusive language directed at individuals/businesses or other anti-social behavior that could lead to potential harm or damage

f. Security Guards Schedule and Coverage – Identifies the policy and procedure for ensuring patrol officer coverage during the locations Clinic hours of operation and addresses staffing shortages due to illness, absences, vacations, staff replacement (new hires), trainings, etc.

g. Security Guards Training – Describes the policy and procedure for the orientation and training of new security guards who are either permanently or temporarily replacing another security guard, and any other trainings that will better equip and enable the guard to deal more effectively with the public and perform their duties.

h. Contractor shall update SOP when a procedural change takes place or upon improvement in processes that may affect the Security Guard to fulfill their duties as outlined in this PWS. COR and Contracting Officer may require SOP updates throughout the performance of this requirement.

i. Deliverable. 4 SOP. The SOP will be sent to the COR and Contracting Officer within 30 days after award, 10 days after contractor updates or Government requested update.

8) PERFORMANCE REQUIREMENTS

a. Communication, Courteous, Positive and Respectful Interaction.

i. Performance Standards:

1. Take Appropriate Action. Security guards shall interact with all individuals encountered in and around the designated areas of surveillance to provide information, problem-solve, prevent unlawful activity, take appropriate action when necessary. Appropriate action will vary on the circumstance and may require the security guard to diffuse the situation with appropriate empathy and verbal actions.

2. Positive and Respect. All interaction shall be conducted in a positive and respectful manner. Security guards shall conduct themselves in a professional and courteous manner and maintain the highest standards of honor and respect for all persons. Security guards shall be able to communicate with persons in a positive and professional manner to explain rules and use verbal persuasion to obtain voluntary compliance.

3. Interaction. Security guards shall never act in an overbearing or domineering manner and will interact with respect as well as exercising fair and equal treatment to others without compromising the safety to themselves or others.

4. AQL: No more than three verified complaints on a security guard during a one-month period of performance.

b. Patrol. Security guards shall patrol the areas around the CBOC/CRRC Clinics and report any illegal activity, unusual findings, or safety concerns. These random patrols will be logged into the Daily Operation log. While patrolling, security guards shall respond to all calls for assistance in the clinic as quickly as possible. Security guards will provide escorts for vendors dropping off or picking up needed materials.

Examples are lab, x-ray and sterile processing. Security Guards will also assist VA Police Physical Security Specialist with monthly intrusion alarm sensor testing.

i. Performance Standards:

1. Internal Patrol. Conduct a minimum of eight internal foot patrols and four external foot patrols of the CBOC/CRRC Clinics.

AQL: Within a month period there are no more than three documented days when 8 internal and 4 external patrols did not occur.

2. Security guards will, at random conduct patrols so as not to establish a pattern.

3. Final Patrol. The final internal foot patrol will be conducted at prior to the close of business to make sure that no unauthorized persons remain in the building.

AQL: Within a month period there are no more than three documented days when guard did conduct the final patrol.

4. Hazardous Conditions. Immediately report potentially hazardous conditions and items in need of repair, including inoperative lights, leaky faucets, toilet stoppages, broken or slippery floor surfaces, etc., to the Clinic Manager. Take immediate action to prevent injury of patients. or staff (use safety devices to block area and direct activity around the hazard, etc.).

c. Post. The primary post for the clinic will be inside the main entrance at the information desk or in the Guard Dispatch area.

i. Performance Standards:

1. Guard. Contractor has a security guard on site at all locations as required by this PWS.

AQL: No sites without a security guard as required by this PWS.

2. While assigned to the post, the Contract Security Guard will respond to all calls for assistance as quickly and safely as possible.

Post. Security guards shall remain at the post when not conducting a patrol, incident response, or on authorized break.

AQL: Within a month period there are no more than two documented times when guard was not visible on site (not including authorized breaks).

3. Unauthorized Access. Discover and report persons attempting to gain unauthorized access to the property to local police and VA Police.

d. Incident Response.

i. Performance Standard:

ii. Security guards shall exercise sound judgment and discretion in stressful situations. Security guards do not have arrest authority; however, they must be able to quickly assess a situation and determine the most effective way to handle each situation which might include intervening to prevent immediate harm, face-to-face discussions with individuals, conducting active public relations, maintaining a visible presence or observing and reporting to the local Police.

iii. Patient Information. Security guards shall be in uniform and be radio or Cell phone equipped to communicate with their supervisors and the local Police.

Radio / Telephone equipment shall be supplied by the contractor. No identifiable patient information will be communicated via insecure means.

AQL: Zero incidents of identifiable patient information sent via insecure means.

iv. Security guards shall have exclusion authority, i.e., restricting an individual’s access to specific sites/areas based on past or current behavioral issues or offensive conduct, for those sites where such authority exists if the exclusion conforms to 38 CFR 17.106.

v. Response Time. Security guard shall respond to any reported urgent calls within Security calls within 1-2 minutes.

