2. The Contractor shall also be responsible for all damages to persons or property that occurs as a result of the Contractor’s fault or negligence.
3. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.
4. Existing Site Conditions. Construction will occur within the Emergency Department Waiting Area, Lobby and adjoining Central Check-In space. The project will take place in an occupied healthcare facility and the design/build activities will require construction to be phased in such a way as to minimize impact to staff and patients. Infection Control measures will be required at all times as defined in ICRA assessment, Class III, Group 2, Type C. Construction activity will require constant coordination with VA personnel.
5. Site Investigation is required for this project to ensure understanding of scope of work. The Contractor shall be responsible for field verifying all conditions and quantities that may affect the project work prior to bid of this project. This work can be performed directly by the General Contracting firm, or indirectly via contract to a third party (Sub-Contractors). The person(s) conducting the site investigation are to check in with the VA Facilities Management Services department and will be escorted to review the project for not less than 4 hours by the VA Contracting Officer Representative (COR). This work can be done in advance and is intended to limit unforeseen site conditions not indicated on the drawings.
6. The final construction shall conform to all VA requirements outlined in the FGI Guidelines for Design and Construction of Hospitals, Facilities Guideline Institute (FGI), ADA, Joint Commission Accreditation Standards, ANSI, SMACNA, IBC, NEC, NFPA as well all requirements of the VA design manuals posted by discipline in the VA Technical Information Library at the following web address: http://www.cfm.va.gov/til/dManual.asp

8. Due to requirements in NFPA 101 Life Safety Code, a minimum of two egress routes for each occupied space must be maintained after an allowable common path of travel distance of 100 feet (per NFPA 101 Paragraph 18.2.5.3. To ensure the safety of VA patients, staff, and tenants, work is to be structured to allow for egress routes to be maintained throughout the course of construction. Work requiring relocation of tenants, is subject to notification requirements. If Contractor provides a schedule resulting in any violations of NFPA 101 Life Safety Code during any work, they must also submit proposed interim life safety measures for VA review. Any action necessitated by NFPA 101 Life Safety Code will be the responsibility of the Contractor.
Construction shall conform to all VA requirements outlined in the FGI Guidelines for Design and Construction of Hospitals, Facilities Guideline Institute (FGI) as well all requirements of the VA design manuals posted by discipline in the VA Technical Information Library at the following web address: http://www.cfm.va.gov/til/dManual.asp Background and Facility
1. Existing Site Conditions Construction will occur within the Emergency Department Waiting Area, Lobby and adjoining Central Check-In space. The project will take place in an occupied healthcare facility and the design/build activities will require construction to be phased in such a way as to minimize impact to staff and patients. Construction activity will require coordination with VA personnel.
The General Contractor and its Sub-Contractors are expected to be cognizant of need to adhere to the construction schedule as a significant factor in determining success of efforts. All demolition shall be required to remove abandoned utilities back to active main; site investigative efforts are to facilitate that component of the work.
Requirements
1. General The General Contractor and its Sub-Contractors will provide an initial itemized design and construction cost estimate. The above documented project scope must meet all applicable codes, regulations, and standards. This includes but is not limited to NFPA Codes, NEC, EPA (specifically conduction of NEPA), MT DEQ Regulations, OSHA 1926, ASTM and TJC Standards. Additionally, the General Contractor and its Sub-Contractors are required to meet all applicable laws and regulation not explicitly stated in this document. Construction efforts and products shall be conducted and produced in compliance with VA Publications including Master Construction Specifications, Design Guides, and CAD Standards (http://www.cfm.va.gov/TIL).
Phasing is to be expected as a necessary component of construction to maintain access to necessary clinical operations. In order to mitigate impact to operations, the project shall be constructed in not less than three (3) phases and potentially (but not limited to) as many as four (4) phases. The Emergency Department, Waiting Areas not under renovation is required to be operational during the phases of construction.
