About this file

This is a Limited Sources Justification document for a sole source order against Federal Supply Schedule contract V797D-50450 to Lovell Government Services for 360 Defender Portable Compression Devices (part #08-0028) for the Rocky Mountain Regional VA Medical Center in Aurora, CO.

The justification explains that these wireless, tubeless, rechargeable compression devices are needed to prevent deep vein thrombosis (DVT) and enhance blood circulation for veterans in critical and acute care areas. The facility previously had only 0-20% compliance with ordered sequential compression device therapy due to limitations of traditional equipment. This sole source purchase is justified because the Precision Medical Defender is the only TAA-compliant cordless device on FSS that delivers asymmetric compression replicating natural blood flow. The facility already has 300 of these devices and wants consistency for training and compatibility. Market research confirmed Lovell Government Services as the sole authorized FSS vendor for these proprietary devices, as documented in a November 2022 press release designating them as Precision Medical's SDVOSB vendor for the Defender DVT Prevention Device.

2. Description of Action: This acquisition is conducted under the authority of the Multiple-Award

Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). This is a sole source order against a Federal Supply Schedule.

Order against: FSS Contract Number: ___ V797D-50450__________________

Name of Proposed Contractor: Lovell Government Services Street Address: 223 West Gregory St City, State, Zip: Pensacola, FL Phone: (850)684-1867

3. Description of Supplies or Services:

The Defender Mobile Clot Prevention system delivers asymmetric compression that replicates the blood flow of an ambulating patient. It is also tubeless, wireless and works with a rechargeable battery pack.

This is a request from the Rocky Mountain Regional VA Medical Center (RMR VAMC) for other than full and open competition for the procurement of a new, Firm Fixed Price Order for the procurement of Defender Mobile Clot Prevention system at the Rocky Mountain Regional VA Medical Center (RMR VAMC). The system delivers asymmetric compression that replicates the blood flow of an ambulating patient. It is also tubeless, wireless and works with a rechargeable battery pack. The compression device is used to aid in the prevention of DVT, enhance blood circulation, and diminish post-operative pain and swelling. For many years at this VA facility, nursing has been unable to consistently fulfill provider-ordered sequential compression device therapy for DVT prophylaxis for veterans admitted to critical and acute care inpatient areas. Lack of availability of traditional Sickle Cell Disease (SCD) pumps, concerns related to fall risk for ambulatory patients, and changing practice/recommendations around

VHAPG Part 808.405-6 Limiting Sources Page 2 of 4 Revision: 01 Effective Date: 09/01/2024 mobility goals while inpatient all inhibit compliance with ordered SCD therapy. As a result, a cordless, wireless SCD solution that is single-patient use and always available is required to increase compliance.

4. Identify the Authority and Supporting Rationale:

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

5. Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: The Precision Medical Defender Mobile Clot Prevention is the only TAA-compliant cordless SCD device on a Federal Supply Schedule Contract. This is also the only system that delivers asymmetric compression that replicates the blood flow of an ambulating patient compatible with the current equipment in use at the RMR VAMC. This product is supplied through Precision Medical’s sole source provider, Lovell Government Services, through the FSS contract. The RMR VAMC has used these items in the past and are requesting this specific brand for clinic continuity. The RMR VAMC has previously purchased 300 of these devices and by having the same product in the facility, it will allow for an easy transition between devices, if one were to fail, and would prevent the need for excess training on multiple systems. Lack of availability of traditional SCD pumps, concerns r/t fall risk for ambulatory patients, and changing practice/recommendations around mobility goals while inpatient all inhibit compliance with ordered SCD therapy. As a result, a cordless, wireless SCD solution that is single-patient use and always available is required to increase compliance. Based on observational data, inpatient services were between 0%- 20% compliance with ordered SCD therapy prior to trialing cordless SCD solutions on one inpatient unit (K3). Cordless/wireless SCDs support DVT prophylaxis, and increased compliance supports reduced
