RFIs for 36C25724B0023 INSTALL NEW AIR HANDLERS BUILDING 29

1. Is this project sales tax exempt? If the project is sales tax exempt can the government provide a sales tax exemption certificate?

Response: 7 V.T.C.A. Tax Code §151.311 Offerors are hereby notified that in accordance with V.T.C.A., Tax Code §151.311, the purchase of tangible personal property for use in the performance of a contract for an organization exempted under Section 151.309 or 151.310 of this code is exempt if the tangible personal property is incorporated into realty in the performance of the contract. Additionally, the purchase of tangible personal property, other than machinery or equipment and its accessories and repair and replacement parts, for use in the performance of a contract for an improvement to realty for an organization exempted under Section 151.309 or 151.310 of the code is exempt if the tangible personal property is necessary and essential for the performance of the contract and completely consumed on the job. The VA is an exempt organization.

Therefore, the contractor’s purchase of such building and construction materials within the State of Texas to be incorporated into the real property belonging to the U.S. Department of Veterans Affairs (VA) or completely used in the performance of the contract is subject to exemption from Texas Sales and Use taxes under the code. To take advantage of the tax exemption the successful offeror under this solicitation must complete a Texas Sales and Use Tax Exemption Certificate when it purchases construction materials for this contract.

Notwithstanding FAR 52.229-3, all bids received in response to this solicitation are presumed to reflect this tax exemption, and therefore should not include Texas’ Sales or Use Taxes on sales of materials for incorporation into VA real estate under this contract or used in the performance of this contract.

2. Can the required SSHO positions be fulfilled by the qualified superintendent?

Response: Yes

3. Will the Government provide comprehensive written badging requirements for the project if badging is required?

Response: Yes, we will provide written badging requirements once a contractor has been chosen and contract is awarded.

4. Will the Owner or GC be responsible for hiring the commissioning agent?

Response: GC

5. Will the Owner or GC be responsible for purchasing testing and lab services?

Response: GC

6. Where will the designated parking area be for workers accessing the construction site?

Response: To be determined. Contractor parking areas are fluid, as are laydown areas, so we’ll determine a parking area during construction kickoff meeting.

7. Will the Owner accept the use of the industry leading Procore Project Management software as the primary submittal and data tracking tool for this project?

Response: No

8. How soon after award is NTP expected to be issued?

Response: Bonds are required before NTP can be issued.

9. Does the Government have a fire alarm servicer that they currently work with? What is the name and contact information of the person or persons that will need to be coordinated with for security and fire alarm and suppression systems work and/or disruptions?

Response: VITEL Communications

10. Due to current potentially significant tariffs being placed on the importation of building materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials? Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin.

Response: This project will be awarded as a Firm Fixed Price contract. No escalation will be considered.

11. Is AISC (American Iron and Steel Certification) required for the structural steel fabrication and/or erection for this project?

Response: Yes, AISC will be required for the AHU bases.

12. Will pay applications for materials secured on site or in a bonded warehouse be approved for payment?

Response: Yes, but we will need proof of a bill of lading.

13. Due to the current economic inflation, Will the government reduce the amount of time that contractors must hold their numbers to 60 days? By reducing the inflation risk, the government will avoid escalations costs that general contractors and subcontractors must account for.

Response: The Government will reduce to 90 days.

14. Will the government consider the inclusion of an Economic Price Adjustment Clause in accordance with Federal Acquisition Regulations (FAR), Subpart 16.203 "Fixed-price contracts with economic price adjustment" and the related contract clause language in FAR 52.216-2, 3, 4? We believe such a clause is appropriate for the following reasons:

· The contract involves an extended period of performance with significant costs to be incurred beyond 1 year after performance begins.

· The contract amount subject to significant fluctuations in price is substantial [may want to list specific examples of highly unstable pricing items within the scope]; and

· The economic variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor, without this type of clause."

Response: This project will be awarded as a Firm Fixed Price contract

15. Does this project comply with the NEW Biden Administration Executive Order 14005 concerning the Buy American Act? This executive order limits the purchase of materials from previously approved countries to include Canada and Mexico. Can you please confirm whether materials or equipment manufactured in these previously approved Buy American Act countries outside the United States can or cannot be used on this project?

Response: Yes this project complies

16. We previously considered bidding this project and it had a $2-5mil budget and it was clearly a project worth of $5mil evident in the bids the VA received, and VA made initial award to ENERGY EPC SOLUTIONS, LLC with a contract amount of $5,746,199.30. Why is the VA still holding a $2-5mil budget without a reduction in scope?

Response: The magnitude of construction for this project is Between $5,000,000 and $10,000,000 according to VAAR 836.203-70.

17. The provided drawings (GC100 through GC103) show ICRA “Hard” boundaries only at the edges of the phasing work areas. Does this mean that all residents of these areas will be relocated during the work for that phase?

Response: No

18. If the residents will not be relocated, what are the ICRA requirements for the individual areas that will be disturbed inside each phase, and will the hard barriers still be required at the edges of the phase boundaries?

Response: Level IV.

19. Please confirm the proposed phasing plan has been agreed to by the facility and the work areas will be vacant during construction.

Response: Work areas will not be vacant except for the mech room.

