B.4 STATEMENT OF WORK
Bldg. 203 Water Softener System Replacement
General Requirements: The work consists of providing all labor, materials, tools, supplies, and equipment as required for complete removal of existing Water Softener System and installation of new Water Softener System with 25% greater flow and capacity as specified in this Statement of Work. The place of performance is building 203, Central Texas Veterans Health Care Facility in Temple, at 1901 S. 1st Street; Temple, Texas 76504.
The contractor shall be familiar with all the terms, conditions, and requirement herein contained.
All work must comply with federal, state, and local regulations. This is a turnkey project. It is the contractor’s responsibility to verify site condition. After all work is completed, the contractor shall have a walkthrough with the VA POC or Alternative POC to ensure all work is completed and ready to receive payment.
All work shall be done according to the Infection Control Risk Assessment (ICRA) specified for the respective areas where work is performed.
Performance Period. Work shall be completed within 60 Days after NTP.
Work Hours. Majority of the work shall be performed during normal working hours unless other wised noted by the VA POC. Normal working hours are 8:00 am – 4:30 pm, Monday – Friday.
Government Holidays. The Government observes these holidays:

If a holiday falls on a Saturday, then the Friday before shall be considered the holiday. If a holiday falls on a Sunday, then the Monday after shall be considered the holiday.
In addition to the days designated as holidays, the Government observes the following days:
• Any other day designated by Federal Statute
• Any other day designated by Executive Order
• Any other day designated by the President’s Proclamation
It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.
Project Requirements. The contractor shall perform the following during the entire project:
• The contractor shall review project site and coordinate all work, to install a new water softener system. Contractor must field verify site for conditions and required repairs.
Visit the site and become familiar with work location.
• The contractor shall coordinate with the VA POC (2) weeks prior to any proposed closure or reduction of passable ingress/egress, or accessible access entries disturbance.
Additionally, the contractor shall post construction safety signage, and alternate travel routing at location of disturbance where need on site.
• The contractor shall insure all Personal Protective Equipment (PPE) is provided and used by all construction staff and visitors.
• All work shall be performed in accordance with industry standards. Where conflict occurs between these guidelines the more stringent requirement shall be observed. All conflict in site conditions or materials shall be brought to the VA POC attention prior to beginning any work. All work shall be performed by skilled/trained/certified/licensee craftsperson of their respective trades. All work shall be complete in performance and comply with best practices of industry standards.
• The contractor shall limit/prevent damage to areas not covered in this scope of work.
Finishes materials, structure damage due to contractor negligence shall be repaired at the contractor’s expense. Repair/damage mitigation work shall match existing appearance and materials while being installed to new or better standards.
• Prior to any work being started the contractor shall comply with the requirements for Type C/Class IV (High Risk) Infection Control Risk Assessment (ICRA).
• The contractor shall provide submittals of all parts and equipment prior to purchase and or installation.
• Provide all labor and materials necessary for complete removal of existing water softener system and provide a new water softening system meeting all salient characteristics of the solicitation.
• Vertical pressure type water softener system, complete with pressure vessel, softening resin, control valve, brine maker and electronic controller. The system shall be of an approved design as fabricated by a manufacturer regularly engaged in the production of water treatment equipment. All equipment and material shall be supplied in compliance with the specifications as intended for a complete and operational system.
• Qualified manufacturers of water softener equipment shall have been engaged in the manufacture of this equipment for a period of not less than fifteen (15) years.
• The system shall be skid-mounted in.
• The system shall automatically send a signal to fill when regeneration is completed.
• The contractor shall provide water testing equipment.
• The contractor shall install new ball valves before and after the system.
• The contractor shall install an inline water meter and bypass system for the water meter.
• The contractor shall provide a qualified manufacturer’s representative to check complete installation for conformance to manufacturer’s recommendation, to place the system into service, to make all adjustments required for full conformance to design and specified requirements and to perform all demonstrations and testing.
• The contractor shall flush and disinfect new water lines and softener interiors in accordance with AWWA C651.
• An operating test shall be run in the presence of the VA POC.
• The contractor shall provide Commissioning documentation.
• The contractor shall provide demonstration and training to VA personnel.
• The contractor shall coordinate with the VA POC prior to occupying the workspace.
• The contractor shall obtain all burn permits from Safety prior to any hot work.
• The contractor shall solder all copper connections.
• The contractor shall test and verify all connections.
