About this file

This document is a Vendor Questions & Answers file for a VA courier service solicitation specifically set aside for Service-Disabled Veteran Owned Small Businesses (SDVOSBs). The solicitation is for a new courier service requirement involving pickup and delivery of boxes and containers, likely containing patient information, which will require a Business Associate Agreement to ensure HIPAA compliance. The incumbent vendor is Kangaroo Pick-up and Delivery Service, Inc.

Key details include strict requirements that only SBA-certified SDVOSBs can bid, with non-certified vendors' offers being automatically ineligible. The VA will not disclose the contract's budget or previous contract details, instead instructing vendors to provide their most competitive offer. The contract will enforce Limitations on Subcontracting under VAAR 819.7004, and vendors must sign a Certificate of Compliance. Potential contractors are directed to review the Statement of Work (SOW) to determine their own staffing and vehicle requirements, as the VA will not specify exact driver or vehicle specifications.

Vendor Questions & Answers The updates are highlighted in yellow below:

1) Is this solicitation only for Service-Disabled Veteran Owned Small Businesses (SDVOSBs) total set-aside? Or can anybody bid on it?

Answer: Yes, the solicitation is only for Service-Disabled Veteran Owned Small Businesses

(SDVOSBs) to submit their offers. Unfortunately, if a vendor that is not SBA certified as a

SDVOSB submits their offer, the non SBA certified SDVOSB offer would not be evaluated.

2) Who is the incumbent?

Answer: The incumbent is Kangaroo Pick-up and Delivery Service, Inc.

3) What was the previous/current contract# for this requirement?

Answer: In order to ensure this solicitation’s requirements are met, the previous service contract is not relevant since this is a new requirement with details listed in the RFQ, SOW, and

Price/Cost Schedule.

4) What is the budget/value for this requirement?

Answer: The VA does not disclose the funding/budgeted amount for the requirement since this is a commercial acquisition under FAR 12.6. Therefore, we highly recommend for vendors to provide their best offer that they believe is competitive.

5) Why and how are you going to enforce the Limitations of Sub-Contracting? Answer: Under

VAAR 819.7004 the CO required to enforce the limitations of sub-contracting for any set-aside contracts. Therefore, any offerors who do not agree and sign the VAAR 852.219-75 VA Notice of

Limitations on Subcontracting – Certificate of Compliance For Services, the offerors will not be eligible for evaluation.

Also, for both pre-award & post-award actions, the CO will use any other pertinent VAAR, VHA

Policies, and FAR to ensure that Limitations of Sub-Contracting are enforced.

6) What was the cost of the final full option year of the previous contract?

Answer: In order to ensure this solicitation’s requirements are met, the previous service contract is not relevant since this is a new requirement with details listed in the RFQ, SOW, and

Price/Cost Schedule.

7) Please confirm whether licenses can be utilized via subcontractor(s) for this requirement?

Answer: Please review SP1, SP2, and SP3 of the Special Standards of Responsibility from the RFQ document.

8) Why would a Business Associate Agreement be needed for this requirement?

Answer: The courier would be picking up boxes and containers that will likely have patient information that requires protection of patient privacy to prevent a HIPAA violation; therefore, a

Business Associate Agreement shall be required between the vendor awarded the contract and a Veterans Health Administration (VHA) Privacy Officer.

9) How many drivers/vehicles are currently used to service the current contract?

Answer: The current number of drivers/vehicles by the incumbent vendor is not relevant for this requirement. Please review the Statement of Work (SOW) to allow your company to make the determination of the number of drivers/vehicles based on your business’ capabilities. The VA will not state the headcount of courier drivers/vehicles required because it is the contractor's responsibility to properly staff and equip their business to meet the SOW requirements.

10) What is the vehicle size currently servicing this location?

Answer: The current size of the incumbent vendor’s vehicles is not relevant for this requirement. Please review paragraph 5 of the SOW in the RFQ to allow your company make the determination of vehicle size. Reason: Maybe the driver has multiple customer deliveries to support, not just the VA. Therefore, the VA will not state the exact vehicle size, so it is the contractor's responsibility to ensure the vehicle used meets the SOW requirements.