20. Has the government arranged for swing space for the building’s displaced tenants.

Response: There will be no displaced tenants.

21. How much down time will the government need between each phase? Will the contractor be afforded additional POP to offset the required transition time?

Response: This will depend on what work is performed and where.

22. Please provide the make and model of the panelboards requiring new breakers.

Response:

Panels are as follows:

Panel EC2 = Square D Panel EHC = General Electric Panel MCP = General Electric Field verify panelboard models during site investigation.

23. Please confirm no environmental hazards such as lead, ACM, and/or PCBs are expected to be encountered during construction and require abatement.

Response: No environmental hazards are expected.

24. Please confirm any unforeseen environmental hazards will be treated as a Differing Site Condition and handled under the contract’s change and differing site conditions provisions.

Response: That is correct

25. Please confirm temporary HVAC isn’t required for this project. If temporary HVAC is required, please provide a stamped and engineered temporary HVAC plan from the DOR.

Response: A temp AHU is required for this project.

26. The POP for the project isn’t commensurate with industry lead times for HVAC Equipment. Current lead times for custom indoor HVAC AHUS are running anywhere from 9-12 months. VFDS lead times are still hovering around a year. Please extend the POP or provide an administrative NTP to allow submittals and procurement to commence prior to construction NTP.

Response: Once contract has been awarded and submittals approved, contracting will adjust POP accordingly.

27. Will crane work need to be performed on the weekend?

Response: This will depend on the scope of the crane plan and how the crane will be used on the project, as well as recommendations from our safety office after review of the plan.

28. Is the existing roof under warranty? If so, please provide the name of the roof manufacturer and the installation contractor.

Response: See attached roof warranty and roof drawings.

29. Please provide the name of the existing roofing system installed at the facility.

Response: See attached roof warranty and roof drawings in RFI 28.

30. During the Pre-Bid site visit, the Contractors were shown an AHU Tagged AHU-3 and instructed the pneumatic controls for the unit were to be replaced with DDC. Please advise if the work mentioned above is included in the project scope of work.

Response: We do not remember this during the site visit. There is no AHU 3 associated with the CLC.

31. How many VAV’s can be replaced at one time?

Response: This will depend on the location and occupancy of the areas.

32. Please confirm the location of the contractor’s laydown yard.

Response: This will be determined after award. Laydown areas are assigned once the GC starts work.

33. Is the contractor to provide a new through roof steam vent for the new steam system or are we to utilize an existing vent?

Response: The existing steam vents risers are to remain. Some shorter lengths of new steam pipe will be needed to connect the new SPRV station and the new SFT to the existing steam vent piping. Refer to MP104 for connections of new steam vent piping to existing-to-remain connections.

34. Confirm cleaning of existing ductwork is confined to the basement mechanical space only.

Response: Cleaning of the existing ductwork is to include all ductwork serving Building 29 CLC.

35. Confirm the temp AHU can be placed in the grass area adjacent to the basement mechanical room.

Response: Yes.

36. This project’s scope of work includes a new steam line to be installed in the basement. During the site walk contractors were unable to view the basement area where the new steam pipe will be installed. Please provide pictures of the location where the new steam pipe is to be installed. How is the existing utility tunnel to be accessed for work to be completed? Is the basement an operational area of the facility? If the ceiling space where the steam line to be installed is within an operational area, when can the ceiling be removed, and steam line installation work performed?

Response: Those who attended the site visit were afforded the opportunity to access the basement area and take photos during the site visit. We also offered access to the steam tunnel, but no one accepted. The steam tunnel can be accessed through the boiler plant. Part of the ceiling is in the Endo clinic, but most is in the mech room where the AHUs will be replaced.

37. Are we to dispose/abate of any asbestos, lead, mold, or other hazardous material as part of this project? If so, provide appropriate hazardous material site survey report.

Response: There should be no asbestos or lead.

38. What will the ICRA level be for this project?

Response: Level III for the Mech Room and Level IV for 1st and 2nd floors (occupied floors).

39. Are there any required/proprietary subcontractors the general contractor is to hire associated with this project?

Response: Control Technologies (CONTECH) for controls.

40. Will all work associated with this project able to be performed during regular working hours?

Response: Yes, most will be. But utility and steam outages might need to be scheduled on weekends or holidays.

41. Are we required to provide a 24 hour/day on-site fire watch during demolition?

Response: Yes, if the fire alarm or fire suppression system is inactive for more than 8 hours.

42. Please confirm 1) Fire Suppression to be left in place as-is. 2) Parts of the fire suppression are to be replaced. If so, please specify what is to be replaced. 3) The entire fire suppression system is to be removed and replaced throughout the entire construction space.

Response: The existing fire suppression system shall be modified to be compliant with NFPA 13, and to accommodate changes that may cause obstruction. NFPA 13 requires fire suppression heads under ducts wider than 48”. Several of the new duct mains in the mechanical room are wider than 48”. The existing fire suppression heads lower than existing ductwork shall be repositioned to within 12” of the underside of new ductwork, or of the above floor deck, if no new duct is provided.

43. Is there an existing a company that the VA uses for integrating the controls system? If so, can you provide company contact information?

Response: Control Technologies (CONTECH).
