VHAPM Part 813.106 Simplified Acquisition Procedures Attachment 1: Brand Name Justification for SAP under $250K

DEPARTMENT OF VETERANS AFFAIRS

Brand Name Justification IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C259-19-AP-2712

1. Contracting Activity:

Organizational Activity:

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The Sheridan VAHCS Radiology Department requires the purchase of an additional GE Optima XR240AMX (1) Mobile Digital Radiographic System. The equipment will be used in the Radiology Department to serve as a backup to the recently purchased GE Optima XR240AMX. The mobile radiography units are critical for emergent diagnosis and care.

3. Unique characteristics that limit availability to only one manufacturer, with the reason no other manufacturer can be used:

In January 2019 the GE Optima XR240AMX Mobile Digital Radiographic System was purchased in the amount of XXXXXX under contract XXXXX and is currently in use at the Sheridan VAHCS Radiology Department. Since this purchase is for an additional unit to work in tandem with the current unit, having the same unit would eliminate the additional time and cost of training staff on a different manufacturer’s unit. The Government would save an estimated amount of XXXX not to mention the time training takes staff away from patient care. Two units from the same manufacturer would provide continuity of care, ease and continuity of operator use. Detector plates would be interchangeable between the two units. The Government would save money on the service contract since only one contract would be needed, listing the two units as part of the contract. If the facility has two units from different manufacturers there would be a need for two service contracts. GE also provides a service engineer located in Sheridan, WY which provides for rapid response if the machines are non-functional.

4. Description of market research conducted and results or statement why it was not conducted:

A Sources Sought Notice was posted on the Federal Business Opportunities (FBO) site on September 4, 2019. Four (4) responses were received; An FPDS search showed a previous purchase under XXXXXX for the same item awarded to XXXX. Further, GE Healthcare provided authorized distributor letters to the Government identifying two (2) SDVOSBs however; in accordance with the class deviation dated July 12, 2019 regarding the nonmanufacturer rule, there is no approved class waiver for the NAICS and product description selected. Further, the manufacturer, GE Healthcare, is a large business. As a result, the solicitation will be posted to the official Government Point of Entry website, Federal Business Opportunities (FBO), as a brand name open market, unrestricted solicitation.
