About this file

This Limited Sources Justification document is for a task order to sustain ScriptPro pharmacy dispensing equipment for Veterans Integrated Service Network (VISN) 19 VA Medical Centers. The procurement will utilize VA Federal Supply Schedule (FSS) 36F79719D0135, with ScriptPro USA, Inc. as the sole source contractor. The task order will cover maintenance and support services including 24x7x365 Help Desk support, on-site field service repair, preventive maintenance, parts, software updates, drug database updates, and ongoing interface maintenance for proprietary ScriptPro automated pharmacy dispensing systems.

The anticipated period of performance is October 1, 2025, to September 30, 2026, with a potential 6-month extension option. The justification emphasizes that ScriptPro is the only authorized provider for these services, and alternative solutions would cost approximately $11 Million to procure and implement. Market research conducted in July 2025 confirmed no other vendors can meet the requirement. The document includes approvals from various VA contracting officials, including the Contracting Officer, Branch Chief, Director of Contracting, and the Head of Contracting Activity, validating the sole-source procurement approach.

(3) Description of Supplies or Services:

The Contractor shall provide maintenance and support for the ScriptPro automated pharmacy dispensing systems utilized by all VISN 19 VAMCs, including 24x7x365 Help Desk support, on-site field service repair, preventive maintenance, parts, software updates, drug database updates, and ongoing interface maintenance. The ScriptPro equipment utilized by all VISN 19 VAMCs is proprietary, and the required services can only be performed by authorized ScriptPro personnel.

(4) Identify the Authority and Supporting Rationale:

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; The ScriptPro equipment utilized by all VISN 19 VAMCs is proprietary, and the required services can only be performed by ScriptPro personnel. Services that are not performed or authorized by ScriptPro would void the equipment warranties, according to the terms and conditions of the VA FSS.

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with (IAW) the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

(5) Describe Why the Order Represents the Best Value: The prices on the VA FSS for the current requirement have been determined fair and reasonable, and utilization of the FSS provided significant volume discounts for the initial setup and installation of equipment on the previous acquisition, which continue to represent considerable cost savings for the Government

Acquisition ID#: 36C259-26-AP-0173 by further utilizing the existing systems, compared to reprocuring and installing other pharmaceutical dispensing equipment. Only one source is capable of providing the required services for the equipment currently utilized by VISN 19 VAMCs, and any other alternatives to meet the Government’s needs would result in significantly increased costs and unnecessary duplication of efforts associated with reprocuring different pharmaceutical dispensing and management systems and training VA staff. Estimates associated with the previous acquisition indicate that approximate costs of procuring, installing, and training employees on alternative systems for all VISN 19 locations would exceed $11 Million. There are no known changes in suppliers, technology, or market conditions since the previous acquisition. Therefore, alternatives for the existing ScriptPro systems are not currently being sought. Additionally, any other alternatives to meet the Government’s needs would result in potential lapses of critical medical services to Veterans. In accordance with FAR 8.404(d), it has been determined that utilization of the VA FSS to meet the current requirement represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

(6) Describe the Market Research Conducted: Market research was conducted in July 2025 and confirms that only one source is capable of providing the required services. A search of the VA National Acquisition Center (NAC) catalog indicates that the required services are available on VA FSS 36F79719D0135. Acquisition history for the current task order, 36C25923F0441, procured IAW FAR 8.405-6(a)(1)(B), was reviewed. Searches conducted on GSA confirm that there are no other schedule holders capable of meeting the requirement. Searches were conducted utilizing the North American Industry Classification System (NAICS) code for this requirement (811210) and the keyword “ScriptPro.”

(7) Any Other Facts Supporting the Justification: A sole-source confirmation letter from the manufacturer states that ScriptPro is the only source for maintenance/updates, or modifications and upgrades to its systems, and is contained in the contract file briefcase. Additionally, the terms and conditions of VA FSS state that the existing warranty is void if the equipment or software is modified other than as authorized in writing by ScriptPro.

(8) A Statement of the Actions: There are currently no actions available to available to avoid restricting competition for this requirement.

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
