Refer to Amendment 0001 for Questions 1 and 2.

Refer to Amendment 0002 for Questions 3 and 4.

Questions and Answers:

QUESTION 5: My Subcontractor Team Members are not comfortable saying whether they have an exemption or not to the vaccine mandate. My question for you is, do you need a religious or medical exemption? And if so, why?

Response 5: Per Executive Order 14042, FAR 52.223-99 (01 Oct 2021 Deviation), and VHA Directive 1193 all personnel are required to be either vaccinated or have an approved exemption. Attachment A Paragraph 5 provides direction on personnel who are unvaccinated and have an exemption:

“5. MASKING FOR UNVACCINATED VHA HEALTH CARE PERSONNEL

a. VHA ( Health Care Personnel (HCP) ) who do not receive COVID-19 vaccination due to medical or religious exemptions must designate this on VA Form 10-263 (Appendix B) and wear a face mask while in any

VA medical facility, including both clinical and non-clinical areas. In addition, unvaccinated VHA HCP are required to wear a face mask during performance of their assigned duties and responsibilities, as outlined in local conditions.

b. The face mask must be worn until the individual is considered fully vaccinated for COVID-19 and completes VA Form 10-263 (Appendix B).

NOTE: Local policy may require that all individuals wear a face mask, regardless of vaccination status, if a risk of transmission of SARS COV-2 exists.

c. VHA HCP may remove their face mask only in accordance with VHA masking guidance.

d. Face masks will be made available at VA medical facilities and distributed per local conditions. A face mask must be replaced when it becomes wet, visibly soiled, torn, or damaged. Alternatives to face masks may be considered under limited conditions with the guidance of infection control professionals. “

Per VHA Directive 1193 “Healthcare personnel (HCP) refers to all paid and unpaid persons who work in or travel to VHA locations who have the potential for direct or indirect exposure to patients or infectious materials, including body substances (e.g., blood, tissue, and specific body fluids); contaminated medical supplies, devices, and equipment; contaminated environmental surfaces; or contaminated air. These HCP may include, but are not limited to, emergency medical service personnel, nurses, nursing assistants, physicians, technicians, therapists, phlebotomists, pharmacists, health professions trainees (HPTs), contractor personnel, and persons (e.g., clerical, dietary, environmental services, laundry, security, maintenance, engineering and facilities management, administrative, billing, and volunteer personnel) not directly involved in patient care but potentially exposed to infectious agents that can be transmitted from HCP and patients. HCP include all VA licensed and unlicensed, clinical and administrative, paid and without compensation, full- and part-time, intermittent, fee basis employees who are expected to perform any or all of their work at these locations.”

QUESTION 6: If my subcontractor doesn’t have an exemption but acknowledges the requirement to wear a face mask when under conditions in the work environment described as outlined in national

VHA guidance (See Appendix A, paragraph 5.a and Appendix B) what is the difference?

Response 6: Per Executive Order 14042, FAR 52.223-99 (01 Oct 2021 Deviation), and VHA Directive 1193 all personnel, to include Contractors who perform duties in our facilities, are required to either be fully vaccinated or have an approved exemption. Per The Safer Federal Workforce website ( https://www.saferfederalworkforce.gov/faq/contractors/ ):

The prime contractor is responsible for ensuring that the required clause is incorporated into its first-tier subcontracts in accordance with the implementation schedule set forth in section 6 of Executive Order 14042.

When the clause is incorporated into a subcontract, a subcontractor is required to comply with the Task Force

Guidance for Federal Contractors and Subcontractors and the workplace safety protocols detailed herein.

Additionally, first-tier subcontractors are expected to flow the clause down to their lower-tier subcontractors in similar fashion so that accountability for compliance is fully established throughout the Federal contract supply chain for covered subcontractor employees and workplaces at all tiers through application of the clause.

Q: May the prime contractor assume the subcontractor is complying with the clause?

A: Yes, unless the prime contractor has credible evidence otherwise.

Q: Do federal employees, onsite contractor employees, and visitors who are not fully vaccinated need to wear a mask or physically distance in federal buildings or on federal lands?

A: Yes, people who are not fully vaccinated need to continue to wear a mask and physically distance consistent with CDC guidance and the requirements set forth in Executive Order 13991 and OMB

Memorandum M-21-15 and the model safety principles issued by the Safer Federal Workforce Task Force on

September 13, 2021.

Q: Do onsite contractor employees need to provide proof of a negative COVID-19 test?

A: Prior to being subject to a contractual requirement to be vaccinated, onsite contractor employees who are not fully vaccinated or who decline to provide information about their vaccination status must be able to provide proof of a negative COVID-19 test from no later than the previous 3 days prior when in a federal building or federally controlled worksite. If a contractor employee is regularly tested pursuant to an agency testing program, then they do not need to provide proof of a negative COVID-19 test from no later than the previous 3 days when in a federal building unless required to by the agency testing program.

QUESTION 7: Who approves a Contractor’s exemption?

Response 7: Per the COVID-19 VACCINATION VA FORM 10-263, the medical exemption is approved by a licensed physician and the employer, a religious exemption approval authority rests with the employer.

QUESTION 8: Is the documentation maintained at the VA or by the Contractor?

Response 8: Employer would appropriately maintain documentation and the VHA will maintain documentation per VHA Directive 1193, 5.l.:

l. VA Medical Facility Employee Occupational Health Staff. Employee Occupational Health staff at each VA medical facility is responsible for: (1) Ensuring appropriate entry and maintenance of all documentation involving vaccination or exemption by all VHA HCP in accordance with VA Handbook 5019, Employee

Occupational Health Service, August 3, 2017.

(2) Formulating and communicating the local process for secure receipt of documentation involving vaccination or exemption by VHA HCP.

(3) Documenting and monitoring COVID-19 vaccination compliance of all VHA HCP and identifying to the VA medical facility executive leadership those individuals who have not signed and submitted the Health

Care Personnel COVID-19 Vaccination Form, VA Form 10-263 (Appendix B) within 8 weeks of publication of this directive.

NOTE: VA Medical Facility Employee Occupational Health staff may not identify individuals according to their vaccination status or otherwise indicate whether an individual has been vaccinated unless that individual has provided a qualifying authorization permitting the disclosure on VA Form 10-5345 Request for and

Authorization to Release Health Information. Questions should be referred to the local Privacy Office.

(4) Aggregating, analyzing and reporting to the VA medical facility Director all metrics prescribed by the

Office of Occupational Safety and Health for the purposes of evaluating the COVID-19 vaccination program.

QUESTION 9: Regarding the building under construction that houses the 2 Carrier chillers on the contract, there were 4 condensing units on the roof. These units are not in the SOW, please advise if they are included and what the expected PMs are if they are included.

Response 9: The condensing coils on the building under construction are NOT part of the chiller contract, they are maintained by the VA.