AQL: Within a month period there are no more than one documented times when guard did not respond timely.

vi. Injury or Illness. Obtain professional assistance in accordance with procedures in the Police SOP or Post Orders in the event of injury of illness to Government employees, Veterans, or others while in the building or on the grounds. Render First Aid and/or CPR in emergency situations and assist medical and law enforcement personnel as appropriate.

e. Call 9-1-1.

i. Performance Standard:

1. Call 9-1-1. Security guards shall not attempt to handle any situation that is beyond their authorization or ability to deal with safely. Security guards will call 9-1-1 for police and other public safety or first responders as appropriate.

AQL: 9-1-1 is always called when necessary and without delay within one minute of known instance.

2. Security guards shall report criminal activities to the Local Police agencies, avoiding personal participation in arrests or criminal investigations, except in emergency situations.

f. Alarms:

i. Performance Standard:

1. In the event of a fire alarm and disaster drills, the Contract Security Guard will assist in the orderly evacuation (if necessary) and assist in crowd control and traffic control until the arrival of the Fire and Police Department. Direct Fire Department to fire scene.

2. In the event of an Intrusion alarm at the Pharmacy, IT closest, and any other restricted area, the Contract Security Guard will notify on duty VA Police and investigate to determine the cause.

9) GOVERNMENT-FURNISHED EQUIPMENT/INFORMATION

a. Access to use a workspace as needed with the following:

i. Chair and Desk near the main entrance.

ii. Telephone

b. VA Form 1433 VA Police Daily Operations Journal

c. The below training will be provided by the Government (currently by TMS completed on a non-Government computer). The training can be completed online, classroom, hands-on, or combination of the three.

d. Each training class wil be one hour.

iii. Prevention and Management of Disruptive Behavior Level 2 (Bi-Annually)

e. Accountability for Government Property. All non-disposable property furnished by the Government under this contract will remain the property of the Government.

Inventories will be conducted at the startup of the contract, annually, and upon termination of the contract. The Contractor shall conduct a joint inventory of all such property with the COR. Any property furnished by the Government to fulfill contracted requirements which is lost or damaged, resulting from improper use or negligence by the Contractor’s employees, shall be repaired or replaced at the Contractor’s expense, as directed by the COR.

10) CONTRACTOR FURNISHED EQUIPMENT

a. Security guards shall not be armedwith a firearm, nightstick, Pepper Spray, Electronic stun devices, or any item other than radios and handcuffs. Radio equipment and handcuffs shall be supplied by the Contractor.

b. Contractor shall provide professional and neat security guard uniforms. Uniforms shall consist of a neutral color (Tan, Cream, Black, Gray) and clearly indicate that the person is a contracted security guard. Uniforms shall be appropriate to conduct patrols in adverse climate of the area.

c. Each guard on duty shall be equipped with supplementary equipment including, but not limited to, notebooks, pens, pencils, replacement flashlight batteries and bulbs, and traffic control safety apparel (reflective vests, gloves, etc.), as appropriate to operations. Guard shall not be permitted to provide themselves any unauthorized supplemental, personal item, or other non-standard items that distract from their duties

i. Name tag. Uniform shall show last name of the guard visible 10 feet away.

ii. Cell Phone. Provide on-site guard with a cellular telephone capable of making 9-1-1 emergency calls and calling VAPSHCS Police. Furnish the phone number and direct connect number to the COR.

11) RISK CONTROL

a. Safety Protocol:

i. When a veteran exhibits aggressive behavior (verbal threats or gestures, agitated behavior, or kicking or throwing things) staff will alert the security guard on duty. Staff will open their office door and/or leave as appropriate or possible. If staff feels in imminent danger and cannot leave their offices shout out for help from security or colleagues in neighboring offices or have Govt employee press their Lynx keys. Government employee computers in rooms where veterans are being seeing have 2 control keys (F9 and F11) that when pushed simultaneously activate a pop-up on all computers alerting staff that there is an incident in a room. If neither the staff nor the security guard can de-escalate the veteran; 9-1-1 will be called.

b. The infection control plan will be followed at all Clinics.

12) MEETINGS

a. Post-Award Meeting: A post award meeting will be held within seven days after award. The meeting must be mutually scheduled with contractor, police representatives, COR, CO and other individuals as necessary. The meeting will be held virtually via MS Teams. Government is responsible for the agenda.

b. Monthly Meeting: A monthly meeting, will be held at a mutually scheduled time with contractor, police representatives, COR, Contracting Officer and other individuals as necessary. The meetings will be held virtually via MS Teams. The Government may cancel the monthly meeting that occurs within the same month as the yearly meeting.

c. Yearly Meeting: A yearly meeting, will be held at a mutually scheduled time with contractor, police representatives, COR, Contracting Officer and other individuals as necessary. This meeting will either be held virtually via MS Teams or in person at the Seattle Campus, WA. Location will be decided by the Government.

