(End of Addendum to 52.212-1)
E.3 52.212-2 EVALUATION COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price, and other factors considered. The following factors shall be used to evaluate offers:
Basis of Award
The Government intends to award a purchase order resulting from this solicitation to the vendor, who can provide the services to meet this requirement. This is a competitive comparative analysis selection in which the competing offeror’s past performance, technical, delivery commitment, and price will be evaluated to determine who represents the greatest benefit to the Government at a price that can be determined fair and reasonable. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement or inability to perform or provide all goods and services requested shall result in an offer being determined technically incapable. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:
A. Following receipt of quotes, the Government will perform a comparative analysis of the goods and services quoted. The Government will compare quotes to one another to select the vendor that best benefits the Government in fulfilling the requirement. The evaluation of Government requirements outlined in the Request for Quote will determine suitability.
B. The Government will evaluate quotes for award purposes using the following factors:
1) Technical Capability
2) Price
3) Past Performance
Factor 1 Technical Capability
Quotes will only be considered from those who are regularly involved in the business called for as listed in the Statement of Work (SOW).
1. The Government will evaluate the ability to show evidence of the reliability, ability, experience, equipment, facilities, and personnel directly employed or supervised by them to render prompt and satisfactory performance for the Personnel Dosimetry Service IAW SOW.
2. The Government will evaluate evidence submitted to demonstrate the Contractor is licensed and regulated by the United States Nuclear Regulatory Commission (NRC) Title
10, Code of Federal Regulations, Part 20-Standards for Protection Against Radiation
(reporting and recording requirements). United States Department Of Labor, Code of
Federal Regulations (CFR) Title 29, Part 1910 – Occupational Safety And Health
Standards. Failure to maintain an appropriate dosimetry program and provide individual monitoring devices or equipment could result in regulatory non‐compliance with the possibility of fines, lawsuits, and/or the revocation of our permit to use byproduct material under the Master Material License issued to the Department of Veterans Affairs by the
NRC. Loss of our permit would result in the termination of all Radiology operations, all other clinical & therapeutic uses of radioactive materials, and the research use of radioactive materials necessary to meet this requirement.
Factor 2 Price –
1. Pricing: The contractor shall submit unit prices rounded to the nearest hundredth. Prices should be documented in Attachment 3 Price Cost Schedule, with the correct unit price and total amount.
2. Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers. Prices will be evaluated for completeness and reasonableness. Unrealistically high or low proposed costs or prices, initially or subsequently, may be grounds for eliminating an offeror from competition either on the basis that the offeror does not understand the requirement or has submitted an unrealistic offer.
Additionally, unbalanced pricing poses an unacceptable risk to the Government and may be a reason to reject an offer. The burden of proof for the credibility of proposed costs/prices rests with the offeror. The Government reserves the right to amend the solicitation and remove any set-aside should pricing of all quotes be found unreasonable.
(b) Options. The Government will evaluate offers for award purposes by adding the total price of all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt unless a written notice of withdrawal is received before the award.
Factor 3 - Past Performance:
The Government will evaluate the relevant past performance submitted by the Contractor.
The references from comparable Veterans’ Affairs contracts must be within the past five years and the documentation shall detail the past performance in providing manufacturing and delivery of services for Personnel Dosimetry Service. References must reflect past performance comparable to the scope and complexity of the requirement.
(End of Provision)
