B.2 STATEMENT OF WORK

1. SCOPE OF WORK: The contractor, licensed in the State of Texas, shall provide all personnel, supervision, transportation (armored car vehicles) and other items and services necessary to perform the driving, pick-up, and delivery of cash and other monetary documents (i.e. checks, change orders, etc.) from the location(s) specified. The contractor shall perform to the standards and specifications in this contract.

2.2 PERIOD OF PERFORMANCE

3. SECURITY: The contractor personnel shall observe and adhere to all applicable federal, state and municipal laws, codes and regulations relating to the performance of this contract.

Amarillo VA policy on the possession of firearms and weapons states:

Except for Police Service personnel, members of law enforcement agencies of Municipal, County, State and Federal governments on official law enforcement related visits to the facility and private security agents who are licensed by the State of Texas and who are conducting official approved business on Veterans Affairs property, no persons on or entering the premises will have in their possession, in their vehicle, or under their control any weapon. Weapons can be described as any hand-held instrument specifically manufactured to supplement a person’s physical capabilities in defensive or offensive combat. Although Texas law allows an individual to possess and carry both an openly displayed weapon and concealed weapon, Federal Law (18 USC 930) does not allow open carry of firearms on federal property and any permit to carry concealed firearms issued by the state is not valid. Persons with permits must not bring the weapons on Federal property on their person or in their vehicle. Weapons discovered will be confiscated as evidence, the person in possession may be charged under Federal code, and the weapon disposed of by Logistics.

If firearm(s) and/or weapon(s) are brought on federal property:

a. Introduction of weapons:

i. Armed law enforcement officers will stop at the Police Service prior to conducting official business in the Medical Center. Armed law enforcement officers who are not on official business will be advised that if the officer wishes to visit any patient care area they can place their weapon in a weapons locker prior to entering that area.

ii. Privately-owned firearms of patients being admitted to the facility will be accepted for safekeeping by Police Service only as a last resort when family members or other responsible persons who are legally able to possess a firearm are not available to remove the firearm from the facility for the patient. The firearm shall be made safe and processed in accordance with established evidence/safe keeping policies and procedures.

iii. To the maximum extent practical, a patient seeking admission who is in possession of any weapon should turn the weapon over to a family member or other responsible person to remove the weapon from Medical Center property. When the patient cannot remove the weapon from Medical Center property or transfer it to an accompanying family member or other responsible party, the weapon will be accepted for safekeeping by Police Service. The weapon shall be processed in accordance with established evidence/safe keeping policies and procedures.

iv. For those out-patients who are not being admitted or visitors who declare a firearm in their possession may be allowed to store their firearm in a weapon locker until they depart the facility. In these circumstances, VA Police, will explain the weapons policy and VA Regulation 1.218(b) 37. Possession of Firearms, and may issue a Courtesy Violation Notice (CVN), or if other mitigating circumstances exist a District Court Violation Notice (DCVN) may be issued or federal charges may be filed.

v. If a staff member or volunteer discover a Veteran or visitor in possession of a weapon or firearm immediately contact the VA Police by dialing the emergency number 66.

b. Weapon Confiscation:

i. Firearms discovered or confiscated on facility grounds will be preserved and stored as evidence when appropriate and or turned over to Logistics for disposition in accordance with Federal Property Management Regulations.

ii. A receipt for the firearm will be provided to the owner of the firearm, if known.

The contractor’s employees in execution of this contract must stop at the VA Police Department, located in the lobby of the main entrance, to be escorted to/from the agent cashier office. At that time, if necessary, can declare all weapons to the VA Police.

The contractor will provide a list of designated individuals [including photo of each], who will be responsible for the pick-up/delivery of monies to/from the cashier office, to the agent cashier office.

4. DEPOSITS: The contractor is required to pick-up/deliver the deposit to the financial institution designated in the schedule of services listed in item #2 by next business day.

a. The VA will:

i. Place all checks and currency order slips in a self-sealing shipment bag.

ii. Maintain a sequential folder of shipment of valuables forms detailing the date of shipment, the amount shipped, the number of the bag used for the shipment, the signature of the person preparing the shipment, and the signature of the contractor’s representative picking up the shipment.

b. The Armored Car Personnel will:

i. Sign the VA agent cashiers’ shipment of valuables form upon pick-up of self-sealing shipment bags containing daily deposits.

ii. Maintain their own log of all shipments delivered to this facility, which the cashiers will verify and sign.

5. CHANGE ORDERS: The VA agent cashier will call change orders into the financial institution designated in the schedule of services listed in item #2 as early as possible so the bank can have it prepared before noon. The armored car contractor will pick up the change order and deliver to the VA cashier office on the next business day. If change orders aren’t called in early enough and/or prepared by the bank timely for pick up then the contractor will pick up the change orders on the next business day and deliver the following business day.

6. TIME SCHEDULE: The agent cashier/canteen staff or his/her designated representative may NOT request that the contractor return to the VA due to the fault of VA personnel not being ready for the schedule pick-up or provide service during other than normal duty hours (to include weekends and holidays). However, if the contractor arrives at the VA earlier than designated pick-up time in item #2 and the VA personnel are not ready, the contractor’s representative shall wait until the scheduled hours of pick-up.

7. PERSONNEL: The contractor shall provide personnel who possess the skills, knowledge, and training to satisfactorily perform the services required by this contract. The contractor has the sole responsibility of training, providing uniforms, equipping, supervising and discharging of all employees.

8. LICENSE: An unexpired copy of the contractor’s State of Texas license, to operate as an Armored Car Company, must be provided to the VA contracting officer (CO). If at any time the contractor is no longer licensed through the State of Texas then this contract is automatically terminated.

(d) Comptroller General Examination of Record. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(a) Pursuant to 38 U.S.C. 8127(l)(2), the offeror certifies that—

(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:

In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. (3) If VA determines that an SDVOSB/ VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:

(i) Referral to the VA Suspension and Debarment Committee;

(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and

(iii) Prosecution for violating 18 U.S.C. 1001.

(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.

(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.

(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.9 VAAR 852.242-71 ADMINISTRATIVE CONTRACTING OFFICER (OCT

2020) The Contracting Officer reserves the right to designate an Administrative Contracting Officer (ACO) for the purpose of performing certain tasks/duties in the administration of the contract.

Such designation will be in writing through an ACO Letter of Delegation and will identify the responsibilities and limitations of the ACO. A copy of the ACO Letter of Delegation will be furnished to the Contractor.

C.10 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