13) MISCELLANEOUS

a. Removal from Duty. The Government may also request the Contractor to immediately remove any employee(s) from the worksite(s) should it be determined that individuals are being assigned to duty who have been disqualified for either suitability or security reasons, or who are found to be unfit for performing security duties during their tour of duty. The Contractor must comply with these requests. For clarification, a determination of unfit may be made for, but not limited to, incidents involving the most immediately identifiable types of misconduct or delinquency as set forth below:

i. Violation of the SOP and other VA Rules and Regulations addressed in VA training and orientation.

ii. Violation of Federal, State or local laws, rules, and/or regulations.

iii. Neglect of duty, including sleeping while on duty, unreasonable delays, or failure to carry out assigned tasks, conducting personal affairs during official time, and refusing to render assistance or cooperate in upholding the integrity of the security program at the work site.

iv. Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words or actions, or fighting. Also participating in disruptive activities that interfere with the normal or efficient operations of the Government.

v. Improper use of official authority or credentials.

vi. Unauthorized use of communications equipment or Government property.

vii. Violation of security procedures or regulations.

b. Daily Operation Log: At the end of each shift the security guard shall submit a daily operation log describing the days events/incidents/encounters/responses.

i. Security guards shall maintain a daily log of activities which will be sent to the Seattle VA Chief of Police at the end of each day utilizing VA Form 1433 VA Police Daily Operations Journal.

ii. Log shall document each contract security person sign-in when reporting for duty and sign-out when leaving at the end of the shift.

iii. No personal identifying information can be in the daily log.

iv. All logs will be faxed/emailed to Seattle VA Police Dispatch and then shredded at the end of the workday.

v. No VA sensitive information or identifiable patient information shall be retained by the security guards or permitted to leave the VA premises.

vi. Deliverable. 5. Daily Operation Log. Security guard shall submit to the COR at the end of each shift.

c. Weekly Report: Contractor will supply a weekly status report of schedules and coverage for the coming week, # of veteran contacts the previous week, response times, and any issues or concerns.

Deliverable. 6 Weekly Report. Contractor shall submit the status report every Friday to the COR.

d. Security Guard Retention Program

i. After every six months of employment, up to nine (9) guards (either full or part-time) can receive retention. The Government will reimburse the contractor up to $2,250 total for a retention paid to such contractor employee(s). The following conditions must be meet:

1. With the invoice, contractor shall submit pay information verifying employee received such pay. Contractor shall list employee name(s) on invoice.

2. Contractor employee shall have met the standards of this PWS during such timeframe.

14) QUALITY

a. Quality Control

i. The Contractor shall develop a Quality Control Plan (QCP) and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's QCP is the means by which he assures himself that his work complies with the requirement of the contract. At a minimum the QCP shall address the following:

1. Supervision/control of employees

2. Hiring/retention of employees

3. Plan to deal with staff callouts and employee shortages

4. Administration support to the Contractor employee for complex federal background checks

5. Communication plan with COR, Contract Specialist and Contractor employees. This is an important element of the QCP and overall contract

ii. The finalized QCP shall be submitted within 20 days of award for Government review/approval. The Contracting Officer may notify the Contractor of required modifications to the plan during the period of performance. The Contractor then shall coordinate suggested modifications and obtain acceptance of the plan by the Contracting Officer. Any modifications to the program during the period of performance shall be provided to the Contracting Officer for review no later than 10 days prior to effective date of the change. The QCP shall be subject to the Government's review and approval. The Government may find the QCP "unacceptable" whenever the Contractor's procedures do not accomplish quality control objective(s). The Contractor shall revise the QCP within 10 days from receipt of notice that QCP is found "unacceptable."

iii. Deliverable. 7. QCP. Contractor shall submit 20 days after award, and/or 10 days after notice of required notification to the COR and Contracting Officer.

b. Quality Assurance Surveillance Plan (QASP)

i. The Government shall monitor the Contractor's performance under this purchase order in accordance with the Government's QASP. Performance under the contract will be monitored and evaluated by the designated Contracting Officer’s Representative (COR), VA Police, and the Local Clinic Managers. Performance objectives may be modified during program operation, upon written agreement of the selected Provider and VA Police.

C.1 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL

PRODUCTS AND COMMERCIAL SERVICES (NOV 2023)

(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights—

(1) Within a reasonable time after the defect was discovered or should have been discovered;

and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