• The contractor shall install new hangers on the new piping before and after all joints to prevent sagging. All materials shall be of new materials.
• The contractor shall ensure all debris is removed from the worksite in a covered and sealed container.
• The system shall meet the following specifications.
Specifications as follows:
o 1-Twin Tank Water Softener System o CLWS-3 Electronic controls metered system on 36''+72''Tanks.
o 600.000 grains capacity o Flow rate of 200G.P.M per unit with on demand flow of 400-G.P.M. total flow.
Note: At the end of each workday, the contractor shall clean-up all worked in areas.
• Contractor shall contact Primary VA POC or Alternative POC prior to start of the work.

• The Contractor shall schedule work through the VA POC, to ensure that all necessary parts, materials, tools are accounted for prior to the start of work.
• The contractor shall coordinate with VA POC NLT than 7 days to the start of this service and completion. See information below:
Contractors Responsibilities Responsible for removal of all demo materials
• Coordinating with the VA POC during the shutdown and startup.
• Ensure that interior space is protected for construction debris during repair/mitigation procedures. Areas of disturbance shall be limited to the immediate work area. The contractor shall protect all adjacent structure, finishes and landscape from damage during construction. Repair of contractor damage shall be solely at the contractor expense.
• Ensure that all safety measures are followed in accordance with local and state safety laws.
• Within 7 days of notice to proceed the contractor shall provide a written schedule.
• Ensure that all safety measures are followed in accordance with local and state safety laws.
Other Considerations
• The contractor shall be responsible for the verification of all requirements for this project. All measurements and conditions must be verified by the contractor. Any discrepancies between field conditions, project documents, and this SOW shall be immediately brought to the Contracting Officer’s attention.
• The contactor shall be qualified/certified to perform all procedures in accordance with all local codes/ regulation.
• The contractor shall be required to submit a safety plan for VA review and approval prior to the performing work.
• The contractor shall comply with the requirements for Type C/Class IV (High Risk) Infection Control Risk Assessment (ICRA).
• The contractor shall provide adequate documentation verifying that any equipment and/or materials proposed meet or exceed all federal government requirements.
• The contractor’s supervisor shall always be available to address any needs VA POC/Alternative POC may have during the period of performance which is 30 days from start to finish and alert the Alternative POC of daily progress.
• The contractor shall thoroughly clean the project site daily with contractor’s own equipment, including s vacuums, mops, buckets, wash rags, dust mops, etc.
• The contractor shall be responsible for the removal of project demo materials/debris /equipment from this facility when complete.
Codes and Standards The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:
• Compliance with EPA and State environmental regulations.
SAFETY PLAN REQUIREMENTS
Prior to performing any work, the contractor shall be required to submit a safety plan in accordance with OSHA and VA Regulations.
The safety plan shall include, but not limited to the following:
• Personal Protective Equipment (i.e., head, hearing, and eye protection, footwear, clothing, gloves, etc.)
• Job Safety Training (i.e., OSHA, safety meetings, etc.)
o 30 Hour OSHA Construction Safety Course – competent person o 10 Hour OSHA Construction Safety Course – all others
• Safety Discipline (i.e., correction of violations, etc.)
• Emergency Procedures (i.e., responsibilities, procedures, etc.)
• Written Hazard Communication Program (i.e., responsibilities, procedures, list of hazards, MSDS, etc.)
o PPE is available and properly worn.
PERMITS: The Contractor shall be responsible for obtaining any licenses and permits and complying with any laws, codes, and regulations applicable to the execution of this work as required Federally and by the State of Texas.
WARRANTEE: The contractor shall warrantee work to be free of defects and workmanship for the duration of 1 year.
SECURITY: Contractors shall be required to obtain and wear security badges in plain sight above the waist at all times. Contractors found without a badge will be immediately removed from VA property by VA Police. Allow 7 business days per worker to obtain a badge. Security badges are obtained through the VA POC.
TUBERCULOSIS (TB): Contractors team members are responsible for TB testing of all workers scheduled to be on-site at the VA prior to the start of work. On-site workers will provide the VA Infection Control Nurse a copy of the TB test at the time of the infection control training provide by the VA. TB test must be within 90 days prior to assignment. Coordinate with the VA POC. TB training class is free and is a 30 min video.