Submittals issued during construction will be limited to all MEP components. Associated architectural submittals will be agreed upon prior to commencing construction. Upon completion of construction, the Contractor will produce As-Built drawings to the VA. As-Built drawings to be provided electronically in both AutoCAD and PDF. These drawings are to be stamped as “AS-BUILT”. Operational and Maintenance manuals provided by the Design/Build firm are to include a single hard copy and a complete three electronic copies.
Projects are to be assessed for impact to Patient Care utilizing an Infection Control Risk Assessment (ICRA) in advance. Where the ICRA is found to represent significant impact to the means and methods of construction of individual tasks, the requirements of the ICRA will be included on a drawing sheet for each tasking. Additional impacts identified by the VA may be required to be included in the drawing sets to address other impacts to construction as a means of ensuring continuation of operations is maximized throughout the construction period.
A submittal log is to be included in the General Requirements section of the specification and is to be managed (updated and utilized) electronically by the General Contractor and its Sub-Contractors during construction. A similar logging system indicating dates and input is also to be included as a means of tracking Requests for Information (RFI). Project Management software may be used to track submittals and RFI’s, consult with VA on the preferred software.
2. Schedule All work efforts as related to construction are to be completed in duration not to exceed 30 calendar days or ANTP (See Period of Performance). Each submission shall allow for 5 working days for the VA review. All RFI’s are expected to be returned by the VA within one week of receipt. Durations indicated elsewhere in this document are to be incorporated into the preliminary schedule and are to be carried throughout. Many work efforts are anticipated to be conducted concurrently; however, in the event that efforts that later need to be redirected as a result of a substantive change within the scope are an assumed risk of the General Contractor and its Sub-Contractors. A schedule is to be provided as part of the basis for design and is expected to be updated as needed.
3. Following Construction, the General Contractor and its Sub-Contractors shall complete as-built drawings and furnish them electronically in PDF format on a removable storage format to the VA.
4. Post-Construction Quality Validation Within the specification, the General Contractor is to specify a one-year warranty period covering defects related to all work and materials/equipment included in the project. The General Contractor is to review the project in its entirety and determine oversight or resource requirements to enhance sustainment and limit need for warranty period services. Factory start-up is required of all applicable equipment included in the project. Where failures during the warranty period are attributable to an element of the design, the General Contractor and their sub-contractors are to provide consultation and re-design services at no cost to allow for remediation.

Additionally, the offeror must provide a breakdown of labor of that which is to be performed by the SDVOSB firm and that which is performed by the small business joint venture firm and that which is sub-contracted. All Joint Ventures will be required to be registered, verified and visible as an entity in VETBIZ prior to award.
I.2A SELECTION PROCEDURES
This acquisition will utilize the two-phase design-build selection procedures in accordance with FAR 36.301. Phase I shall include the scope of work, evaluation factors as stated in FAR 36.303-1, and Phase II evaluation factors. A maximum number of five (5) offerors will proceed to Phase II. Once the Contracting Officer selects the most highly qualified offerors, they will be asked to submit Phase II proposals. Phase II of the solicitation shall be prepared in accordance with FAR Part 15, with evaluation criteria developed in accordance with FAR 15.304. The Government will award a contract resulting from this solicitation to the offeror whose offer conforming to the solicitation is determined by the Source Selection Authority to provide the best overall value to the Government. It is the intent of the Government to award without discussions; however, the Government reserves the right to have discussions if such are needed.
In addition to the general standards of responsibility found at FAR 9.104-1, in accordance with FAR 9.104-2, the special standards of responsibility described below apply to this procurement. Offerors who fail to meet any special standard of responsibility will not be eligible to receive contract award.
I.3A PRE-PROPOSAL SITE VISIT
A pre-proposal site visit will be conducted in Phase II. The most highly rated firms selected to proceed to Phase II will be invited to attend the pre-proposal site visit. The Contracting Officer will establish the date and time and notify Phase II offerors in writing. See FAR Clause 52.236-3, Site Investigation and Conditions Affecting the Work, and FAR Provision 52.236-27, Site Visit (Construction) of this solicitation.
