About this file
This is a Brand Name Justification and Approval (J&A) document for Other Than Full and Open Competition submitted by the Department of Veterans Affairs, VISN 16, Jackson MS VA Medical Center.
The justification supports Project No. 586-22-703 EHRM TASS and requests approval to procure specific branded components without full and open competition based on the statutory authority of 41 USC §3304(a)(1) (Only One Responsible Source). The required items are: (1) eighteen (18) Siemens Fire finder sensors and panels; (2) two (2) Johnson Controls temperature and humidity sensors; and (3) one (1) Software House alarm panel. The justification cites the necessity for seamless integration with existing HVAC and alarm systems, noting that Siemens and Johnson Controls have proprietary hardware and software that cannot interface with competitors' systems. Diverting from these brands would require costly system overhauls, increased inventory, multiple monitoring stations, and operational disruption to the medical center. The overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) set-aside with only the identified brand-name items restricted to proprietary sources. The Contracting Officer indicates the anticipated cost is approximately $00 (redacted), with fair and reasonable pricing to be determined post-award based on competitive proposals. The justification will be posted to SAM.gov with the solicitation, and offerors will be responsible for obtaining authorized personnel from brand-name suppliers for installation and work performance.

DEPARTMENT OF VETERANS AFFAIRS
Brand Name Justification and Approval (J&A) For
Other Than Full and Open Competition (<SAT)
Acquisition Plan Action ID: 36C256-26-AP-0074
1. Contracting Activity:
Department of Veterans Affairs, VISN 16, Jackson MS VA Medical Center. Network
Contracting Office (NCO) 16. 2237# 586-26-3-1581-0003.
2. Nature and/or Description of the Action Being Processed:
This justification is to support Project No. 586-22-703 EHRM TASS at the VAMC. This justification is for other than full and open competition for the procurement of the Siemens Fire Alarm components, Johnson Controls HVAC components, Software House Access Panels and Vicon Cameras of this requirement as listed below. The use of a particular brand name for these items listed below accommodates standardization of these items throughout the facility.
1) Siemens Fire finder sensors and panels
2) Johnson Controls Temperature and Humidity Sensors
3) Lynx Panic Alarm Panels
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The additional items for the above-mentioned project. See descriptions below:

4. Statutory Authority Permitting Other than Full and Open Competition:
VHAPG Part 806.3 OFOC Page 2 of 4 Revision: 02 Effective Date: 11/15/23 Acquisition ID#: 36C256-26-AP-1057
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
() (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
() (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;
() (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 () (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR
6.302-5;
() (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
() (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The VAMC needs a seamless tie in with the HVAC and existing alarm systems or cost prohibitive overhaul would be required. Siemens and Johnson Controls Inc have proprietary hardware and software that will not seamlessly interface with other control manufacturer’s hardware/software. Diverting from this brand will require the VA to increase its inventory of HVAC Control Components and require additional investment. The current systems have proven reliability and the VA is comfortable working with these systems. It would not be feasible, either from a control (technical) or a monetary (fiscal) standpoint, to have multiple controls manufacturer’s equipment and software on campus that would not interface with each other and would take multiple monitoring stations to function and to monitor. Installing a different manufacturers’ system will create increased cost for the facility, and in most cases the equipment will not function properly.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to SAM. gov with the solicitation.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The AVAHCS provided a complete government estimate. The anticipated price to the Government for the items requested to be brand name is approximately $00.
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the
Reasons Market Research Was Not Conducted:
Market research was not conducted because a competitive procurement process will be
VHAPG Part 806.3 OFOC Page 3 of 4 Revision: 02 Effective Date: 11/15/23 Acquisition ID#: 36C256-26-AP-1057 used. Competing firms will deliver fair market prices for systems and items listed as all systems are common and use standard off the shelf components. The Contracting Officer and COR were in concurrence with information provided. Approval of the items as "brand name only" is critical for the overall efficiency of the completed project and the AVAHCS facility.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The Request for Proposal for this construction project will be a 100% SDVOSB set aside competitive requirement and only the brand name items identified are to be from the proprietary source.
Offerors are also responsible for obtaining authorized personnel with the brand name suppliers for installation/work performance as needed. New components must be able to tie into an existing and operational system including the use of software. Converting the software system tie-ins to another manufacturer's system to accommodate portions of the facility complex would be extremely disruptive to medical center operations and prohibitively expensive.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Not applicable. It is the responsibility of the offerors, and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.

I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
13. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