SEASONAL INFLUENZA VACCINATION: VHA Directive 1192.01 establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities, through the vaccination of health care personnel (HCP). HCP are individuals who, during the influenza season, work in VHA locations or who come into contact with VA patients or other HCP as part of their duties. HCP include all VA contractors who are expected to perform any or all of their work at VA facilities. VA POC shall ensure the flu vaccination requirements outlined in this directive are expected in all HCP contracts. VA POC are responsible for on-site HCP contract and will inform the Contractors about this directive and its requirements.
INFECTION CONTROL AND SAFETY: The Contractors team, subcontractor workers shall attend the Infection Prevention training provided by the VA every fiscal year. All construction workers shall have a current IC training sticker attached to their badges at all times. If this requirement is not met, workers will be removed from construction site.
WORKMANSHIP: All work under this contract shall conform to the standards of these specifications. The Contractor at no additional cost to the Government shall correct work not meeting these specifications. Work shall be accomplished by mechanics skilled in the trade.
WORKING CONDITIONS: The buildings and the surrounding site areas will be occupied, and Government operations will continue a normal, temporary, or restricted basis for the duration of the contract. The Contractor shall take all precautions to ensure that his operations are conducted in a manner so as not to interfere with the normal operation of surrounding facilities. The Contractor shall execute work in a safe manner and shall not subject personnel to unsafe conditions. The contractor shall be required to be mindful of the area operations, and patient areas while conducting the cleaning. The Contractor shall provide safety barricades, devices, and equipment to protect personnel, property, and repair damage caused by construction operations. Take all precautions to protect the building and its occupants during the period.
SITE VISIT: The Contractor shall visit the site to determine the full extent of the work. Failure to inspect the site will not constitute grounds for a claim after contract award. A site visit will be scheduled through the VA POC, Alfred Stall, Alfred.stall@va.gov or Roger Adams, Roger.adams@va.gov.
DISPOSAL: Disposal of materials removed under this contract at an approved disposal site in accordance with all local, state, and federal laws, regulations, and guidelines are the Contractor’s sole responsibility. The contractor shall adhere to all OSHA requirements concerning removal, transporting, and disposal of the material.
CLEAN-UP: The Contractor shall keep the area neat and tidy and free of debris at the end of each workday.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023)
(DEVIATION)
(a) Definition. for the Department of Veterans Affairs, ‘‘Service-disabled Veteran-owned small business concern or SDVOSB’’:
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;
(iv) The business has been certified for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certified in the SBA certification database at https://veterans.certify.sba.gov/; and
(v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veteran Small Business Certification Program at 13 CFR parts 121, 125, and 128.
(2) The term ‘‘Service-disabled Veteran’’ means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(1) Offers received from entities that are not certified SDVOSBs and listed in the SBA certification database at the time of offer shall not be considered.
(2) Any award resulting from this solicitation shall be made to a certified SDVOSB listed in the SBA certification database who is eligible at the time of submission of offer(s) and at the time of award.

When awarded a contract action, including orders under multipleaward contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406(b) and 13 CFR 125.6. For the purpose of limitations on subcontracting, only certified SDVOSBs listed in the SBA certification database (including independent contractors) shall be considered eligible and/or ‘‘similarly situated’’ (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required LOS certification requirements in this solicitation (see 852.219–75 or 852.219–76 as applicable). These requirements are summarized as follows:
(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certified SDVOSBs listed in the SBA certification database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/ VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products.
(i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted. Refer to 13 CFR 125.6(a)(2)(ii) for guidance pertaining to multiple item procurements.
(3) General construction. In the case of a contract for general construction, the SDVOSB prime contractor will not pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, may be paid to firms that are not certified SDVOSBs listed in the SBA certification database.
(5) Subcontracting. An SDVOSB subcontractor must meet the NAICS size standard assigned by the prime contractor and be certified and listed in the SBA certification database to count as similarly situated. Any work that a first tier SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted.
When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13 CFR 125.6.
(e) Required limitations on subcontracting compliance measurement period. An SDVOSB shall comply with the limitations on subcontracting as follows:
[X] By the end of the base term of the contract or order, and then by the end of each subsequent option period; or [] By the end of the performance period for each order issued under the contract.
(f) Joint ventures. A joint venture may be considered eligible as an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402 and the managing joint venture partner makes the representations under paragraph (c) of this clause. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants.
(g) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Veteran Small Business Certification Program and the VA Veterans First Contracting Program.