I.4 Selection Criteria I.4.1 General: Phase I proposals will be evaluated to determine the most highly qualified offerors to advance to Phase II. Factors 1 and 2 are of equal importance when selecting the most highly qualified offerors in the Phase I evaluation. Phase II Proposals will be evaluated, and award will be made based on both price and technical considerations most advantageous to the Government per FAR Part 15.101(a), Tradeoff Process. The Government may consider award to other than the lowest priced offeror or other than the highest technically rated offeror if it is in the best interest of the Government.
I.4.2 Offerors who are selected to move on to Phase II will be requested to submit a Phase II proposal. Factors 3-4 will be evaluated in Phase II and are of equal value. The non-price factors, when combined, are significantly more important than price.
Phase I:
Factor 1 – Past Performance Factor 2 – Technical Approach Phase II:
Factor 3 – Technical Solution Factor 4 – Schedule Factor 5 – Price In addition to the general standards of responsibility found at FAR 9.104-1, in accordance with FAR 9.104-2, the special standards of responsibility described below apply to this procurement. Offerors are to submit documentation with their Phase I proposal.
Offerors who fail to meet any special standard of responsibility may not be eligible to receive contract award.
Solicitation Submittal Requirements:
The Offeror shall submit the following information: (For a partnership or joint venture, the following submittal requirements are required for each Contractor who is part of the partnership or joint venture and for the entity itself. EMR shall not be submitted for subcontractors.)
1. OSHA or EPA Violation(s):
Offerors shall provide Summary of Work-Related Injuries and Illnesses, affirming that the Offeror has no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years.
2. Experience Modification Rate (EMR):
Offerors shall provide documentation to show that the offeror has an Experience Modification Rate (EMR) of equal to or less than 1.0.
Factor 1-Past Performance
(a) Aspects of Past Performance Evaluation. The past performance evaluation is an assessment based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements. There are two aspects of the past performance evaluation.
| (1) The first is to evaluate whether the offeror’s past performance is relevant or not relevant to the effort to be acquired. The criteria to establish what is relevant is unique to each source selection. | |
| (2) The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts. In addition, the Government reserves the right to obtain information for use in the evaluation of past performance from all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance, and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. |
(b) Source Selection Evaluation Board (SSEB) members will review past performance information to determine the quality and usefulness as it applies to the performance confidence assessment.
Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.
(a) Solicitation Submittal Requirements:
Offerors shall submit up to five (5) recent and relevant projects where the offeror performed Architecture and Engineering services, and up to five (5) recent and relevant construction projects as defined below. If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted. The Government will evaluate past performance based upon sources available to the contracting officer that may include Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS) and Electronic Subcontract Reporting System (eSRS). IF THERE IS NOT A PAST PERFORMANCE EVALUATION IN PPIRS or FAPPIIS, then the offeror shall submit Past Performance Questionnaires (PPQ) for each project. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). An incomplete questionnaire will not be considered. The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Ilze Karklins-Powers, ilze.karklins-powers@va.gov.
Recency – a recent project is defined as being completed within five years of the due date of this solicitation.
Relevant – includes performance of efforts involving design and renovation of an active hospital area in an active medical facility that are similar or greater in scope, magnitude, and complexity of the effort described in this solicitation. Construction project(s) shall have a minimum value of $250,000. AE project(s) shall have a minimum value of $25,000.
The offeror may utilize experience of a design subcontractor to demonstrate design experience under this evaluation factor. The Offer must provide a supporting joint venture agreement, partnership agreement, teaming agreement, or letter of commitment and an explanation of the involvement for the design subcontractor.
Offerors are cautioned to submit enough information in the format specified in the solicitation. Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.
(b) – Basis of Evaluation:
The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this RFP, based on the offeror’s demonstrated past performance. Past performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will not be considered as highly as past performance information for the principal offeror. Design Build Projects will be rated more favorably. Offerors with no relevant past or present performance history or the offeror’s performance record is so limited that no confidence assessment rating can be reasonably assigned shall receive the rating "Unknown Confidence," meaning the rating is treated neither favorably nor unfavorably.
Factor 2 – Technical Approach:
(a) Solicitation Submittal Requirements:
Provide a brief narrative (page limitation: one (1) page) describing the offeror’s method to manage the project to achieve design and construction objectives as described in the RFP. If the page limits are exceeded, the pages more than the limit will not be read or considered. Include at minimum all aspects covered in the scope of work. The following shall be included in the narrative:
1) Design Approach: Describe the techniques and methods for an efficient, effective design and.
| 2) Construction Approach: Describe the techniques and methods for this construction project | to include coordination with the design packages, projected timelines, and coordination of | all aspects of the phasing. | |
| (b) | Basis of Evaluation: |
The basis of evaluation will include reviewing the offeror’s proposed technical approach for this design-build project as defined in the solicitation submittal requirements. The assessment of the offeror’s method to manage the project shall be used as a means of evaluating the offeror’s ability to successfully meet the requirements of the solicitation.
Factor 3 – Technical Solution
1. Solicitation Submittal Requirements:
Provide a narrative describing the technical solution to the project that meets the requirements of the RFP. Include the following:
· Describe how your team plans on minimizing disruptions to hospital operations during construction.
Narrative shall not exceed six (6) single-sided pages. Up to 3 supplemental concept drawings may be provided to supplement the narrative. The plans provided by the Station to describe the scope of work may be included and modified, and do not count against the drawing page limit.
1. Basis of Evaluation:
The Government will evaluate the narrative and conceptual drawings (if included) considering the extent to which the offeror demonstrates a clear understanding of the architectural and engineering and construction requirements of the project. The Government will evaluate the offeror's technical solution to determine adherence to the technical requirements of the RFP.
Factor 4 – Schedule
(a) Solicitation Submittal Requirements:
(1) The progress schedule will be in a time scaled bar graph format. The horizontal axis will be scaled for time beginning with the Notice to Proceed and concluding with contract completion. The vertical axis will show the milestones and major portions of the contract work. All schedule items will show a start date and a completion date. The detailed schedule, will indicate specific tasks with dates for each step of the process including:
1. Design Period: The design period sub periods (i.e., first and second reviews, other meetings, internal Quality Assurance/Quality Control plan reviews, etc.).
1. Construction Period: Mobilization; Demolition method and sequencing; plans to avoid utility outages; submittals and material delivery; generator relocation etc.
1. General Project Delivery Schedule and Narrative - Show relationships between construction document development/completion (including required review activities) and construction activities.
1. Schedule shall indicate all elements of the design and construction timeline, from notice to proceed (NTP) (in order to establish a common baseline among all offerors, assume NTP date of September 30, 2022) to contract completion, including but not limited to preconstruction meetings and submittals, design and design phase approvals, utilities, demolition, material lead times, utility installations, testing/adjusting/balancing, construction and post-construction submittals, close-out. Use period of performance listed on the solicitation.
(2) The offeror shall specify how much allowance has been made for bad weather in the schedule, the days of the week and the hours of construction operations during each phase of the work, and the percentage of contract completion that will be achieved at the end of each month of the contract.
(3) Short Schedules - The offeror will provide a written commitment as to the time frame (number of days after receipt of the notice to proceed) within which the offeror will guarantee completion. The maximum anticipated completion of this project (including design and construction of the entire project) is indicated in the SOW. Shorter schedules (must include required Government review times), if obtainable, will receive more favorable scoring. The offeror’s schedule will establish the contract completion date and will be incorporated into the award.
(b) Basis of Evaluation:
The basis of evaluation will include the bar graph detailed schedule considering the extent to which the offeror demonstrates a clear understanding of the architectural and engineering requirements for the construction period and general project delivery. The Government will evaluate the likelihood that the work will be performed in accordance with the stated schedule given the technical requirements of the RFP.
